she caused the accident at the accident scene when she stated that the driver in the lane next to
Mr. Hoesch waved her through the intersection,
II. Statement as to Damages:
The impact of this collision caused immediate pain to Mr. Hoesch's left shoulder and hip,
Soon after the accident, Mr. Hoesch also developed a feeling of numbness and heaviness in his
upper left chest area that radiated into his left thumb.
The sharp pain in his left shoulder made it difficult for Mr. Hoesch to move his arm.
Moreover, his left arm was numb, causing him to periodically drop items that he was holding,
He was also having difficulty with sleeping; he slept on his left side which had been injured in the
accident,
Mr, Hoesch treated with an orthopedic surgeon for approximately six months and he was
unable to rectify Mr, Hoesch's pain, Mr, Hoesch has permanent injuries as a result of this
accident, These injuries include continued pain in his left shoulder, limitation of motion of his
upper left extremity, as well as paresthesia of the effected extremity. Moreover, his left hand goes
cold on a daily or every other day basis,

Unfortunately Hoesch Is disabled for reasons unrelated to the accident. He
underwent extensive chest surgery In October of 1995 to remove a tumor from his lung, Nerve
damage was done that causes constant pain to Hoesch, which prevents him from doing
anything except laying down on his bed or sofa,

4. On or about May 3, 1995, at approximately 5:30 p,m.,
Plaintiff Dennis W. Hoesch was operating a 1990 Buick LaSabre
traveling southbound on State Route 114 in the left hand lane in
Silver Spring Township, Cumberland County, Pennsylvania.
5. At or about the same time Defendant Martha Smith was
operating a 1990 Pontiac Grand Prix traveling northbound on State
Route 114, Silver Spring Township, Cumberland County, Pennsylvania.
6. As Defendant Martha Smith approached the intersection of
State Route 114 and Sporting Green Drive, she slowed to a stop to
make a left onto Sporting Green Drive.
7. After stopping at the intersection of Route 114 and
Sporting Green Drive, Defendant Martha Smith proceeded into the
southbound State Route 114 and collided with the vehicle being
operated by Plaintiff Dennis W, Hoesch.
B. As a result of the incident, Plaintiff Dennis W. Hoesch
suffered severe and permanent injuries, including, but not limited
to the following: (a) contusions, injuries and pain to his left
shoulder and hip; (b) stiffness in his back and hips; (c) pain in
left hand, forearm and thumb; and (d) various other injuries.

(b) She operated her 1990 Pontiac Grand Prix in
violation of the assured clear distance rule;
(c) she failed to be observant and was inattentive
when operating the 1990 Pontiac Grand Prix;
(d) she failed to be highly vigilant when operating
the 1990 Pontiac Grand Prix with respect to other
vehicles also in the roadway;
(e) she failed to apply or negligently applied her
brakes in an attempt to avoid the accident;
(f) she failed to have the 1990 Pontiac Grand Prix
under proper control to be able to stop before striking
vehicles in the roadway ahead; and
(g) she operated the 1990 Pontiac Grand Prix in a
careless and reckless manner,
WHEREFORE, Plaintiff Dennis W, Hoesch respectfully requests
this Honorable Court to enter judgment against Defendant Martha
Smith in an amount in excess of $25,000, plus interest and costs,
said amount being in excess of applicable arbitration limits.
