4. On or about May 2, 1997, McCabe entered judgment in this court.
S. McCabe served Defendant Alana Kay with post judgment interrogatories on or
about May 12, 1997.
6. Pursuant to Pa. R. C. P. 4006(a)(2) Defendant's responses 10 the same were
due within 30 days thereal1er, but none had been received.
7. In response to Defendant Alana Kay's failure to comply, McCabe filed a motion
to compel and His Honorable Court issued a show cause order in response dated June 20,
1997, which ordered the Defendant to respond within 20 days.
8. McCabe served a copy of the aforementioned show cause order via U. S. Mail,
first class certified, restricted delivery on July 2, 1997, on the Defendant, Alana Kay.
9. Defendant failed to respond to the order referred to in Paragraph (8) above and
McCabe responded by tiling a motion for sanctions with this Court.
10. On August I, 1997, His Honorable Court treated the motion referred to in
Paragraph (9) above as a motion to make the rule absolute and issued an order
accordingly which provided for, inter alia, that Defendant respond within 20 days of the
date of the order by providing answers to the Plaintil1's Interrogatories or suITer the
imposition of sanctions.
II. Defendant Alana Kay failed to respond to the order of this Court of August I,
1997.
12. On August 29, 1997, McCabe filed a motion for sanctions against Kay which
was scheduled for a hearing December 8, 1997.
13. On December S, 1997, McCabe assigned judgment to Plaintif17judgment
creditor, Robert D. Kline which was entered of record December 8, 1997. All Defendants
were notified of the assignment.
14. On December 8, 1997, PlaintitTattended a hearing in His Honorable Court for
the imposition of sanctions against Defendant Alana Kay to which she did not attend.
