Severnl other electrical contractors had glven bids on the work at 412 S. Iligh, and one had been retained to perform the work. This contractor had started the work and never recurned to finish, und Allison then proceeded with the job. 9. Allison agreed Co perform the work under the afore- mentioned contractor's specifications and scope of work, for the same monies us agreed by Gates and said electrical contractor, as he was low bidder for the work. 10. All work was performen under verbal agreement, as per Gates' requests. 11. In addition to the electrical work to be performed, Allison was asked as an employee of LR Four to help in the recon- struction and remodeling of the house at 412 S. High. Allison was to receive compensation at the rate of $12.00 per hour, payable weekly by LR Four. 12. As an employee, Allison had the right to use accounts established at local supply houses by LR Four for the purposes of obtaining materials to work with. 13. It was also agreed that any materials provided by Allison on the job for construction purposes would be paid for by Gates and/or LR Four. 14. Allison, In the course of employment, had the responsi- bility of making work-related decisions on the job for himself and other employees of LR Four and their subcontractors. 15. On or about December 31, 1996, Allison was approached be Gates and asked co perform plumbing work at 412 S. High Street. The work to be performed was already in progress and being per- formed by another subcontractor, who would 'lot retuta to finish. 16. Alllson agreed to perform the plumbing work, including all domestic water lines and sanitary drain lines, under the same oral agreement with Gates us the electrical contract. 17. It was clearly stated by Allison on several occusions that separate times would be kept for all mechanical services aad all remodeling, carpeatry, work, as n separation of payment was to be made. IS. All agreements were oral and between Linden (IV) Gates and Allison. 19. On or about Decembcr 18, 1996, Allison presented Gates with a material list for wiring materialo at 412 S. High. Sub- sequently, a check was issued to cover the amount of 1200.00. A copy of this bill is attached to this complaInt. 20. On or about January 16, 1997. bills were issued from Allison for matcrials and equipment uscd at 412 S. High. A , bill was also issued for electrical work performed to date. These bills are attached to this complaint. On or about February 14, 1997, Allison was gIven a check by Gates to pay the bills. less uny monies owed to Gatcs for material and equipment purchased by Allison for personal use. 21. On or about February 26, 1997, a bill was issued by Allison to Gates for materials and equipmeat used at 412 S. High by Allison and other employees of LR Four for $365.48. This bill waa never paid in full. An amount was paid of $197.73, with a balance owing of $167.75. (See attached bills.) 22. On March 12, 1997, bills were issucd by Allison to Gates for plumbing work, electrical work, and materials used . at 412 S. High, in the amount of $3600.75 (Sce attachments). Subsequently, a check was issued dated March 21, 1997, payine $680.55 of this amount, lcaving Q balance owing of at lcast $2920.20. 23. All bills issued in Fcbruary and Mal"ch n!\1ected thc same costs and work 8S bills previously issued and paid, using the same bidding and cost procedures. 24. Ou or about March 14, 1997, a discussion was held at 412 S. High between Allison and Linden (IV) Gates, at which time it was said by Gates that he wns stopping work at the project due to lack of funding and lack of permits. 25. On or about March 18, 1997, Gates contacted Allison and asked him to perform more work at 412 S. High, clai~ing permits had been issued, or wcre pending. 26. On March 19, 1997, Allison met Gates at 412 S. High to discuss the work to be performed, including electrical inspect ions and the balance of the plumbing and electrical work. At this time, Gates mentioned all permits had been obtained aad would provide numbers of such to Allison for inspections. 27. On March 20, 1997, Allison performed electrical work at 412 S. High and a bill was presented in ~he amount of $135.00. On or about April 23. 1997, Allison rcceived payment for this amount from Gates/LR Four. 28. On March 21, 1997. a discussion was held bctween Patricia Gates and Allison at 1440 S. York Street concerning job matters and payments of bills. I'm sorry I minsed your attorney, Patty, as we probably could have resolved any differences we might have had, immediately. One issue we discussed was who Is in charge of your busines8 affairs, and whose directions should be followed out In the field. I was informed that Patty owns thc propcrty I hsve been working on, Butch is the boss, and Patty does the payroll. There has becn some confusion on my part as to how this worked. We also dIscussed Scott's work, and both agreed that the quality of hIS work has improved since I have bccn working With him. (This may be expiained ~imply by that we nre both prof~o8ionals and work well together, n9 1 assumed you were alw8Y~ happy with Scott's performance.) There was also discussion on the plumbing work 1 performed. 1 was informed that I was compenaoted for this under your payroll. and you paid for all mnterlalo. When r nsked vou to produce bills or receipts for nuc~ materials. it wssn't done. We discussed that all materials were charged ut iager'B, and I disputed this. During the discussion of hours, payments. etc., the Issue of my March 15, 1997 time card c~me up. r Questioned why there were hourn ndded by iomeonB on the b~ck of thu card, refJ~ctinfl 90me kind of payment for plumbing work. I was Informed that Patty didn't Imow what thiG wan for, I]lId duly noted such on the card, as plumbing was aub-contract. Page 2 We discussed the matter of the health insurance I was to be provided, as an incentive to work. After all the discussions, I was informed that the price of insurance had gone up the first of the year, which was a factor, and that 1 just hadn't been put on the insurance as 1 was told. I reminded Patty that I had offered to pay for the insurance, myself, in full, and she said that she had forgotten about that, since she was just a "dumb Pollock", with which 1 totally disagree. Discussed also was the matter of a permit at 412 S. Ui~h Street. I had informed Patty that Butch and I had a discussion on the job on March 19, in reference to having a rough wirin~ inspection performed. I told him I needed the permit number, he told me Patty had that number snd he would call me with it later that evening or Thursday morning. I received no phone calls, and was on site Thursday and Butch never arrived. However, 1 was informed by Patty yesterday that there was ao such permit, and there are problems obtaining one, .and much addi tional work may need to be done on site because of one. there was a small time spent on discussing the problema I've had working with and for other people over the years. At the conclusion of this, it was determined that all the instances mentioned were related in one way or another with the Gates family. As to the mattcr of the Schnell's, Patty should know, as you did, Dutch, that 1 made a deciLlion to work for you and tell the Schnells to obtain someone else to finish their work. At this point in time, maybe I should regret that choice having been made. Another discussion took place on your suing me ior libel and/or slander, and I informed Patty thst if I lie about anyone, or put falsc stories in writing, you should sue me and hold me liable. However, I did state that trying to collect a bili owed to me is not either one. If someone tells me constantly to trust them, then cheats me, they are wrong, and the truth will come out. Discussed was the lenRth of time it will take to collect sny monies. snd the monies 5pcnt to do snch. Jurot liS the Nerris situation, in the end, ail costs will be born by tne ones who are wrong. The difference between you and the Merris' CAse is the aRe and time factor. rlnally, there was mention HS to my job status. I assume 1 am still employed, and since 1 am, and there Appears to be no work, I will be applyinfl for unemployment. PRELIMINARY OBJECTIONS TO COMPLAINT AND NOW, come Defendants, Linden (IV) and patricia Gates, by and through their attorneys, Gates & Associates, P.C., and make the fOllowing preliminary objections to the Complaint in the above- captioned matter: I. FAILURE TO CONFORM TO PA.R.C.P. 2177 1. Reference is made throughout the complaint to LR Four Roofing, Inc. 2. It appears that Plaintiff is claiming damages allegedly owed by LR Four Roofing, Inc. 3. To the extent that damages are claimed against LR Four Roofing, Inc., the action has not been prosecuted against the corporation in its corporate name as required by Pa.R.C.P. 2177. WHEREFORE, Defendants respectfully request that the Court dismiss the Complaint. II. NONJOINDER OF A NECESSARY PARTY 4. Reference is made throughout the Complaint to LR Four Roofing, Inc. 5. It appears that Plaintiff is Claiming damages allegedly owed by LR Four Roofing, Inc. 6. LR Four Roofing, Inc. has not been joined as a defendant to this action. WHEREFORE, Defendants respectfUlly request that the Court dismiss the Complaint. III. INSUFFICIENT SPECIFICITY IN A PLEADING 7. Reference is made throughout the Complaint to certain alleged verbal or oral agreements. 8. Reference is made throughout the Complaint to certain work which Plaintiff allegedly perfonned. 9. The Complaint does not SUfficiently specify the following so as to enable Defendants to prepare a responsive pleading: a. The tenns of the alleged agreements; b. Whether the alleged agreements were made with Defendants individually or with LR Four Roofing, Inc.; c. Whether Plaintiff perfonned the alleged work as an employee or independent contractor; d. What tenns of the alleged agreements have been breached; and e. What sums allegedly owing under the agreements have not been paid. WHEREFORE, Defendants respectfully request that the Court dismiss the Complaint. IV. FAILURE TO CONFORM TO PA.R.C.P. 1020(a) 10. The Complaint appears to demand damages for the breach of more than one agreement. 2
