IN THE CO~RT Of COMMON PLEAS
OF CUMBERLAND COUNTY
COUNT I CONTRIBUTORY NEGLIGENCE
I) On 12/4/96 at approximately I :30pm, Corrections Officer Travis Shenk
allowed a verbal confrontation to take place between the plaintiff and
the defendant, Michael Bell, and failed to Intervene sufficiently.
2) Corrections Officer Shenk's behavior failed to exhibit the care which,
He ought to exhibit, whether It be slight, ordinary, or great. C/O Shenks
behavior was characterized by inadvertence, thoughtlessness, Inattention
and the like, whlleC/O Mike Bell (defendant) clearly acted with wlllfull
WANTONESS and RECKLESSNESS.
3) Corrections Officer Shenk failed to use such care as a reasonably
prudent and careful person would use under such circumstances.
4)Correctlons Officer Shenk failed to do what prison guards of ordinary
prudence would normally have done under similar circumstances; That Is
to notify his shlftleader of the altercation that took place In the gym
on 12/4/96 at approximately 1 :30pm.
4a) In addition to the above, C/O Shenk also failed to Intervene, control,
and Isolate the plaintiff and defendant as would normally be done In the
case of (2) two inmates engaging in a similar altercation, for example;
Separating the participants Involved In the altercation and/or taking
the proper measures to follow the rules and regulations of the prisons
disciplinary procedures.( see exhibit B ) For example; Dismissing one
from the gym, verbal warning and/or a disciplinary write-up.
5) eorrections Officer Shenk was responsible for breaching the rules of
disciplinary procedure Imposed on prison employees and inmates In order
to protect both from Injury. Consequently C/O Shenk's behavior contributed
to the Injury sustained to the plaintiff later on In the dining hall on
12/4/96 at approximately 4:10pm.
COUNT 2 NEGLIGENCE
ON APPROXIMATELY 8/23/96 at 8:30pm
1) I(the plaintiff), was told to lock down when i was On unit H. cellN8
after I had been assaulted by an inmate. I tried to tell my side of the
story to (2) two C/O's and they kept telling me to lock-down and and before
I knew It, there were (4) four more C/O's coming on the unit so, I decided
to lock-down and as I went to close my cell door, C/O Byrne forced my door
open and I let go and went to sit on my bunk. Then,at that tlme.7-8 C/O's
came In my cell and told me to get On the floor and there was no room in
my cell to get on the floor, so I gave C/O Wickard my arm to put on the
handcuffs and before I knew it, I was being choked and punched by C/O's
and my cellI ight was.'turned out'by 'one of them,
2) The other Corrections Officers who were involved in the incident stated in naragraph 1
of this count are the following:
Corrections Officer Shenk,C/O Wa11ace.C/0 Bell ,C/O MUldrow,Coporal Culbertson,and Seargeant
Teaney, along with the two I have already stated; C/O Byrne and C/O Wickard.

COUNT 2 NEGLIGENCE(CON'T)
3) See count 1 (CUNTRIBUTORY NeGLiGENCE)
4) Both defendants, Cumberland County Prison Warden,Ear1 Reitz.and Cumberland County Commissioner,
Nancy Besch fal1ed to dO a thorough investigation When i notified them about the contract
being put on me. If they would have done some type of investigat10n, I would have been questioned
during the process for information on who ,what ,when ,where ,why,and how, but I wasn't.
5) When defendants, Earl Keitz and Commlssloner Nancy Besch were informed about a contract
being put out on me by" Correction Officers, they failed to contact the Cumberland County
uistrict Attorney's Uffice to get involved and investigate the a11e~ations.
6) The Plaintiffs cell was shook-down by Corrections Ufflcer Eickoff,Mike and LT. Mike
11u1holland on 2/26/97 and all my cosmetics were destroyed and my mattress and pi Ilow were
rlpped apart beyond repair. I have 2 witnesses to this incident. No one e1ses cell was
destroyed but mine.
7) Cumberland County Prison Warden. and his staff involved in all alleged incidents are in
violation of several of the Prisons Rules and Regulations in "EXHIBIT B".
8) C/O Mike ~ell, C/O Trevor Kent,and C/O Morrison were negligent for the role they played
in -enP. contract on the Plaintiff in count 5. Their actions and behavior were negligent.

COUNT 3 VIOLATION OF CONSTITUTIONAL CIVIL RIGHTS
COUNT(3a) VIOLATION OF U.S.C.A. 8th AMENDMENT RIGHTS
I) On B/23/96 at approximately 8:30pm, I, (the plaintlff)got into a confron-
tation with an Inmate (Quinton Miller). I was askad to lock-down and I
tried to explain that an inmate had assaulted me in my cell and (2) two
C/6's asked me to lock-down, then before i knew it there were 4-5 more C/O's
coming on housing unit H. So 1 went to go lock-dow~ and tried to pull the
door shut but C/O Byrne grabbed my cell door to force It open and I let go
and went to sit On my bottom bunk,and approximately 7-8 C/O's came Into my
cell and said r was going to the hole and i did not resist. I gave C/O
Wickard my arm to handcuff me and before I knew It, the light In my cell went
out and the C/O's started choking and punching me. They told me to get on
the floor but there was no room in my cell to get on the floor wi th 7-8 C/O's
and myself In a small cell. I was assaulted by several C/O's in unit H cell#8.

2) On 8/23/96 at approximately 8:45pm, I.Robert L. Smerl ing(plalntlff) was
escorted to segregation,and upon arriving In unit A,eell 3. Iwas told to lay
on the bunk,but the way I was held by 4 C/O's and h~ndcuffed, I couldn't lay
completely flat on the bunk so then I was assaulted by C/O Mike Bell by being
kicked In the head (2) twice with his boot. I was kicked so hard that I saw

COUNT(3a) VIOLATION OF U.S.C.A. 8th AMENDMENT RIGHTS CON'T.
3) On 12/4/96 at approximately 4:00pm, housing unit E was called to the
dining hall for dinner and I (plaintiff) was on E unit at the time.
I got my tray and sat at the table next to the entrance door of the dllllllg
hall. I sat down and turned around and C/O Mike Bell came through the door
; he mumbled something and passed by me and signed in for his tray he' came
back over to me and sald,"next time I'll crush your skull". Then, he walked
away and got his tray and went where the staff cat at. THEN asl got done
eating and put my tray over at the dlshstatlon, I the plaintiff, turned
around,and there was the defendant, Mike Bell. He said to me,"ya know your
gonna say one too many things to me" and I sald,"you'll get over It".
Then,he came from the side of me and BASHED me with an open hand and busted
open my mouth. The defendant used such force that i saw stars again.

COUNT (3b) VIOLATION OF U.S.C.A. 14th AMENDMENT RIGHTS
1) Cumberland County Prlson(defendant) Is In violation of their rules and
regulations under the title "LEGAL COUNSEL". It states thot on Inmote
requesting legal representation on civil cases only, Is avalloble, and
I wrote several requests for legal representation and was denied. the
defendant Is In violation of my right to due process becouse thoy foiled
to provide me legal representation which was supposed to be availoble to
me as an Inmate. SEE EXHIBIT "B".
2) The (plaintiff) Robert L. Smerllng has been denied sufficient legol
access to legal asslstance,counsel and hard to obtain moterlals.

3) Many of the legal fl rms that I have been referred to,have declined
representation on the grounds of that they are not funded to osslst or
defend Inmates, and others have expressed doubt's about their ability to
win a case against a prison, because the courts usually find in favor of
the Institution, Instead of the Inmate.
4) I Robert L. Smerling (plaintiff) allege that the (defendant) Cumberlond
County Prison Is retaliating against me for filing 0 civil suit against
them by changing polley regarding provision of legal materials.

4a) I (plaintiff) put 16 legal books In the control booth on 1/15/97 and
they were given to CPL. Jenny Hearns and all the slips were pulled out
of all the books and the books ended up back In the law library.

4b) On 1/IB/97 at approximately 6:45pm I spoke with LT. Mulholland and he
said he knew who took the slips out of my books ond who returned them to the
law library and that the new rule Is that I'm only allowed 2 books on law
library days, until the warden rules on whether we will get copies on law

4c) Prisoners do not lose the right to due process of the 14th Amendment.
It follows them Into prison and protects them from uncollstltutlonal
administrative action on part of prison authorities.

5) In I ight of fact that beating Inflicted upon prisoner before he was being
taken to Isolation cell after prison dlsturbonce and under circumstances
which there was no call what so ever for application of force violated

participated In beating of prisoner, are liable to prisoner for all of his

7) On 2/24/97 I sent a motion for photocopies of 1ena1 materials to the clerk of courts and
to all defendants and the motion was deferred by the Judge as beino premature and shortly
after that the(defendant) Cumberland County Prison Warden had a memo put out that inmates
will now be charged lOt for conies of legal material.
8) Un 2/25/97 the day after the(defendant)CCP Warden, recieved my motion for photocopies of
legal documents, they finally not the requested legal material I needed that the prison don't
have. It took over l~ months for me to get the reauested 1epa1 material.
9) On 3/7/97 a memo came out about inmates having to nay for nhotoconies. 1 al1eoe this was
done out of retaliation due to me reouestinp alot of conies of 1eqa1 material to file suit
against the prison warden and his staff.
10) I had a disciplinary hearing on 3/10/97. The prison staff failed to do a comolete summary
of the things that were done that led up to an inmate beinq threatened to testifv aoainst
me or that he will be sent up-state. ~y appeal was shot down by the Warden.
11) I requested legal material that the prison does not have on 3/1/97 and still to this
date, I have not recieved any of it or even a response. I also requested legal material
on 3/20/97 and haven't seen that yet either. Its been over 3 months so far. I've been
denied access to legal material by cunber1and county prison.
12) On 3/25/97 I requested the defendant to get me the legal material I requested: still
no answer.
13) On 2/17/97 I was awoke by LT. Ilgenfritz about some legal books I requested copies of
and they mysteriously disappeared again. They were in central control at lunch at 11:45am
and disappeared by 2:15pm, when the LT. woke me un. I wrote a oreivance to the Warden and
got no response. A couple days later I found the books in the law 1ibra~v buried with my
slips still in them. An 1nmate witnessed this also and will testify in court.
14) My original copy of my first law suit I filed apainst the prison was stolen by nrison
officials during a shakedown on 1/29/97 and I was called to the LT'S Office on 1/31/97 at'
approximately 9:15pm and my law suit mysteriously reappeared on the LT's desk.
15) I had been asking for the title 42 Purdons Pa rules of civil nrocedure since Janua~y
and was denied the books. That is whY I was unaware of the rule for un1iauidated damages
#1021. Then on 3/30/97 the 3 books reaopeared on the shelf in the LT's office for the first
time. I have 2 witnesses to this incident who will testify in court.
16) Cunber1and county Prison Warden has allowed the D1alntlff to be denied certaln legal
books and materials. The defendant has limited my access to 1enal books and materials.
I allege that it 1s in reta11atlon, because I am f11ino civil complaints aqainst them.

COUNT 4 THREATS AND INTIMIDATION
1) The plaintitf was threatened, intimldated,and challenged by Mike Bell, when on 12/4/96
at 1:30pm, Mike Bell came lnto the gym and got in the olalntlff's face and asked aoout words
that were exchanged earller ln the hallway at 1:10pm.
2) Nike Bell threatened to burn down my house with my family in lt and also said,"this ain't
over with, I'll get you". Ihis was l4itnessed by 1nmates.
3) On 12/4/!i6 at 4:UOpm, Mlke ~e11 came into the dinlng room and sald,"Next time, I'll crush
your skull". I was threatened. '
4) Plaintiff was threatened and intimidated by Michael ~u1ho11and after hlS cell was shook
down and destroyed on 2/26/97. LT. Michael Mulholland threatened the Plaintiff that he better
not even th1nk about filing a law suit a~ainst him. LT. 11ulho1land threatened to nail my ass
to the wall and that he would come down on me big time.
5) The Plaintiff notified Mrs. Scott about all the threats,intimidation, and harrassment
from the 3:0Uom-ll:OO~m shift on 2/27/97.
6) uN 1/21/97 I was threatened by corrections officer, Rebuck in the staff station, that he
would DUt my head through a wall in the staff station. The situation was unDrovolked. He
stated to me that he used to get picked on a10t when he was youn~er and that he was havin"
a bad day.
7) (;orrections Officer, Scott Morrison made a threat to an inmate about DuttinCl a contract
on the Plaintiff. I was then warned oy the inmate to lay low and watch my back. ThlS occured
on 3/26/97.
8) Un 4/5/97 I was threatened and verbally attacked by an inmate,and Corrections Officer,
Shawn Harrison failed to intervene sufficiently and opened my cell UD for the inmate to oet
at me in my cell. Then he later asked me to come in the staff station and asked me if I was
okay? The next day I suffered 2 broken ribs from the same inmate.

COUNT 5 CONSPIRACY TO ORDER A CONTRACT UN THE PLAINTIFF, FOR AN INI'ATE TO COMMIT A CRIME
AGAINST THE PLAINTIFF.
1) Corrections Officer Scott Morrison has a renutation for orderino contracts on 1nmates.
The Plaintitf has several witnesses who will testify in court and I also have written
statement.
2) Corrections Officer told an lnmate to inf11ct bodily harm on lnmate, Mark KlnQ. Because
the officer believed that Kinq told on him for bringing cigarettes into the prison for lnmates.
The inmate WhO was ordered to do thlS wl11 testify in court.
3) Corrections Otficer Scott Morr1son told an inmate that he was ~olng to put a contract on
the Plaintiff on 3/2b/97 during gym tlme. The inmate informed me about it and told me to lay
low and watch my back.
4) Corrections Ofticer Scott Morrison asked the inmate involved in paragraph H3 on th1s count
if he Wou1d"inf1ict bodi Iy harm on an inmate", and if a carton of ciqarettes would cover it.
The inmate told me that he turned the Officer down. I will SUbpoena this inmate, to testi~v
in court.
5) Un 3/27/97 I was in the psychologists, Mr. Zengerle,s office and I beoan telling him about
a contract being put on me and I filled out a request slip askinq to see the ~Iarden immediatelY,
that I had some important information for him and Mr. Zengerle oersona11y put it on the ~Jarden's
desk that day. The request slip went unanswered and iqnored. I have obtained a coPY of the
request slip.
6) 'On 3/'J0/97 I typed a letter and sent it to Jud'1e, Edgar B. BaYley expreSSlnq my fears and
concerns for my safety and security in the institution and informino him about a contract
that was being out on me. I have a wltness to tne contents of this letter and I have a co~v
of the letter also. I have still to this day gotten no response.
7l On 4/8/97 1 wrote the Cumberl and County COJw.1i,sS i,oners Offi,ce about the Warden not answeri nlJ
my reque~t sl~ps and about a contract being out out on me here at the pr~son. Then on 4/9/97
at approximateiy 4:00pm I was told by Mr. Motter that Mr, John Uard called and asked him to
tell me that he is in reciept of my letter and they will investigate and get back to me and
I have heard nothing to"this day.
8) On 4/14/97 I told Copora1 Shenk and LT. Mulholland that an officer has put a contract out
on me and they said nothing or asked any further questions. I told them this in the LT!s
offi ce.
9) On 4/15/97 1 was called to Mr. Carey's office and the Warden,Ear1 Reitz was there also
and I told them both about the contract that was put on me. Earl Reitz said he will investigate
and I have heard nothing about it from him again until 5/15/97 when I passed by Hr, Carey's
office and the Warden was in there and I asked him,"what is going on about the investigation
about the contract on me"? He said,"as far as the Prison and the Commissioners Office are
concerned, its over with". This was at approximately 2:35pm on 5/15/97 on thursday.
10) On 4/20/~7 I wrote another letter to the commissioners office about the contract and they
wrote me back and said they will review it and I have heard nothing Slnce. I have a letter from
the Cheif Clerk,John Ward dated 4/22/97 acknow1edginq them recievino my letters dated the 8th
and 20th of April 1997. Ihave heard nothing'since. It seems as thouqh this matter has been
swept under the carpet.......

RELIEF SOUGHT ON THIS CIVIL COMPLAINT
I, the Plaintiff seek the followin~ relief:
1) I would ask that all corrections officers report any and all incidents to their shiftleader
that involve an inmate and a guard, so these tYDes of incidents can be stoDDed before they
get out of hand, and to prevent these tyoes of thinQs from hapoenino to another inmate.
2) I ask that some type of legal assistance be available to inmates on civil cases, WhlCh
1 was denied.
3) I also request that an experienced person in civil and criminal law be hired and assianed
to work with inmates in the law library.
4) The plalnt1ff requests that Corrections Officer Scott ~orrison be terminated. Also that
he not be allowed to work for any type of law enforcement a~ency for the role he olayed in
the attempt to put a contract on the Plaintiff and several other inmates in Cumberland County
Prison.
5) The P1aintlff requests that Corrections Officer Michael Bell be terminated. Also that he
is not allowed to work for any type of law enforcement agency for the role he played in the
attempt to put a contract on the Plaintiff by having another inmate inflict serious bodily
harm on him.
6) The Plaintiff requests that former Corrections Officer Trevor Kent, who now works for the
Cumberland County Sherriff's Dept be terminated. Also that he not be allowed to work for any
type of law enforcement agency for the role he played in the attempt to put a contract out on
the Plaintiff also.
7) The Plaintiff requests that if all parties are not going to be terminated. that they be
suspended for a very long period of time. I also request that the parties involved in the
contract on me be charged criminally. SEE COUNT 5
