AND NOW, this ~ day of ~, 1997, after careful

consideration of the attached petition for settlement of Wrongful
Death Claim and the various Exhibits attached to said Petition, it
is hereby ordered and directed as follows:
1
Settlement of the above-captioned wrongful death claim is hereby
APPROVED at a cun'ent settlement figure of $75,000 to be
distributed as set forth below.

David M. Fissel, in his capacity as AdmiJlistrator of the Estate of
Angela M. Fissel, is hereby authorized to enter into a Release
Agreement whereby Defendant Martin J. Serucsak and All State
Insurance are released from dny and all claims that may be
prosecuted against them by the Estate of Angela M. Fissel and any
claims that may be prosecuted agai!lst them on behalf of the child
of Angela M. Fissel, Rory Ri~hard Stine, as a result of injuries
suffered by Angela M. F.:ssel in the automobile accident of May 19,
1995.

Payment of the settlement proceeds in this case is approved under

PETITION FOR SETTLEMENT OF WRONGFUL DEATH CLAIM
David M. Fissel, by his attorneys, Broujos & Gilroy, P.C., sets
forth the following Petition for Settlement of Wrongful Death Claim
and alleges as follows:

Petitioner, David M. Fissel, is an adult individual residing at 166
12th Street, New Cumberland, Cumberland County, Pennsylvania.

Petitioner is the Administrator of the Estate of Angela M. Fissel
pursuant to the Short Certificate issued by the Cumberland County
Register of Wills at File No. 1995-00524. A copy of said Shoort
Certificate is attached hereto and marked Exhibit "A".

Angela M. Fissel died as a result of injuries suffered in an
automobile accident on May 19, 1995.

Angela M. Fissel (hereinafter referred to as the "Decedent ") had an
unspecified address at the time of her death but was using the
address of her parents at 17 Shady Lane, Eno1a, Cumberland County,
Pennsylvania.

At the time of her death, Decedent was unmarried. She had never
previously been married. She was survived by her child, Rory
Richard Stine who was born on January 30, 1979.

The child Rory Richard Stine is a student at East pennsboro High
School and currently resides with his maternal grandparents, James
and Linda Fissel at 17 Shady Lane, Enola, Cumberland County,
Pennsylvania.

The date of the accident which caused the Decedent's death was May
19, 1995. The accident took place in Reed Township, Dauphin
County, on S.R. 22/322. At the time of the accident, the Decedent
was a pedestrian crossing the roadway and she was struck by a
vehicle driven by the Defendant, Martin J. Serucsak. A copy of the
Police Accident Report pertaining to the incident is attached
hereto and marked Exhibi t "B".

Allstate Insurance (Allstate) is the liability insurance carrier
for the Defendant in the above matter.

Allstate has offered the sum of $75,000 to settle all claims
against the Defendant arising out of the accident in question.

The following information is relevant with respect to the
evaluation of the settlement offer of Allstate Insurance:
A. At the time of the accident, Decedent was unemployed and
her work record prior to the accident l{aS very irregular.
She had been incarcerated for approximately two years at
the Muncy Sta te Correctional Insti tution and had been
released from jail in December of 1993. Between her
release from jail and her death, she had worked for two
or three employers for a time frame of only a few weeks
with each employer, and worked temporary employment for
a few months.
B. Because the Decedent l{aS a pedestrian and she had walked
in front of the vehicle driven by the Defendant, there is
a question of liability on the Defendant.
C. Legal counsel for the Petitioner retained Anderson
Associates Psychological Consul ting services to do a
voca ti ona1 eva1 ua ti on report for the Decedent. A copy of
that report is attached hereto and marked Exhibit "C".
Said report suggests a total loss of earnings potential
of only $132,400.
D. There is no concrete evidence of any conscious pain and
suffering incurred by the Decedent immediately after the
accident and prior to her death.

The undersigned counsel and the Peti tioner herein believe and
allege that the settlement of $75,000 as proposed by Allstate is
.
fair and reasonable under all circumstances to all parties
invol ved.

Pursuant to the Fee Agreement the Peti tioner struck wi th the
undersigned counsel, Petitioner would propose that the Court
approve attorneys's fees in this case payable to Broujos, Gilroy &
Houston, in the amount of $8,330 plus an additional $545 as
reimbursement for costs advanced. Costs advanced in this Court
case inc1 uded the payment of $500 for the mentioned voca tional
report (Exhibi t "C") and the filing fees to ini tia te the above
action.

Petitioner would propose that the remaining monies, $66,125, should
be payable to the Decedent's child, Rory Richard Stine. Payment to
the child Rory Richard Stine would be based upon the following:
A. Petitioner suggests that the entire settlement proceeds
be allocated to the wrongful death portion of a claim in
this matter. Such allocation is appropriate in the light
of the fact that the Decedent had no conscious pain and
suffering that would be appropriately payable to the
survival action, and is also appropriate in light of the
fact that it would be understandable that Decedent would
have an obligation for care and maintenance of her child.
B. Decedent died intestate. In apportioning wrongful death
recovery in pennsyl vania, pennsyl vania case law has
provided that the Intestate Act shall be followed.

INTRODUCTION
A vocational assessment of Angela M. Fissel was conducted in my offices
on the date of 10/18/96. The assessment consisted of a records review to
evaluate the economic implications of damages to be computed under the
Pennsylvania Survival Action provisions. Miss Fissel died on 5/19/95 as
the result of a motor vehiCle/pedestrian accident.
REVIEW OF RECORDS AND REPORTS
1. Pennsylvania State Police accident reports dated 5/19/95.
2. East Pennsboro High School transcripts.
3. Pennsylvania Business Institute (Harrisburg Area Community
College) .
BACKGROUND
Miss Fissel was killed on 5/19/95 in a motor vehiCle/pedestrian
accident. According to Pennsylvania State Police accident reports from
that date, Miss Fissel exited from a tractor trailer in which she had
been riding and was attempting to cross a four-lane highway in the
vicinity of the Clarks Ferry Truck Stop/ Duncannon, Perry County, Pa.,
when she was struck by a van. Miss Fissel died at the scene of the
accident.
SOCIOFAMILIAL BACKGROUND
Miss Fissel was raised in Enola, Pa. She was never married, but she has
a son who was 17 at the time of this evaluation. The son, Rory Stine,
resides with his maternal grandparents, James and Linda Fissel/and
attends East pennsboro High School. Miss Fissel reportedly did not
assist financially with her son's upbringing.
Miss Fissel was incarcerated for approximately two years in Muncy State
Penitentiary. She was released from prison in December of 1993 and
entered a hal fway house. She had traveled to Florida in the weeks
immediately prior to her death, and then hitchhiked home. Miss Fissel
was collecting welfare at the time of her death.
EDUCATIONAL BACKGROUND
Miss Fissel attended school to the 12th grade at East pennsboro High
School. She did not receive a diploma. She became pregnant while a
senior in high school and terminated her education at that point. Her
secondary school records indicate that she was a below-average student
in high school, obtaining mostly "e's" and "D's".

However, during Miss Fissel's noted incarceration, she obtained her
General Equivalency Diploma and then obtained schooling from Harrisburg
Area Community College's Pennsylvania Business Institute. She completed
54 credits of study in business-related courses, including introduction
to computers, business mathematics, business law, business organization
and related classes. She exhibited a dramatic improvement in her
academic achievement. She achieved the President's List during every
semester she completed, and finished with a 4.0 grade-point average.
VOCATIONAL BACKGROUND
Miss Fissel did not have an extensive vocational background. Following
her release from prison in 1993/ Miss Fissel worked for a temporary-
employment agency for approximately one year. In 1995/ shortly before
her death, she worked for a short time both as a waitress at a Ginger-
bread Man restaurant and as a clerk at a Uni-Mart convenience store. She
was not employed at the time of her death.
VOCATIONAL IMPLICATIONS
1. Miss Fissel's vocational history does not lend itself to predicting
a vocational future for her based on the history alone. However,
judging from her educational attainment at the Pennsylvania
Business Institute, it is reasonable to expect that Miss Fissel
would minimally have engaged in low-level clerical occupations,
such as information clerk, receptionist, customer-service represen-
tative/ or clerk-typist. These positions are consistent with Miss
Fissel's level of educational achievement and pay from $5.50 to $7
per hour, averaging $6.25 per hour or $13/000 annually for an
individual with Miss Fissel's background.
2. Deducted from a model of lost earnings hereinafter projected will
be maintenance costs, which are those minimal expenses that are
required to live and to maintain productive capacity, according to
the U.S. Department of Labor, Bureau of Labor Statistics, August,
1986/ Bulletin 2267/ Consumer Expenditure Survev: Interview Survev.
~. According to that publication, the annual consumption budget
for a single person under 35 years of age is $6,380 for the
intermediate budget level.
ECONOMIC IMPLICATIONS
1. Miss Fissel was 33 years of age at the time of her death. Accord-
ing to data presented by the U.S. Department of Labor, Bureau of
Labor Statistics in Bulletin 2254/ Worklife Estimates: Effects of
Race and Education, she normally could have expected a worklife
expectancy to the age of 52.9 (rounded to 53) / or an additional 20
years.
