By order of Court of President Judge George E. Hoffer
dated June l, 1999, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on May 7, 1997, raising
grounds for divorce of irretrievable breakdown of the marriage
and the economic claims of equitable distribution, alimony,
alimony pendente lite. The complaint avers in Paragraph a that
the parties separated on November 21, 1996. Consequently,
grounds for divorce do not appear to be an issue.
I am directing each counsel to file a pre-trial statement
in accordance with P,R.C,P. 1920.33(b) on or before Tuesday,
July 6, 1999, Upon receipt of the pre-trial statements, I will
immediately schedule a pre-hearing conference with counsel to
discuss the issues and, if necessary, schedule a hearing.

AND NOW COMES, CATHY A. BELL, Plaintiff, by her attorney, Ruby D.
Esquire, who avers as follows:
Weeks,
1. Plaintiff, an adult sui juris, is CATHY A. BELL, a U. S. citizen, who currently
resides at 103 East Portland Street, Mechanicsburg, Cumberland County,
Pennsylvania 17055, since November 21, 1996.
2.
Defendant, an adult sui juris, is RONALD L. BELL, a U. S.
citizen, who
currently resides at 9515 Muddy Run Road, Orrstown, Franklin County,
Pennsylvania 17244, since November 21, 1996.
3. Plaintiff and Defendant have been bona fide residents of the Commonwealth of
Pennsylvania for at least six months immediately previous to the filing of this
Complaint.
4. The Plaintiff and Defendant were married on February 13, 1971, at Mechanicsburg,
Cumberland County.
5. There have been no prior actions of divorce or annulment between the parties in
this or any other jurisdiction.
6. Neither party is a member of the Armed Forces of the United States.
7. The marriage is irretrievably broken.
B. Plaintiff and Defendant have lived separate and apart since November 21, 1996.
9. Plaintiff has been advised as to the availability of counseling and that she may
have the right to request that the Court require the parties.to participate in
counseling.
10. Plaintiff requests the Court to enter a decree of divorce.
COUNT I - IRRETRIEVABLE BREAKDOWN

hereof.
12. The marriage is irretrievably broken.
a. Plaintiff and Defendant have lived separate and apart since November 21,
1996.

counseling.
14. Plaintiff requests the court to enter a decree of divorce.
COUNT II - REOUEST FOR DIVISION OF PROPERTY
UNDER SECTION 53502 OF THE DIVORCE CODE
15. Paragraphs 1 through 14 are hereby incorporated by reference and made a part
hereof.
16. The parties purchased or otherwise obtained during the course of their marriage
property which is considered "marital property".
17. Upon entry of a divorce decree, such property should be divided equitably as is
just and proper.
COUNT III - ALIMONY AND ALIMONY PENDENTE LITE
lB. Paragraphs 1 through 17 are hereby incorporated by reference and made a part
hereof.
19. Plaintiff lacks sufficient means of support at present to fully provide for her
reasonable needs, despite the fact she is employed. Plaintiff requests an award
of alimony pendente lite.
20. Plaintiff requires reasonable support to adequately maintain herself in
accordance with the standard of living established during the marriage.
21. Defendant is financially able to provide for the reasonable needs of Plaintiff.
COUNT IV - CHILD SUPPORT
22. Paragraphs 1 through 21 are hereby incorporated by reference and made a part
hereof.
23. Plaintiff lacks sufficient means of support at present to fully provide for the
reasonable needs of their child, despite the fact she is employed. Plaintiff

Counter-Defendant is Cathy E. Bell, whose last known
residence and present whereabouts are in Cumberland County,
Pennsylvania, with a mailing address of 139 Peach Lane,
Mechanicsburg, Pennsylvania 17055 since October 1997.

Counter-Plaintiff and Counter-Defendant have been bona
fide residents of the Commonwealth of Pennsylvania for at
least six months immediately previous to the filing of this
complaint.

The Counter-Plaintiff and Counter-Defendant were
married on February 13, 1971, at Mechanicsburg, Cumberland
County, Pennsylvania.
13.
There have been no prior actions for divorce or
annulment of marriage between the parties in this or in any
other jurisdiction except for the above captioned action.
14.
The marriage is irretrievably broken.
15.
The Counter-Plaintiff has been advised of the
availability of counseling and that the plaintiff may have
the right to request that the court require the parties to
participate in counseling.
16.
Counter-Plaintiff requests the Court to enter a decree
of divorce.

incorporated herein by reference thereto as if fully set
forth herein.

Plaintiff is without sufficient funds or estate or
income to provide for her reasonable needs and is unable to
support herself through appropriate employment.
27.
Plaintiff requires reasonable support to adequately
maintain herself in accordance with the standard of living
established during the marriage.
28.
Plaintiff requests the court to enter an award of
reasonable temporary alimony until final hearing and
permanently thereafter.

Both parties have pension interests, however, Mrs. Bell, believes the values put forth to be
inaccurate and is therefore seeking to submit her own valuation of both pensions prior to the date of
trial. Furthennore, given her age, health, future earning ability and the economic harm effected
upon her by the bankruptcy filing, Mrs. Bell believes that her pension will be just enough to meet
her reasonable needs upon retirement and that the division proposed by Mr. Bell would not promote
eeunomic justice between the parties.

Defendant does not anticipate needing expert witnesses, however, she reserves the right to provide

Neither pension is 100% marital. Pensions while not exempt from equitable distribution may be
administered as part of the bankruptcy estate to the extent that they exceed reasonable needs.
Therefore, the marital interest in defendant's pension may also be subject to administration by the
Chapter 7 Trustee.
VII. Marital Debt
Obligations as to marital debts are res judicata as per the bankruptcy filing by Mrs. Bell.
