. 2. EFFECT OF DIVORCE DECREE: The pllrlies agree that unless otherwise specifically provided
herein, this Agreement shall continue in full foree und effect after such time us a final decrec in divorce may

3. AGREEMENT TO BE INCORPORATED IN DIVORCE DECREE: The pllrlies agree thatthc
tenns of this Agreement shall be incorporated into any divorce decree which may be entered with respect
to them.
4. SEPARATION: It shall be luwful for eaeh party at all times hereafter to live sepnrnte and apart
from the other party as sueh place as he or she may from time to time ehoose or deem fit. The foregoing
provisions shall not be tuken as an admission on the part of either purty of the lawfulness or unlawfulness
of the causes leading to their living apart.
5. INTERFERENCE: Each party shall be free from interference, authority, and contact by the other,
as fully as ifhe or she were single and unmarried except as may be necessary to carry out the provisions of
this Agreement. Neither party shull molest the other or allempttll endeavor to molest the other, nor eompel
the other to cohabit with the other, or in any way harass or malign the other. nor in uny way interfere with
the peaceful existence, separate und apart from the other.
6. WIFE'S DEBTS: WIFE represents und warrants to HUSBAND that since their sepnrniton. she has
not and in the future she will not contract or incur any debt or liability for which HUSBAND or his estate
might be responsible und shall indemnify und save hnnnless HUSBAND from any and all claims or demands
made against him by reasons of debts or obligations incurred by her.
7. HUSBAND'S DEBTS: HUSBAND represents and warmnls to WIFE that since their separation
he has not and in the future he will not contract or incur any debt or liability for which WIFE or her estate
might be responsible and shall indemnify and save hnnnless WIFE from any and all claims or demands made
against her by reason of debts or obligations incurred by him.
S, MUTUAL RELEASE: Subject to the provisions of this Agreement, each party has released and
discharged, and by this Agreement docs for himself or herself and his or her heirs, legal representatives,
executors, administrators and assigns, release and discharge the other of and from all causes of aClion.

against the other, except any or all cause or causes of action for divoree and except any or all causes of
action from breach of any provisions of this Agreement.
9. REAL PROPERTY: The parties own no real estate.
10. DIVISION OF PERSONAL PROPERTY:
(a) The parties have heretofore divided their personal property to their mutual satisfaction.
Henceforth, each of the parties shall own, have and enjoy, independently of any claim of right of the othcr
party, all items of personal property of every kind, nature and description and wheresoever situated, which
are now owned or held by or which may hereafter belong to the HUSBAND or WIFE respectfully, with full
power to the HUSBANO or the WIFE to dispose of same as fully and effectually, in all respects and for all
purposes as ifhe or she were unmarried. All items of personal property shall be divided between the parties
as provided herein:
(b) Personal Effects: All items of personal effects such as, but not limited to: jewelry,
luggage, sports equipment, hobby collections and books, but not including furniture or any property,
personal or otherwise specifically disposed of pursuant to this agreemenl, shall become the absolute and sole
property of that party who has had the principal use thereof or to whom the property was given or for whom
it was purchased, and each party hereby surrenders any interest he or she may have in any sueh tangible
personal property of the other.
(c) Intangible Personal Property (other than Life Insurance): All stocks, bonds, cash, and
sums on deposit in checking and saving accounts (owned by either or both parties) have been or will be
divided to the mUlual satisfaction of the parties.
(d) Teamster's Pension: The HUSBAND recognizes that his Teamster's pension is a
property asset divisible as part of this property settlement agreement. Since the parties have been married
and lived as HUSBAND and WIFE for 91 months of the HUSBAND'S 253 months of service as II
Teamster, the HUSBAND agrees that eighteen (18%) of his disposable Teamster's pension shall be the sole
and exclusive property of the WIFE. The HUSBAND further agrees that he shall obtain and maintain in full
eITect and foree, irrevocably, a Survivor's Benefit Annuity in the maximum amount allowable under law and
regulations for the benefit of the WIFE. All amounts hereunder are to be paid by the pension Administrator
directly to each party.
(e) Furniture and other Tangible Property: All furniture and other tangible personal property
not disposed of pursuant to other paragraphs of this agreement shall be the property of the WIFE.
(I) The parties further agree that neither will incur any future debts for which the other may
be held liable, and if either party incurs a debt for which the other will be liable, that party incurring such
debt will hold the other hnnnless from any and all liability thereon.
II. AFTER ACOUIRED PERSONAL PROPERTY: Each of the parties shall hereafter own and
enjoy, independently of any elaims or right of the other. all items of personal property, tangible or intangible,
hereafter acquired by him or her, with full power in him or her to dispose of the same as fully and
eITectively, in all respect and for all purposes, as though he or she were unmarried.
12. COUNSEL FEES: Each party shall pay his or hcr counsel fees and cxpenses.
13. DIVORCE: The parties hereto agree to enter into a mutual eonsent divoree. HUSBAND agrees
to pursue the divoree and to be the Plaintiff therein, WIFE agrees to sign the necesSlll)' documents. including
an Amdavit of Consent and further instruments that may be reasonably required to give full force and effect
to the provisions of this Agreement.
14. WAIVER OF CLAIMS: Except as herein otherwise provided. each party may dispose of his or
her property in any way, and each party hereby waives and relinquishes any and all rights he or she shall now
have or hereafter acquire. under the present or future laws of any jurisdiction. to share in the property or the
estate of the other as a result of the marital relationship. including without limitation. dower. courtesy,
statuto!)' allowance, widow's allowance. right to take in intestacy, right to take against the Will of the other.
and right to act as administrator or executor of the other's estate. and each will. at the request of the other.
execute. acknowledge and deliver any and all instruments which may be nccessary or advisable to carry into
effect this mutual waiver and relinquishment of all such interests. rights and claims.
15. BREACH: If either party breaches any provision of this Agreement. the other party shall have
the right. at his or her election. to sue for damages for such breach or seek such other remedies or relief as
may be available to him or her. and the party breaching this contract shall be responsible for payment of legal
fees and costs incurred by the other in enforcing their rights under this Agreement.
16. VOID CLAUSES: If any term, condition, clause or provision of this Agreement shall be
determined or declared to be void or invalid in law or otherwise, then only that term, condition, clause or
provision shall be stricken from this Agreement and in all other respects this agreement shall be valid and
continue in full force. effect and operation.
17. DESCRIPTIVE HEADINGS: The descriptive headings used herein are for convenience only.
They shall have no effect whatsoever in determining the rights or obligations of the parties.
18. INDEPENDENT SEPARATE COVENANTS: It is specifically understood and agreed by and
between the parties hereto that each paragraph hereof shall be deemed to be a separate and independent
covenant and agreement.
19. ADDITIONAL INSTRUMENTS: Eaeh of the parties shall from time to time, at the request of
the other, execute, acknowledge and deliver to the other party any and all further instruments that may be
reasonable required to give full force and elTectto the provisions of this Agreement.
20. APPLICABLE LAW: This Agreement shall be construed under the laws ofthe Commonwealth
of Pennsylvania and more specifically under the Divoree Code of 1980.
21. AGREEMENT BINDING ON HEIRS: This Agreement shall be binding and shall inure to the
benefit of the parties hereto and their respective heirs, executors, administrators, successors and assigns.
22. ENTIRE AGREEMENT: This Agreement contains the entire understanding of the parties and
there are no representations, warranties, covenants or undertakings other than those expressly set forth
herein.
23. MODIFICATION AND WAIVER: A modification or waiver of any of the provisions of this
Agreement shall be effective only if made in writing and executed with the same fonnality as this
Agreement. The failure of either party to insist upon strict perfonnance of any of the provisions of this
Agreement shall not be eonstrued as a waiver of any subsequent default ofthe same or similar nature.
24. WAIVER OF RIGHTS: The parties hereto have been infonned of their rights or have been
advised to seek counsel to infonn them of their rights under and pursuant to the Divoree Code, Act of April
2, 1980, Number 1980-26, particularly the provisions for alimony, alimony pendente lite, equitable
distribution of marital property, counsel fees or expenses. Both parties agree that this Agreement shall
conclusivcly provide for the distribution of property under the said law and hereby waive, release and
relinquish any further rights they may respectively have against the other for alimony, alimony pendente lite.

Dear Judge Hoffer:
As you may recall, on January 5, 1998 you convened a hearing in this custody matter.
I represent the Mother in this ca~e. At the conclusion of the hearing, you advised the parties
that primary physical custody should be placed with the Mother and that you would rely upon
the parties to design a schedule for Father's visitation. You also instructed that should the
panies and their attorneys fail to draft such a schedule, you would upon either party's reque~1
dictate a specific schedule.
Despite repeated requests directed to the Plaintiff, through his attorney, we have yet to
receive any proposal for visitation. In fact, the Plaintiff has not made any attempts to see his
son since the day of the custody hearing. As nearly four (4) months have passed since your
hearing, my client believes it would be appropriate for the Court to issue a Custody Order
given the circurnstance~. I have taken the liberty to draft a proposed Order and have enclosed
that for your reference.
My client also advises that Mr. Yenger has refused to contribute toward the co~1s for
the child's counseling. As you may recall from the testimony elicited on January 5, the child
was counseling regularly with William Kennedy of Guidance Associates regarding the child's
anxiety related to his relationship with his Father. Guidance Associates has suspended these
counseling sessions as the account has gone in to default. Mrs. Yenger has paid one-half of
the balance due however, an additionul $300.00 is due to Guidance Associates. TIle Futher
had muintained medical insurance for the child und Mother previously, however due to his
disability, the insurance covemge lapsed in the Fall of last year and the Mother has secured
employment that will provide her medicul benefits for herself und her son once she completes
her probationary period. It is for these reusons, that we have incorporated within the CU~1ody
Order a provision that requires the Futher to reimburse Mother for these pust due counseling
fees, as well as any other counseling fees that become due in the future, so long us the
Mother utilizes any medical insurance benefits thut muy be avuilable to her.

BRIEr DESCRIPTION I Trustees uphold rund's denial of benefits for
hospital treatment for Participant'. Dependent
because the condition was the result of the
Dependent's suicide attempt and/or self-
inflicted injury.
I. FACTUAL BACKGROUND.
Richard L. Yenger has requested that the Central Pennsylvania
Teamsters Health & Welfare Fund make payment for treatment rendered
by Carlisle Hospital to his wife on August 27 to August 29, 1997.
An on-site review of Mrs. Yenger's chart was conducted by an agent
of the Fund's Medical Advisor (HealthAssurance, Inc.) on August 29,
1997. This review revealed that Mrs. Yenger's admission was in
response to a suicide attempt involving the ingestion of pills and
alcohol. I
On October 17, 1997, the Fund denied Mr. Yenger's claim on the
grounds that Plan 13's provisions specifically exclude payment for
hospital expenses arising from suicide attempts and/or self-
inflicted injuries. Mr. Yenger requested a review of this
decision, on a non-appearance basis, on November 22, 1997. In that
request, he stated that "I understand this may have been an
accident. II However, at no time has Mr. Yenger provided any
evidence in furtherance of this contention in particUlar, or his
claim in general.
On December 8, 1997, the Fund's Claim Review Committee
considered information of record for Mr. Yenger's claim review.
Present for the Fund were Joseph J. Samolewicz, Fund Administrator;
Patricia SChafer, Welfare Benefits Manager; Fund co-counsel Frank
C. Sabatino and James S. Beall, Esqs.; and Dr. Joseph Trautlein of
HealthAssurance.
Further review of information gathered by HealthAssurance
revealed that Mrs. Yenger was admitted to the Carlisle Hospital
Emergency Room on August 27, 1997, with a history of ingesting an
unknown amount of pills and alcohol one hour prior to her
admission. There was some question as to whether the pills may
have been Vicodin and Elavil, and the Poison Control Center also
believed that there was another unknown substance that may have
been ingested. Mrs. Yenger was then admitted to the Intensive Care
Unit. The following day she was unable to explain the reasons for
her actions and was reluctant to undergo a psychiatric evaluation.
She was discharged on August 29, 1997.

After this meeting, on December 15, 1997, the Fund wrote to
Mr. Yenger and requested that he and his wife execute an
authorization for release so that the Fund could obtain a copy of
his wife's emergency room report and Psychological evaluation in
order to further the Fund's review of his claim. Mr. Yenger failed
to respond to this request.
II. TRUSTEES' ANALYSIS.
In evaluating Mr. Yenger's claim, the Trustees are bound to
administer the Plan in accordance with Plan documents. ~
Employment Retirement Income security Act (ERISA) S 404(a)(1)(D),
29 U.S.C. S 1104 (a) (1) (D). Article XXI of Plan 13 specifically
states:

the following circumstances:

q. Whenever the injury or illness arise out of a
suicide or attempted suicide, except as specifically provided
under the Death Benefits or Accidental Death & Dismemberment
provisions of this Plan.
r. Whenever the injury or illness arises out of a self-
inflicted injury or an attempt at self-inflicted injury,
regardless of whether the Participant or Dependent intended
[the] consequences of his action, except as specifically
provided under the Death Benefits or Accidental Death &
Dismemberment provisions of this Plan.
In applying this Plan language to the facts of Mr. Yenger's
claim, the uncontradicted evidence of record indicates that Mrs.
Yenger's hospital stay of August 27-29, 1997, was the result of a
suicide attempt and/or self-inflicted injury. Despite having had
opportunities to do so, Mr. Yenger has failed to produce any
evidence suggesting anything to the contrary. In accordance with
Plan 13's explicit language, then, the Trustees uphold the decision
of the Fund to deny payment for benefits for this hospital stay.
If the Participant wishes to appeal this decision, he must
first exhaust the arbitration provisions of the Fund's appeal
procedures. These procedures are set forth in the Plan Document
itself, and include a requirement that a participant seeking
arbitration must request it within sixty (60) days of receiving a
claim review decision.

each party will call to testify and a summary of the
anticipated testimony of each witness. This memorandum shall
be filed at least ten days prior to the mentioned hearing
date.
2. Pending further Order of this Court, the following temporary
custody Order is entered:
A. The Father, Richard L. Yenger, and the Mother, Jacque I.
Yenger, shall enjoy shared legal custody of Daniel R.
Yenger, born November 9, 1990.
B. The Mother shall enjoy primary physical custody of the
minor child.
C. The Father shall enjoy periods of temporary physical
custody of the minor child on alternating weekends from
Friday at 2:00 p.m. until Sunday at 2:00 p.m. and on
every Wednesday from 4:00 p.m. until 8:00 p.m.
Additionally, Father shall have temporary custody at such
other times as agreed upon by the parties.
3. Neither party shall in any way degrade or speak poorly of the
other parent to the minor child.

Each parent has children from prior relationships. TIle father has a daughter, Brooke, who is
seventeen (17) years old. TIle mother has two sons from a prior marriage, John, bom November 9, 1976
and Joshua, bom August 20, 1986. Of these half-siblings, Daniel has developed a very strong bond with
his half-brother, Joshua, who is only four years his senior.
TIle mother anticipates that the consumption of alcohol will be an issue that is raised by both
sides in the upcoming hearing. It is the mother's position that there have been occasions where each
party has consumed alcohol in excess of what would be reasonable and prudent. The mother is currently
undergoing alcohol evaluation and counseling programs and it is unknown as to what remedial mea~ures
the father is undertaking.
II. LIST OF INTENDED WITNESSES
Jacque Yenger, Mother - will testify regarding her relationship with the child, father's relationship
with the child, half-brother's relationship with the child and particular concems that she has regarding
the father/son relationship.
Dr. Joseph Gogalsky, Mother's counselor - will testify conceming mother's positive ability to cope
with the pressures imposed upon her by the parties' separation and the difficulties that her son is having
with his relationship with the father.
William Kennedy, Daniel's counselor - will testify about his discussions with Daniel and his
observations and concerns regarding the relationship between father and son. Mr. Kennedy will also
testify conceming his observations of the mother-son relationship and the strength of the bond between
Daniel and his half-brother, Joshua.
Samantha Miller, friend and fonner neighbor of mother - will testify about the parties' frequent
separations in the past and her observations regarding mother/son and father/son relationships, focusing
on the consistent lack of contact between father and son during this period of separation and prior ones.

PRE-HEARING MEMORANDUM
I. Brief Statement of the Facts.
The parties in this action, Richard L. Yenger, Plaintiff and father, and
Jacque I. Yenger, Defendant and mother, had born to them on November 9,
1990 the child, Daniel R. Yenger. The parties separated at the beginning of
April 1997 and complaints In Divorce and Custody were filed on May 19, 1997.
Mter a Custody Conciliation was held on July 25,1997, a temporary order was
Issued and the matter was scheduled for hearing.
The temporary order granted primary physical custody to the Defendant
with Plaintiff having partial physical custody every other weekend and every
Wednesday afternoon. One month later, the visitation ceased, presumably at
the request of the child. Attempts at telephone communication by the Plaintiff
were unsuccessful and requests for family counseling were fruitless.
On August 27, 1997, Defendant was admitted to Carlisle Hospital
Intensive Care Unit (CHICU), for respiratory arrest caused by a drug overdose.
Plaintiff is unaware of any follow-up psychiatric counselling for Defendant or
the child in that the health Insurance provided by Plaintiffs employer was
terminated.
The child, Daniel, has 3 half-siblings. Plaintiff has custody of his 17 year
old daughter, Brooke, from his prior marriage. Defendant has two sons from
prior relationships-John Barnlnger, 21 years old from her first marriage and
Joshua Baminger, 9 years old.
II. List of Witnesses Available to Testify.
Merle Kramer, Constable, will testify to his observations while assisting
father in retrieving his daughter's personal property from marital home.
Richard Jenks, friend, will testify as to father's devotion to his son and
his experience with the parties over the last 8 years.
Fred Porr, work colleague for 16 years, will testify as to father's devotion
to his son and to father's good character.
Evelyn Yenger, Paternal Grandmother, will testify as to her observations
and interactions with the parties and her wishes for her grandchildren.
Edie Johnston, co-worker of Brooke Yenger, will testify as to the love and
bond between father and daughter, and father's ability to be a strong and
loving father.
Brooke Yenger, Daniel's half-sister, Plaintiffs daughter, will testify as to
her relationship with her father, and his ability and desire to care for his
children.
Richard Yenger, father, will testify as to his love and concern for his son
and the mother's unwillingness to cooperate with father in working toward the
best interests of the child.
Marilyn Ostra, RN, BSN, CEN will testify as to the nature of the drug
overdose as indicated by the statement of services rendered by CHICU.
III. Requested Outcome.
In light of the above circumstances, and with the realization of Richard
Yenger's devotion to his child, and his ability to provide a warm and nurturing
home environment for Daniel, and in recognition that the mother refuses to
foster a relationship between father and son which would be in the best
interest of the son, it is requested that this Honorable Court:
1. Grant full custody of the child Daniel to his father, Richard Yenger,
Plaintiff.
2. Require that evidence of proof from the attending psychiatrist or
psychologist which would substantiate that Jacque Yenger, Defendant,
continues to receive medical attention and counselling for her mental health
issues and substance abuse.

or all oC your claim as determined by the CENTRAl. PENNSYLVANIA TEANSTERS
IIEALTB AND W~:LI'ARf: FUND.
If you are not in accord with the way your claim has been processed,
you or your duly authorized representative may request in writing to the
Board of Trustees the opportunity 1.0 appear before the Claim Review Board
of our Fund, together or with a represenLative of your choice. You are not
required to appear before the Cialm Review Board. Your request can be
handled as a non-appearance. You may request a claim review by contacting
Nrs. Barbara Ganter at the f'und Office who will send you the necessary
forms for completion in order to schedule your review. Alternately or
additionally, you, the claimant, may request, in writing, that the Claim
Review Board review any documents pertaining to your case. You or your
representative may also submit, In writ. Lng, issues and comments for study
by the Claim Review Board.
After reviewing all submitLed documentation, the Claim Review Board
reports its findings LO the Board of TrusLees for their final decision.
The Trustees' declslon shall be made prompt.1y, and not later than sixty
(60) days after the date of the claim review hearing, with the Claim
Review Report being issued at. the next. regularly scheduled Board of Trustee
meeting, unless special circumst.ances, such as, bUL not limited to,
additional information or materials arc submit.ted for st.udy and processing,
in which event a decisLon shall b" rendered as soon as possible, but not
later than 120 days aCLer the Lnitial claim review hearing, again with the
Claim Review Report being issued in conjunction with the next regularly
scheduled Board of Trustees meetlng. The Claim Review Board shall notify
the claimant, in wri ting, if they need additional time for a decision on
review. The decision of the Board of Trustees on claim reviews is final
and shall be in writing, and shall include the specific reasons for the
decisLon.
