4. Defendant Leon C. Baker is an adult individual with an address of20 Heather Drive,
Carlisle, Cumberland County, Pennsylvania.
5. Defendant Baker, Dence & Baker contracting is believed to be a Pennsylvania
partnership with an address of20 Heather Drive. Carlisle, Cumberland County. Pennsylvania.
COUNT I: BREACH OF CONTRACT
6. Paragraphs I through 6 are incorporated herein by reference as if set forth in their
entirety.
7. On or about March 5, 1996, Plaintiffs entered into an Agreement of Sale with
Defendants to purchase that certain tract of real estate then known as Lot #11, Ritner Highway,
Carlisle. Cumberland County, Pennsylvania and now known as 2472 Ritner Highway, Carlisle,
Cumberland County, Pennsylvania (hereinafter "Property") for a purchase price of$167,321.00.
A true and correct copy of the Agreement of Sale and Purchase of Real Estate (hereinafter
collectively referred to as "Agreement of Sale") is attached hereto as Exhibit" A" and by
reference incorporated herein and made a part hereof.
8. Pursuant to Subparagraph 2 of Paragraph 9, Sellers were to provide a one year
warranty on the home.
9. On May 17.1996, pursuant to the Agreement of Sale, Plaintiffs purchased the
Property from Defendants, A true and correct copy of the Deed and Settlement Sheet is attached
hereto as Exhibit "B" and by reference incorporated herein and made a part hereof.

10, Upon taking possession of the property, Plaintiffs discovered that the Property had
surface water problems, foundation problems, water coming in sewage pipes. basement leaking
problems, an inadequate sump pump, and a steel "I" beam shimmed with wood instead of steel
plates or masonry. A copy of the inspection report by Harold Bender, an inspector for Middle
Department Inspection Agency, Inc. Is attached hereto as Exhibit "C" and by reference
incorporated herein and made a part hereof.
II. On numerous occasions. Plaintiffs contacted Defendants to have them. pursuant to
the warranty, repair the problems listed in Paragraph I 0 above and the inspection report attached
hereto as Exhibit "C".
12. On each and every instance. Defendants have refused to correct the deficiencies with
the property, all of which would be covered under a builder's warranty.
13. The extent of damage or deficiencies to the Property are such that Defendants knew,
or should have known, that the Property had been improperly constructed and contained
construction problems,
14. Plaintiffs have obtained a quotation from an independent contractor, Sheriff
Builders. Inc., for all treatment and repairs necessary to correct the damage and deficiencies at
the Property. A true and correct copy of said quotation/proposal is attached hereto as Exhibit
"D" and by reference incorporated herein and made a part hereof.
] 5. Plaintiff has suffered an ascertainable loss as a result of Defendants' actions of FIVE
THOUSAND SIX HUNDRED ($5,600.00) DOLLARS for the cost to treat the Property and
make all the necessary repairs to the Property due to said damage and deficiencies.

WHEREFORE. Plaintiffs respectfully demands judgment against Defendants, jointly and
severally, in the amount of FIVE THOUSAND SIX HUNDRED ($5,600.00) DOLLARS, which

COUNT II: BREACH OF WARRANTY OF HABITABILITY
16. Paragraphs I through 15 are incorporated herein by reference as if set forth in their
entirety.
17. At the time Plaintiffs and Defendants contracted and agreed upon the terms of the
Agreement of Sale, attached hereto as Exhibit" A". Defendants warranted to Plaintiffs that the
Property would be properly constructed and would be habitable.
18. Upon taking possession of the property, Plaintiffs discovered that the Property had
surface water problems, foundation problems, water coming in sewage pipes, basement leaking
problems, an inadequate sump pump, and a steel "I" beam shimmed with wood instead of steel
plates or masonry as detailed in the Inspection Report attached hereto as Exhibit "C" and by
reference incorporated herein and made a part hereof.
19. On numerous occasions, Plaintiffs contacted Defendants to have them repair the
problems pursuant to the warranty.
20, On each and every instance, Defendants have refused to correct the deficiencies with
the property, all of which would be covered under a builder's warranty.
21. The extent of damage or deficiencies to the Property are such that Defendants knew,
or should have known, that the Property had a construction problems.

22. Plaintiffs have obtained a quotation from an independent contractor, Sheriff
Builders, Inc" for all treatment and repairs necessary to correct the damage and deficiencies at
the Property. A true and correct copy of said quotation/proposal is attached hereto as Exhibit
"c" and by reference incorporated herein and made a part hereof.
23. Plaintiff has suffered an ascertainable loss as a result of Defendants' actions of FIVE
THOUSAND SIX HUNDRED ($5,600.00) DOLLARS for the cost to treat the Property and
make all the necessary repairs to the Property due to said damage and deficiencies.
24. Because of Defendants failure to correct known defect to the Property (i.e., see
Paragraph 10 above). said Property is uninhabitable due to the construction problems at the
Property.
25. Said uninhabitability violates the implied warranty of habitability that Defendants
as the sellers gave to Plaintiffs as the purchasers of the Property.
WHEREFORE, Plaintiffs respectfully demands judgment against Defendants, jointly and
severally, in the amount of FIVE THOUSAND SIX HUNDRED ($5,600.00) DOLLARS, which
sum does not exceed the limits requiring compulsory arbitration, together with interest thereon,
and the costs of suit,
COUNT III: MISREPRESENTATION

27. Defendants intentionally. knowingly. and with fraudulent intent, misrepresented
to Plaintiffs that Defendants would construct a home pursuant to the plans attached hereto as
Exhibit "e" and by reference incorporated herein and made a part hereof.
28. Defendants representations were made knowingly and intentionally to deceive
Plaintiffs, and as such the Defendants' actions were wanton, reckless, and outrageous.
29. Defendants' representations were with regard to material facts about the Property
and the Defendants knew that Plaintiffs, as a purchasers, were relying on those
misrepresentations when contracting and agreeing to purchase the Property.
30. Defendants misrepresentations were made for the purpose ofinducing Plaintiffs
to purchase the Property and were made with the knowledge that Plaintiffs would only have
contracted for the purchase of the Property if they believed that the Defendants had made certain
that the Property would be constructed properly and would be habitable.
31. Plaintiffs have obtained a quotation from an independent contractor, Sheriff Builders,
Inc., for all treatment and repairs necessary to correct the damage and deficiencies at the
Property. A true and correct copy of said quotation/proposal is attached hereto as Exhibit "D"
and by reference incorporated herein and made a part hereof.
32. Plaintiff has suffered an ascertainable loss as a result of Defendants' actions of FIVE
THOUSAND SIX HUNDRED ($5,600.00) DOLLARS for the cost to treat the Property and
make all the necessary repairs to the Property due to said damage and deficiencies,
WHEREFORE, Plaintiffs respectfully demands judgment against Defendants, jointly and
severally, in the amount of FIVE THOUSAND SIX HUNDRED ($5,600,00) DOLLARS, which

COUNT VI: VIOLATION OF THE UNFAIR TRADE
PRACTICES AND CONSUMER PROTECTION ACT
33. Paragraphs I through 32 are incorporated herein by reference as ifset forth in their
entirety.
34. Defendants used unfair deceptive acts or practices as defined in the Unfair Trade
Practices and Consumer Protection Law (hereinafter "UTPCPL"), Section 201-2(4)(vi) and (vii),
with reference to the intentional and fraudulent misrepresentations and knowing violations of the
warranty as set forth above.
35. Defendants are in violation of the UTPCPL, Section 201-3 by using unfair and
deceptive acts or practices as set forth above.
36. Plaintiffs purchased the Property relying on Defendants' representations that the
home would be constructed in a workmanlike manner and that there would be a warranty.
37. Plaintiffs have obtained a quotation from an independent contractor, Sheriff Builders,
Inc., for all treatment and repairs necessary to correct the damage and deficiencies at the
Property. The damage and deficiencies are referenced in the Inspect:on Report, a true and
correct copy of which is attached hereto as Exhibit "C" and by reference incorporated herein and
made a part hereof. A true and correct copy of said quotation/proposal is attached hereto as
Exhibit "D" and by reference incorporated herein and made a part hereof.
