Waiver of Mechanics Lien
WHEREAS, Ruhlman Bros., Inc. of RD#2, Hanover, PA 17331, is a
sub-contractor of John F. Walter Excavating, Inc., who entered into a contract dated
Ve.~rcta. rtt fi .koo ~ , ("Contract") with S & A Custom Built Homes, Inc. to
provide materials and perform labor necessary for the site improvements at
Chesterfield, Phase II, Section 2A, Borough of Carlisle, Cumberland County,
Pennsylvania, and more particularly described in a deed recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book V, 31,
Page 351, Tract i only.
NOW, THEREFORE, it is hereby stipulated andagreed that neither the
undersigned sub-contractor, any material man, nor any other person who furnished
labor or materials to the contractor under the Contract will file a lien, commonly
called a mechanics' lien, for work done or materials furnished to the said site
improvements or any part thereof.
This stipulation is made and intended to be filed with the Prothonotary
for the County of Cumberland, Commonwealth of Pennsylvania in accordance with
Section 401 of the Mechanics' Lien Law of 1963, codified at 49 P.S. §1401 (Purdon
1965), of the Common. wealth of Pennsylvania in such case provided.
IN WITNESS WHEREOF, the undersigned hereto, intending to be
legally bound, have set their hands and seals this ~ day of
