Noble, by and through her counsel, Howett, Kissinger & Miles, P.C., hereby files this Petition to Modify Foreign custody Order against Defendant Michael C. Noble, and in support thereof respectfully avers as follows: 1. Petitioner is Margaret C. Noble (hereinafter referred to as "Mother"), the plaintiff in the above-captioned matter, who currently resides at 1149 Dry Powder circle, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 2. Respondent is Michael C. Noble (hereinafter referred to as "Father"), the defendant in the above-captioned matter, who currently resides at 380 prairie Drive, Forks, Washington, 98331. 3. The parties were previously husband and wife, having been divorced by a Decree of Dissolution of Marriage (with Minor Children) entered on September 15, 1988 in the Superior Court of the State of Arizona in and for the County of pima at docket no. D-070903. A copy of said decree is attached hereto as Exhibit "A" and incorporated herein by reference. A certified copy of said decree is being registered with the Cumberland County Court as a foreign custody order pursuant to the Uniform Child Custody Jurisdiction Act contemporaneously with this petition. 4. The parties are the natural parents of three (3) minor children: lWm DATE OF BIRTH John Drummond Noble, III Brian Charles Nobel Matthew Covington Noble 10/16/81 9/13/83 12/12/85 5. The Arizona decree awarded the parties joint legal custody of the three (3) minor children. Mother was awarded physical custody of Matthew, subject to reasonable visitation rights in Father. Father was awarded physical custody of John and Brian, subject to reasonable visitation rights in Mother. However, since the decree was entered, the children have lived with either party at various times, not consistent with the award of physical custody pursuant to the Arizona decree. 6. Brian and Matthew have lived with Mother since the summer of 1995. John has lived with Mother since March 1996. 7. Neither party nor any of the children has lived in Arizona for more than eight (8) years. Mother and the three (3) children reside in Pennsylvania and Father resides in Washington. 8. Pursuant to the Federal Parental Kidnapping Prevention Act ("PKPA"), 28 U.S.C. ~1738a, a state court that has made a prior custody determination has continuing jurisdiction to modify custody if the state continues to have jurisdiction under its own laws and the state is the residence of the child or of any contestant. No child or a party to this custody matter 3 The state in which the child immediately preceding the time involved lived with his parents, a parent, or a person acting as parent, or in an institution, for at least six consecutive months, and in the case of a child less than six months old the state in which the child lived from birth with any of the persons mentioned. Periods of temporary absence of any of the named persons are counted as part of the six-month or other period. Mother and all three (3) children have resided in Pennsylvania since March 1996, a period of more than one year. Therefore, the provisions of ~5344(a)(1) (i) confirms jurisdiction to modify the custody order in the courts of this commonwealth. 12. Because all three (3) children and one parent have resided in Pennsylvania for more than a year and there is available here substantial evidence concerning the children's present and future care, protection, training and person relationships, this Court also has jurisdiction pursuant to ~5344 (a) (2) . 13. This Court has jurisdiction pursuant to ~5344(4) because no other state has jurisdiction under the prerequisites of ~5344(1), (2) or (3) and it is in the best interests of the children that this Court assume jurisdiction. 14. Mother has had primary physical custody of Matthew and Brian for almost two (2) years and John for more than one (1) year. The Arizona decree does not reflect the current custodial circumstances and has not for some time.
