MORTGAGE FORECLOSURE
COM P L A I N T
1. Plaintiff, Federal Home Loan Mortgage Corporation, is a
corporation, with a Servicing Agent, Homeside Lending, Inc., with
an office at Post Office Box 44090, Jacksonville, Florida 32231.
2. Defendant, Cheryl A. Winters, Executor of the Estate of
Sarah E. Pennella, is an adult individual whose last known
residence is 301 North Hanover Street, Apartment 3, Carlisle,
Pennsylvania 17013, and Norman W. Pennella, Executor of the Estate
of Sarah E. Pennella, is an adult individual whose last known
residence is Box 59, Hillsgrove, Pennsylvania 18619-0059.
3. On or about June 18, 1987, Sarah E. Pennella executed and
delivered a Mortgage Note in the sum of $40,000.00 payable to HILL
FINANCIAL SAVINGS ASSOCIATION, (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of
the aforesaid Mortgage Note, in order to secure payment of the
same, Sarah E. Pennella made, executed and delivered to the
original Mortgagee, a certain real estate Mortgage which is
recorded in the within Commonwealth and County in the Office of the
Recorder of Deeds in Mortgage Book 870, Page 34, conveying to the
original Mortgagee the real estate described therein.
Said
*Together with interest at the per diem rate noted in (b) above
after June 1, 1997, and other charges and costs to date of
Sheriff's Sale. The attorney's fees set forth above are in
conformity with the Mortgage documents and Pennsylvania law, and
will be collected in the event of a third party purchaser at
Sheriff's Sale. If the Mortgage is reinstated prior to the sale,
reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No Judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance has been given to the Mortgagors in accordance with Section
403 of Pennsylvania Act No.6 of 1974, but the Mortgagor has failed
to reinstate the Mortgage in accordance with the provisions
thereof. A copy of the Notice is attached hereto and made a part
hereof as Exhibit "C".
10. Defendant is not a member of the Armed Forces of the
United States of America, nor engaged in any way which would bring
him within the Soldiers and Sailors Relief Act of 1940, as amended.
11. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to qualify for
assistance.

C 0 M P L A I N T
1. Plaintiff, Federal Home Loan Mortgage Corporation, is a
corporation, with a Servicing Agent, Homeside Lending, Inc., with
an office at Post Office Box 44090, Jacksonville, Florida 32231.
2. Defendant, Cheryl A. Winters, Executor of the Estate of
Sarah E. Pennella, is an adult individual whose last known
residence is 301 North Hanover Street, Apartment 3, Carlisle,
Pennsylvania 17013, and Norman W. Pennella, Executor of the Estate
of Sarah E. Pennella, is an adult individual whose last known
residence is Box 59, Hillsgrove, Pennsylvania 18619-0059.
3. On or about June 18, 1987, Sarah E. Pennella executed and
delivered a Mortgage Note in the sum of $40,000.00 payable to HILL
FINANCIAL SAVINGS ASSOCIATION, (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of
the aforesaid Mortgage Note, in order to secure payment of the
same, Sarah E. Pennella made, executed and delivered to the
original Mortgagee, a certain real estate Mortgage which is
recorded in the within Commonwealth and County in the Office of the
Recorder of Deeds in Mortgage Book 870, Page 34, conveying to the
original Mortgagee the real estate described therein.
Said
Mortgage was subsequently assigned to Meridian Mortgage Corp., in
the within County and Commonwealth in the Recorder of Deeds in
Miscellaneous Book 471, Page 868, on April 21, 1994. Said Mortgage
was further assigned to BancBoston Mortgage Corp., in the within
County and Commonwealth in Book 482, Page 86e, on September 26,
1994.
Said Mortgage was further assigned to Federal Home Loan
Mortgage Corporation, and has been sent for recording.
Said
Mortgage and Assignments are incorporated herein by reference.
5. The land subject to the Mortgage is: 36 Otto Avenue,
Carlisle , Pennsylvania 17013, and is more particularly described in
Exhibit "B" attached hereto.
6. Sarah E. Pennella died September 6, 1996. On November 8,
1996, Cheryl A. Winters and Norman W Pennella were appointed
Executors of the Estate of Sarah E. Pennella. The Estate of Sarah
E. Pennella is the real owner of the land subject to the Mortgage.
7. The Mortgage is in default due to the fact that Mortgagor
has failed to pay the installment due on December 1, 1996, and all
subsequent installments thereon, and the following amounts are due
on the Mortgage:
(a) Unpaid principal balance
$21,548.39
(b) Interest at $5.31 per day
from 11/1/96 to 6/1/97
(based on contract rate of 9.0%)
(c) Accumulated Late Charges
Late charges at $20.29 per
month for 5 months

(e) 5% Attorney's commission
*Together with interest at the per diem rate noted in (b) above
after June 1, 1997, and other charges and costs to date of
Sheriff's Sale. The attorney's fees set forth above are in
conformity with the Mortgage documents and Pennsylvania law, and
will be collected in the event of a third party purchaser at
Sheriff's Sale. If the Mortgage is reinstated prior to th~ sale,
reasonable attorney's fees will be charged that are actually
incurred by ~laintiff.
8. No Judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance has been given to the Mortgagors in accordance with Section
403 of Pennsylvania Act No.6 of 1974, but the Mortgagor has failed
to reinstate the Mortgage in accordance with the provisions
thereof. A copy o~ the Notice is attached hereto and made a part
hereof as Exhibit "C".
10. Defendant is not a member of the Armed Forces of the
United States of America, nor engaged in any way which would bring
him within the Soldiers and Sailors Relief Act of 1940, as amended.
11. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to' qualify for
assistance.

MORTGAGE FORECLOSURE
COMPLAINT
1. Plaintiff, Federal Home Loan Mortgage Corporation, is a
corporation, with a Servicing Agent, Homeside Lending, Inc., with
an office at Post Office Box 44090, Jacksonville, Florida 32231.
2. Defendant, Cheryl A. Winters, Executor of the Estate of
Sarah E. Pennella, is an adult individual whose last known
residence is 301 North Hanover Street, Apartment 3, Carlisle,
Pennsylvania 17013, and Norman W. Pennella, Executor of the Estate
of Sarah E. Pennella, is an adult individual whose last known
residence is Box 59, Hillsgrove, Pennsylvania 18619-0059.
3. On or about June 18, 1987, Sarah E. Pennella executed and
delivered a Mortgage Note in the sum of $40,000.00 payable to HILL
FINANCIAL SAVINGS ASSOCIATION, (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of
the aforesaid Mortgage Note, in order to secure payment of the
same, Sarah E. Pennella made, executed and delivered to the
original Mortgagee, a certain real estate Mortgage which is
recorded in the within Commonwealth and County in the Office of the
Recorder of Deeds in Mortgage Book 870, Page 34, conveying to the
original Mortgagee the real estate described therein.
Said
Mortgage was subsequently assigned to Meridian Mortgage Corp., in
the within County and Commonwealth in the Recorder of Deeds in
Miscellaneous Book 471, Page 868, on April 21, 1994. Said Mortgage
was further assigned to BancBoston Mortgage Corp., in the within
County and Commonwealth in Book 482, Page 868, on September 26,
1994.
Said Mortgage was further assigned to Federal Home Loan
Mortgage Corporation, and has been sent for recording. Said
Mortgage and Assignments are incorporated herein by reference.
5. The land subject to the Mortgage is: 36 Otto Avenue,
Carlisle, Pennsylvania 17013, and is more particularly described in
Exhibit "B" attached hereto.
6. Sarah E. Pennella died September 6, 1996. On November 8,
1996, Cheryl A. Winters and Norman W Pennella were appointed
Executors of the Estate of Sarah E. Pennella. The Estate of Sarah
E. Pennella is the real owner of the land subject to the Mortgage.
7. The Mortgage is in default due to the fact that Mortgagor
has failed to pay the installment due on December 1, 1996, and all
subsequent installments thereon, and the following amounts are due
on the Mortgage:
(a) Unpaid principal balance
(b) Interest at $5.31 per day
from 11/1/96 to 6/1/97
(based on contract rate of 9.0%)
(c) Accumulated Late Charges
Late charges at $20.29 per
month for 5 months

*Together with interest at the per diem rate noted in (b) above
after June 1, 1997, and other charges and costs to date of
Sheriff's Sale. The attorney's fees set forth above are in
conformity with the Mortgage documents and Pennsylvania law, and
will be collected in the event of a third party purchaser at
Sheriff's Sale. If the Mortgage is reinstated prior to the sale,
reasonable attorney's fees will be charged that are actually
incurred by plaintiff.
B. No Judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance has been given to the Mortgagors in accordance with Section
403 of Pennsylvania Act No.6 of 1974, but the Mortgagor has failed
to reinstate the Mortgage in accordance with the provisions
thereof. A copy o~ the Notice is attached hereto and made a part
hereof as Exhibit "C".
10. Defendant is not a member of the Armed Forces of the
united States of America, nor engaged in any way which would bring
him within the Soldiers and Sailors Relief Act of 1940, as amended.
11. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 19B3 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to qualify for
assistance.

MORTGAGE FORECLOSURE
COMPLAINT
1. Plaintiff, Federal Home Loan Mortgage Corporation, is a
corporation, with a Servicing Agent, Homeside Lending, Inc., with
an office at Post Office Box 44090, Jacksonville, Florida 32231.
2. Defendant, Cheryl A. Winters, Executor of the Estate of
Sarah E. Pennella, is an adult individual whose last known
residence is 301 North Hanover Street, Apartment 3, Carlisle,
Pennsylvania 17013, and Norman W. Pennella, Executor of the Estate
of Sarah E. Pennella, is an adult individual whose last known
residence is Box 59, Hillsgrove, Pennsylvania 18619-0059.
3. On or about June 18, 1987, Sarah E. Pennella executed and
delivered a Mortgage Note in the sum of $40,000.00 payable to HILL
FINANCIAL SAVINGS ASSOCIATION, (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of
the aforesaid Mortgage Note, in order to secure payment of the
same, Sarah E. Pennella made, executed and delivered to the
original Mortgagee, a certain real estate Mortgage which is
recorded in the within Commonwealth and County in the Office of the
Recorder of Deeds in Mortgage Book 870, Page 34, conveying to the
original Mortgagee the real estate described therein.
Said
Mortgage was subsequently assigned to Meridian Mortgage Corp., in
the within County and Commonwealth in the Recorder of Deeds in
Miscellaneous Book 471, Page 868, on April 21, 1994. Said Mortgage
was further assigned to BancBoston Mortgage Corp., in the within
County and Commonwealth in Book 482, Page 868, on September 26,
1994.
Said Mortgage was further assigned to Federal Home Loan
Mortgage Corporation, and has been sent for recording.
Said
Mortgage and Assignments are incorporated herein by reference.
5. The land subj ect to the Mortgage is: 36 Otto Avenue,
Carlisle, Pennsylvania 17013, and is more particularly described in
Exhibit "B" attached hereto.
6. Sarah E. Pennella died September 6, 1996. On November 8,
1996, Cheryl A. Winters and Norman W Pennella were appointed
Executors of the Estate of Sarah E. Pennella, The Estate of Sarah
E. Pennella is the real owner of the land subject to the Mortgage.
7. The Mortgage is in default due to the fact that Mortgagor
has failed to pay the installment due on December 1, 1996, and all
subsequent installments thereon, and the following amounts are due
on the Mortgage:
(a) Unpaid principal balance
$21,548.39
(b) Interest at $5.31 per day
from 11/1/96 to 6/1/97
(based on contract rate of 9.0%)

*Together with interest at the per diem rate noted in (b) above
after June 1, 1997, and other charges and costs to date of
Sheriff's Sale. The attorney's fees set forth above are in
conformity with the Mortgage documents and Pennsylvania law, and
will be collected in the event of a third party purchaser at
Sheriff's Sale. If the Mortgage is reinstated prior to the sale,
reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No Judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance has been given to the Mortgagors in accordance with Section
403 of Pennsylvania Act No. 6 of 1974, but the Mortgagor has failed
to reinstate the Mortgage in accordance with the provisions
thereof. A copy o~ the Notice is attached hereto and made a part
hereof as Exhibit "C".
10. Defendant is not a member of the Armed Forces of the
United States of America, nor engaged in any way which would bring
him within the Soldiers and Sailors Relief Act of 1940, as amended.
11. plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to' qualify for
assistance.
