The property is subject to a Mortgage wilh National City Mortgage Company which is in
foreclosure. The amount sought is in excess ofS46,OOO.00.

The Petitioner and Respondent signed a Listing Agreement with Remwc Realty
Associates, Inc. for $64,900.00 pursuant to Court Order. This sale price will enable the parties to
pay the settlement costs, the sewer lien, and the first mortgage. The second mortgage will settle
for less than is owed in order to sellle this maller.

On April 24, 2002, the Petitioner was notified by Remax Realty that a Agreement of Sale was
signed for the sale of the marital property for the price of $60,000.00.

The Respondent has refused to sign the Agreement of Sale. He wants the property
foreclosed so that the Petitioner is evicted from the marital residence. A copy of the Agreement
of Sale attached hereto and marked as Exhibit" A".
8.
The Petitioner seeks a Rule to Show Cause why the Respondent, David R. Eckert, should
not be required to sign the Agreement of Sale for the sale of the martial property and the deed for
the sale of the property together.
9.
The Petitioner also seeks legal fees incurred by the Petitioner to pursue this action.

that would justify a deviation from the support guidelines.
CONCLUSIONS OF LAW
1. Defendant is liable for spousal support and
the support of his three children. The order is effective
May 4, 2000.
2. Based upon the guidelines, because of the
parties' limited income, an award for spousal support is
not appropriate.
3. The Defendant's total monthly child support
obligation is $675.06. The support guidelines calculations
are attached hereto as Exhibit A.
ORDER OF COURT
AND NOW, this 12th day of October, 2000, the
Defendant is ordered to pay the sum of $675.06 for the
support of his minor children, David Benton Eckert, Andrew
Lee Eckert, and Joshua Ray Eckert. This order is effective
May 4, 2000. In all other respects, our order of July 13,
2000, shall remain in full force and effect. Plaintiff
shall maintain medical insurance on the parties' children.
The parties shall share unreimbursed medical expenses on an

vacate the premises after being served a PFA complaint which was filed on 4/24/20, and
served on 4/26/2000.
3) The hearing for the original PFA order filed on 4/24/00 before Judge George E
Hoffer was held on 5/4/00, Yvonne and I both accepted a stipulation and agreement
without admitting or denying any allegations in the petition therefore eliminating the need
to hold a formal hearing before the Judge.
4) On 10/24/00 a complaint was filed for an extension of the PFA, which the hearing
was held on 11/8/00 before Judge George E, Hoffer. At this hearing I did not agree to
accept the extension and we therefore got to present our cases to the Judge. After
hearing the case he ruled that it be granted for an additional six months, to give Yvonne
ample time to pursue the divorce actions. Judge Hoffer then stated that this case is
closed and for her or her attorney not to file an additional complaint unless they had
something new. The current order will expire on 5/16/01.
5) It was also testified to and by Yvonne Eckert at the hearing on 11/8/00 that in the
early part of two thousand, she decided she no longer wanted to be married: Again.
6) It is obvious that the complaint of an irretrievable breakdown of the marriege is not
accurate as I moved back into the marital home in May/June of 1997, where we lived, as
husband and wife until 4/26/00.
7) Therefore at this time I will not sign any affidavits regarding this divorce action.
Paragraph 3
In light of the afformentioned item, I respectfully request dismissal of alimony, alimony
pendente lite, counel fees and expenses. The alimony claim has been deemed
innappropriate by Judge Edward E. Guido in his court order dated 10/12/00. (No. 485
Support 1984 DR11,690.) Equitable distribution of property and equitable burden of
loans/credit card balances acquired up to 4/26/00, may not be appropriate in light of the
facts listed.
