Bice the sum of Seventeen Thousand Six Hundred Dollars ($17,600,00), 6. The premises subject to said mortgage is more specifically set forth in Exhibit "A", 7, R, Michael Bice and Deborah I. Bice are the sole owners of the said premises securing said mortgage, 8, Said Mortgage has not been assigned in whole or in part by the Plaintiff herein. 9, That said Mortgage is in default because Defendants herein have failed to pay a partial payment of $405,88 for July, 1995, monthly payments of $431.00 for August through December 1995; $417,35 for January through December 1996; and payments of $337,20 for January, February, March, April and May, 1997. 10, The Plaintiff has given to the Defendants written notice of intention to foreclose on said Mortgage as required by law under Act 6, dated March 19, 1997, a copy of which is attached hereto and incorporated herein as Exhibit "C", II. The Plaintiff has given written notice of default as required by the Homeowner's Emergency Assistance Act of 1983, dated March 19, 1997, a copy of which is attached hereto and incorporated herein as Exhibit "0", 12. That due to Defendants' default and the fact the Mortgage matured on April 10, 1997 the entire principal amount of Seventeen Thousand Six Hundred Dollars ($17,600.00) has become due and payable, together with escrow due, intcrest at the current rate of 8,5% per annum, reasonable legal fecs for collection of said sum in accordance with the terms of said mortgage less such sums as have been paid on account of principal of the said Mortgage and costs, '. '. 13, The PlaintilTbelieves and therefore avers that reasonable attorney's fees for collection of the debt is $1,000,00 and that it will incur such amounts, 14, The Defendants are liable to the PlaintilT for interest at the rate of 8,5,00% per annum, late charges, property taxes and expenses as provided in the Mortgage documents that will accrue until distribution by the Sheriff of Cumberland County, Peansylvania, to be computed at the time of judgment in these proceedings, in addition to the current balance, 15, The Defendants are liable to the Plaintiff for the following on said Mortgage loan: a, Principal $6,718,63 b, Interest to 5/31/97 1,094,58 c, Escrow due 4,906,68 d, Payment Credit (25.12) e, Attorney's fees 1.200,00 TOTAL AMOUNT: ~ 13.894.77 16, The PlaintilT believes and avers that the Defendants are not members of the armed forces nor are they in the military service of the United States of America.
