WHEREAS, KOLLAS AND COSTOPOULOS, of 1104 Femwood Avenue, Camp
Hill, Cumberland County, Pennsylvania, hereinafter referred to as Owner, is about to execute
contemporaneously herewith, a contract, with RUSSELL A. TIDA Y, for the erection of a house
ancillary to development in a complex known as Wertz Run Heights, Cumberland COImty,
Pennsylvania, construction described as follows:
ALL THOSE CERTAIN tracts or parcels of ground on Lot 1114 of North Middleton
Township, Cumberland County, Pennsylvania, more particularly bounded and described as set forth
in Exhibit "A," attached hereto and made a part hereof.
NOW, this 30th day of April, 1997, at the time of and immediately before the
execution of the principal contract dated April 30, 1997, and before any authority has been given by
the said Owner, to the said Contractor to commence work on the said building, or purchase materials
for the same in consideration of the marking of the said contract with Owner, and the further
consideration of One Dollar and 001100 ($1.00), to Contractor paid by Owner, it is agreed that no
lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the
material men or workmen or any other person for any labor, or materials purchased, or extra labor
or materials purchased for the erection of said building, tile right to file such liens being expressly
waived,

Association South 18 degrees 43 minutes 36 seconds West, a distance of 206.52 feet to
a point at Lot #15; thence along Lot #15 North S2 degrees 45 minutes 00 seconds West,
a distance of 369.55 feel to a point on the eastern right-of-way line of Grant Court, the
point of BEGINNING,
Lot #14 contains 55,144.73 square feet or 1.266 acres.
