KABUSK: -- although it's captioned as a 16 license suspension matter. 17 I have marked Commonwealth's Exhibit Number 18 1, a certified packet of documents, which consists of three 19 subexhibits. The first one is a copy of official notice of 20 suspension dated and mailed 4/23/97, effective 5/28/97 21 notifying the motorist stanley E. As a result, the vehicle registration will be suspended for three months effective 5/28/97. THE COURT: Three months suspension? MR. KABUSK: Yes, Your Honor. THE COURT: Okay. MR. KABUSK: Next subexhibit, Record of conviction Details received by the Department electronically from District Court number 09301, for citation Number A05513793, date of violation 2/26/97, date of conviction 4/11/97. I would direct your attention to the disposition which states GP, which is guilty plea. THE COURT: Okay. What was the underlying offense? Does it say? MR. KABUSK: 1786F. THE COURT: Which is? MR. KABUSK: operating vehicle without required financial responsibility. THE COURT: And that section is give it to me again. MR. KABUSK: THE COURT: MR. KABUSK: 1786F. 1786F. Okay. And that's the offense of operating a motor vehicle. 3 1 THE COURT: That's operating. 2 MR. KABUSK: Right. 3 THE COURT: For which he tendered a plea of 4 guilty before the District Justice? 5 MR. KABUSK: And we are here now on 1786D, 6 suspension. 7 The third subexhibit, vehicle inquiry detail 8 by title screen from Department of Transportation's records 9 for 1980 Oldsmobile coupe, with title number 36769244 10 license plate AYX2174 owned by Stanley E. Rickrode with 11 registration expiration date February 1997. 12 THE COURT: okay. 13 MR. KABUSK: I would move for the admission 14 of Commonwealth's Exhibit Number 1. 15 THE COURT: Any objection? 16 MS. WINDER: No objection. 17 THE COURT: Admitted 18 (Whereupon, 19 Commonwealth's Exhibit No. 1 20 was admitted into evidence.) 21 MR. KABUSK: And Your Honor, can you to take 22 notice that the Oldsmobile is the type of vehicle to be 23 registered? And based upon the evidence I would rest. 24 THE COURT: okay. Respondent. 25 MS. WINDER: Your Honor, we would call 4 1 Mr. Rickrode to testify. 2 THE COURT: okay. You may take the stand, 3 sir. 4 Whereupon, 5 STANLEY RICKRODE, 6 having been duly sworn, testified as follows: 7 DIRECT EXAMINATION 8 BY MS. WINDER: 9 Q Mr. Rickrode, for the record, would you state 10 your name and your present address. 11 A Stanley Rickrode. Eight Cabin Lane, 12 Shippensburg. 13 Q And Mr. Rickrode, were you the owner of this 14 particular -- I guess it's listed as a 1980 Oldsmobile in 15 February of 1997? 16 A Yes. 17 Q And was that car in operable condition at 18 that time, as far as you know? 19 A No, it was not. 20 Q And why not? 21 A Because we had taken the keys and took the 22 battery out of the car. 23 THE COURT: I am having trouble hearing. If 24 you could speak just a little louder. What had you done? 25 THE WITNESS: I took the keys from the car, 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 took the battery out, and parked it so that it couldn't be drove because there was no insurance on it. BY MS. WINDER: Q And when did you take the battery out of the vehicle? A When did I take it out? Q Yes. A What date are you saying? Q Yes. A Somewhere around Thanksgiving or a little after. Q And would that have been of 1996? A Yeah, I would say so. Q So the battery had been out of the car for several months before the date of this citation and this offense; is that right? A Right. Q Now, on that particular day, February 26th, 1997, did you operate that Oldsmobile? A No, I did not. Q Did you have the keys for that vehicle? A Yes, we did. A She had put them -- I think they were in the desk drawer in the house. Q And was the battery out of the car on that date? A Yes. Q As far as you know, had that car been driven at all since you had taken the battery out of it? A Not that I know of. Q Did you normally operate that vehicle? A No, I didn't because it was bought for my son, and he was the operator. I never drove it. Q When you took the battery out of it and parked it, because there was no insurance, did you tell your son that? A Yeah, he knew it. Q And what did you tell him about driving the vehicle? A I told him that he couldn't drive it. There was no insurance on it. I was laid off. And I could not pay the insurance in the winter. And he knew he wasn't supposed to be driving it. Q And as far as you knew, at the end of February, did he have a set of keys? A No, I never knew he had one. 7 A out for lunch, car then. Q son before you car? A 20 A On the 26th? 21 Q Yes. 22 A I am not sure if it was the 26th, but he -- I 23 didn't know that he even got caught until I got this notice, 24 and then he had told me that he had got caught driving this 25 car, and he said that, you know, he just explained it to me 8 1 that he drove it. 2 Q And when you say you got -- you found out 3 about this when you got notice, is that when you got the 4 citation? 5 A When I got the citation is when I found out, 6 really, that he had drove the car, because I didn't 7 understand why I was getting the citation. 8 Q And what did you do with that citation? 9 A Well, I went into Donald Daihl's to see what 10 it was about, and he explained it to me. He said that, you 11 know, that the car was in my name, and I was liable to have 12 insurance on it. I know it is. I parked it. 13 Well, he said, that I was fined for it, and I 14 was to pay the fine before he had turned it in to 15 Harrisburg. And that was about it on it, you know, that I 16 know. 17 Q Now, when he was talking about turning 18 something in to Harrisburg, what was he talking about? 19 A He said if I did not pay the fine, that they 20 would have to turn it in to Harrisburg, and then they would 21 probably pull my -- well, pull my license until the fine was 22 paid. 23 Q For the citation? 24 A For the citation. So I pled guilty for it, 25 and paid for it because I knew there was no insurance on the 9 1 car to begin with. 2 Q Were you aware that your paying this citation 3 would result in any kind of suspension? 4 A No. No, I didn't realize that there would be 5 any suspension over it. 6 Q Did you talk to an attorney about this 7 citation at all? 8 A No. No, I didn't. 9 Q Do you have that car now? 10 A No, we do not. We had got rid of it to a 11 junk dealer. It's totally junk. I mean, it's in the junk 12 yard. 13 MS. WINDER: I have no other questions. 14 THE COURT: Any questions? 15 CROSS-EXAMINATION 16 BY MR. KABUSK: 17 Q Mr. Rickrode, did you receive a citation? I 18 would imagine it came in the mail; is that correct? 19 A Yeah. 20 Q And was it for a violation of 1786F of the 21 Vehicle Code? 22 A I don't know about 1786F, but I got a 23 citation for no insurance, if that is what it is. 24 Q Okay. WINDER: Mr. Rickrode, would you state your name. Terrance Rickrode. Eight Cabin Lane, Q A Shippensburg. Q Mr. Rickrode, were you the operator of this Oldsmobile on the 26th of February of 1997? A Yes, I was. Q Did you know that there was no insurance on that vehicle before that date? A Yes. Q Had you been told by your father that he was taking the battery out, and that you were not to drive the car? A Yes. Q Did he give you any permission to use the 11 1 vehicle on that day you took it? 2 A No. 3 MS. WINDER: I have no other questions. 4 THE COURT: I didn't have any questions. S MR. KABUSK: No questions. 6 THE COURT: What did you get stopped for? 7 THE DEFENDANT: I don't know. The officer 8 knows me, and he pulled me over because he knows me. He 9 said I had an inspection violation. 10 THE COURT: Okay. You may step down. Any 11 further testimony? 12 MS. WINDER: No, Your Honor. 13 THE COURT: Anything else? 14 MR.
