COMPLAIN~
AND NOW, comes the Plaintiff Robert Dowell, by and through
his attorneys, Saidis, Guido, Shuff & Masland and aver as
follows:
1. The Plaintiff is Robert Dowell, an adult individual who
currently resides at 1568 Boiling Springs Road, Boiling Springs,
Cumberland County, Pennsylvania.
2. The Defendant, Thomas E. Thoenig is an adult individual
who currently resides at Dingmans Ferry, Pennsylvania.
3. The Defendant, Superior Carriers, Inc. is an Illinois
business corporation which regularly does business in the
Commonwealth of Pennsylvania.
4. The events hereinafter complained of occurred on or
SAID IS, GUIDO,
SHUFF &
MASLAND
about July 11, 1996 along Interstate 81 in the Borough of
Carlisle, Cumberland County, Pennsylvania.
5. At said time and place Plaintiff was operating a 1992
Oldsmobile Sedan northbound on the said Interstate 81.

6. At said time and place the Defendant Thoenig
was
operating a 1995 Mack Truck in a northbound direction on the said
Interstate 81.
7. At all times relevant hereto, Defendant Thoenig was an
agent and/or employee of Defendant Superior Carriers, Inc. acting
in the course and within the scope of his employment and/or
agency.
8, At the aforesaid time and place, the Mack Truck being
operated by Defendant Thoenig for and on behalf of Defendant
Super ior Carriers, Inc. collided with the rear of the vehicle
being operated by Plaintiff.
9. Plaintiff's damages as hereinafter set forth were the
direct and proximate result of the negligence of Defendant
Thoenig then and there occurring.
10. Defendant Thoenig was negligent generally and in the
following particulars:
a. Operating his vehicle in a reckless manner;
b. Failing to have his vehicle under proper
control;
c. Failing to stop before colliding with
Plaintiff's vehicle;
d.
ahead;
Failing to maintain an assured clear distance
e.
Following too closely to Plaintiff's vehicle;
f,
Travelling too fast for conditions; and
SAIDIS. GUIDO,
SHUFF &
MAS LAND
g. Failing to comply with the provisions of the
Pennsylvania Motor Vehicle Code relating to the
operation of motor vehicles, specifically as it relates
to the aforesaid acts of negligence.
