Since the child's birth, the child has resided with both parents at 149 Shippensburg Mobile Estates, Shippensburg, Cumberland County, Pennsylvania. from her date of birth until September 03, 1996. She resided with her mother at 1482 Mainsville Road, Shippensburg, Franklin County, Pennsylvania, from September 03, 1996, until January 01. 1997, when the parents reconciled and the mother moved back to 149 Shippensburg Mobile Estates, Shippensburg, Cumberland County, Pennsylvania, where the child has resided with both parents until May 18, 1997. The Plaintiff and Defendant are the parents of the minor child, JODI ELIZABETH SPENCER. They are currently separated. No divorce has yet been filed. 4. The Plaintiff mother, CINDY S. SPENCER, currently resides at the home of her parents, Mary and Chester Suders at 1482 Mainsville Road, Shippensburg, Franklin County, Pennsylvania. Plaintiff, CINDY S. SPENCER and Mr and Mrs Suders are the only residents at I ' that address. II II I S. The Defendant father, ERIC G. The Mother, Cindy S. Spencer, and the Father, Eric G. Spencer, shall have shared legal custody of Jodi Elizabeth Spencer, born May 11, 1993. 2. The parties shall share physical custody of the Child in accordance with the following rotating bi-weekly cycle, beginning on September 15, 1997: CUstody Period CUstodial Parent Monday 6:30 a.m. - Wednesday 3:30 p.m. Mother Wednesday 3:30 p.m. - Thursday 6:30 a.m. Father Thursday 6:30 a.m. - Thursday when Father off work Mother Thursday after work - Friday 6:30 a.m. Father Friday 6:30 a.m. - Friday when Father off work Mother Friday after work - Saturday 8:00 a.m. Father Saturday 8:00 a.m. - Tuesday when Father off work Mother Tuesday after work - Wednesday 6:30 a.m. Father Wednesday 6:30 a.m. - Thursday when Father off work Mother Thursday after work - Friday 6:30 a.m. Father Friday 6:30 a.m. - Friday 6:00 p.m. Mother Friday 6:00 p.m. - Monday 6:30 a.m. Father 3. All custody exchanges under the foregoing paragraph shall take place at the Mother's residence, with the exception of the Saturday morning exchange of custody at 8:00 a.m., when the' ;Mo.ther shall be responsible to provide transportation for the Child.' - "''; ,. ; __'_oJ:..': I " _ .j .. ...... I ~ 4. The parties shall share or alternate having custody of the Child on holidays as follows: A. Christmas: The Father shall have custody of the Child every year on Christmas Eve and the ~Iother shall have custody of the Child every year over night on Christmas Eve through Christmas Day. B. Thanksgiving Day: The Mother shall have custody of the Child on Thanksgiving Day in odd numbered years and the Father shall have custody of the Child on Thanksgiving Day in even numbered years. C. Newberg's Memorial Day (Sunday before Memorial Dar)/Memorial Day: The Father shall have custody of the Chlld every year on Newberg's Memorial Day and the Mother shall have custody of the Child every year on Memorial Day. D. Alternating HOlidays: The parties shall alternate having custody of the Child on the following holidays, with the schedule to begin as agreed upon by the parties: New Years Day, Child's birthday, Easter Sunday, July 4th, and Labor Day. E. Mother's Day/Father's Day: The Mother shall have custody of the Child every year on Mother's Day and the Father shall have custody of the Child every year on Fath<;!r' s Day. F. ~lother's Company picnic: The ~lother shall have custody of the Child every year on the day of the Mother's company picnic in August. In the event the Mother's company picnic falls on the Father's regular period of custody under this Order, the parties shall cooperate in scheduling a make-up period of custody for the Father. 5. Each party shall have a one week period of uninterrupted custody with the Child during each year upon providing thirty (30) days advance notice to the other party. The extended period of custody under this paragraph shall be scheduled so as not to interfere with the holiday custody schedule. 6. This Order is entered pursuant to an agreement of the parties at a Custody Conciliation Conference. The parties may modify the provisions of this Order by mutual agreement. A Conciliation Conference was held on July 3, 1997 with the following individuals in attendance: The ~Iother, Cindy S. Spencer, with her counsel, Sally J. Winder, Esquire, and the Father, Eric G. Spencer, with his counsel, Johnna J. Deily, Esquire. 3. Although the parties were able to agree on a Custody arrangement at the Conciliation Conference, the Conciliator discovered upon attempting to incorporate the arrangements into a bi-weekly schedule, that there was a conflict with the Mother's work schedule. The Conciliator subsequently held this matter open pending confirmation by counsel for the parties on the agreed upon custody schedule. /0 1,1/97 Date" ' 4.
