BETWEEN Mark D. Jones and Patricia Lynn Jones of 34 Pine Hill Avenue, Mechanicshurg,

AND Lynford K, Donlvon of 116 Wesl Hillcrest Drive, Carlisle. Pennsylvania 17013, pnny of Ihe second
pnrl, (hereinarter called Conlrnctor).
WHEREAS the said panics have hy 0 duly execuled Agreement under seal, henring even dale herewilh.
enlered into a wrillen conlraet for Ihe excnvnlion. the conslruelion and com pie lion of a single family residence 10
be erecled on the lot of ground shuate in Silver Spring Township. Cumberland Counly, Pennsylvania, known as
34 Pine Hill Aveaue, Mechanicshurg.
NOW THIS AGREEMENT WITNESSETH: That the Contrnctor for aad in considerntion of the
contrnet aforesaid and Ihe considerntion mentioned thereunder, as well as Ihe fun her considernlion of One ($1,00)
Dollar 10 him in hand paid by the Owner at or before Ihe scaling and delivery of Ihese presents, the receipt
whereof is hereby acknowledged, docs herehy covenant, promise, and agree Ihat no mechanics' lien or claim or
other lien or claim of any kind whalsoever shall be filed or maintained againsl the said building or huildings or
the cunilage or cunilages appunenantthereto. by Conlrnctor or by any sub.conlrnctor, materialmen, or laborers
for work done, or materials furnished under said conlrnCI or by any olher pany aeling Ihrough or under Ihem or
any of them for and about said building or buildings or any pan Ihereof, or on credil thereof, and that all suh.
eonlraelors, materialmen and lahorers on said work shall look to and hold Contrnclor personally Iiahle for all sub-
contracts, materials furnished and work and labor donc, so Ihatlhere shall nol be any legal or lawful claim of any
kind whatever against Owner for any work done or lahar or malerials furnished under said conlraCI for and ahoul
Ihe ereclion, conslnlelion, and complelion of said huildings as aforesaid, or under any contrnct fnr extrn work or
for work supplemenlaltherelo or olherwise,
AND this agreement waiving the righl of lien shall be an independent covenanl and shall opernte and he
effective as well wilh respeclto work done and malerials furnished under any supple menial conlract for exlra work
in the erection, construclion. and complelion of Ihe said huilding or huildings as any work and lahar done and
malerials furnished under the contracl aforesnid,
AND, in order 10 give Ihe Owner full power and aUlhorhy to prolecl himself and the 101 or lols of ground
against any and all claims filed by the Conlraclor or anyone acting under or Ihrough him or iI in violation of the
foregoing covenanl, Ihe said Conlrnclor for himself, themselves. ilself, hereby irrevocably aulhorizes and
empowers any Allomey of any Coun of Common Pleas of the Commonweahh of Pennsylvania, to appear for
him, Ihem, iI or any of Ihem, in any of the said Couns of Common Pleas as Allomey for him, Ihem, or il and in
him. their, hs. name, mark satisfied of record althe cost and expense of Ihe Conlrnctor or of any Sub.Conlraetor
or Materialman, or Malerialmen. any and all claims or claim. lien or lien, filed by or for Ihe Contrnetor. or any
Sub.ConlraclOr or Malerialman, or in his or Ihcir name against said building or buildings, lot or 10ls of ground or
any pnrlthereof and for such act, or acts this shall be good and sufficienl warranl and authorily. and a reference 10
Ihe Coun, Tenn and Number in which and where this Agreemenl shall have been filed shall be a sufficient
exhibit of the Authorhy herein contained to warrant such action. and the ContraclOr for himself, Ihemselves.
