ORDER OF COURT
AND NOW, this 6th day of November, 1995, a
hearing was held this date to remove Pauline A. Martin as
administrator of the estate of her sister, Mary M. Merva. The
record would show that the decedent died March 16th, 1994, and
that Pauline A. Martin was appointed personal representative on
October 19th, 1994.
Since that date she has done absolutely nothing in
connection with the administration of the estate, and,
therefore, the Court makes the following order:
The Court directs that Pauline A. Martin have an
attorney file an appearance within ten days from today.
Secondly, that an inventory be filed within thirty days from
today and that thereafter the estate proceed in accordance with
present law.
If an attorney does not file an appearance within
that time or if an inventory is not filed within that time, the
Court then will vacate the appointment of Mrs, Martin as
personal representative of the estate of her sister.

Dear Ms. Lewis:
Please be advised that this mailer has finally been concluded in that the sale of the
property occurred approximately four (4) weeks ago, and we have prepared the Inheritance Tax
Return, and accountings for ultimate distribution.
In that aspect, I have enclosed herewith four (4) original executed Inheritance Tax
Returns and a check in the amount of $1 0.815 .19 made payable to the Register of Wills, Agent,
for the tax which this office detennines is the amount due. I would respectfully request that you
forward an original return and inventory with the enclosed leller to the Department of Revenue,
Inheritance Tax Division, so that the penalty does not continue to run against this estate.
Receipts and Releases have been sent to all beneficiaries, and we are waiting the return of
the same in order to distribute the amount set forth within the Inventory to all beneficiaries.

Dear Judge Sheely:
Pursuant to my discussion with your Clerk of approximately one (I) week ago, please
find enclosed a copy of an Entry of Appearance, pursuant to your Order of November 6, 1995,
requiring the administratrix, Ms. Martin, to contact counsel to begin the process of administering
the estate. Also, my office has contacted Atty. Hogg indicating that an estate account will be
opened once the several bank accounts held by the decedent at the time of death are closed out,
and his client's claim would be immediately paid.
This office has also retained the Offices of McNees, Wallace & Nurick as local counsel to
coordinate the steps of selling the real estate and the personal property of the decedent, and to
prepare any filing with the Court pertaining to this estate.
Please understand that we arc working diligently to see that this estate is swiftly
administered, and please be assured that we have the expertise to see that the estate is also

PURSUANT TO 20 PA. C, S. SECT. 3182(1),
Margaret Albright petitions this Court to remove Pauline A. Martin,
Administratrix of the Estate of Mary M. Merva, Deceased. Petitioner
respectfully represents that:
1. Petitioner is one of the creditors of Mary M, Merva,
Deceased,
2. On October 19, 1994, respondent was appointed
personal representative of the Estate of Mary M. Merva,
Deceased, by the Register of Wills of Cumberland County,
Pennsylvania.
3. Pauline A. Martin, as Personal Representative of such
Estate, has failed, without reasonable excuse, to prepare
an Inventory and Appraisement within the times provided by
20 Pa. C.S. Sec1.3301.
Wherefore, Petitioner requests that Pauline A. Martin be ordered to
appear and show cause why she should not be removed as Personal
Representative of the Estate of Mary M. Merva, deceased, and that the
Court grants Petitioner such other and further relief as may be deemed
just and proper.

Dear Judge Sheely:
Please be advised that we have made some progress with respect to the estate of the
above decedent regarding liquidating the assets of her estate.
The real estate people have been contacted and we expect very shortly, to put the property
on the market for sale, this office has retained the services of McNees, Wallace and Nurick as
local Counsel as you advised in my letter of November 28,1995.
The difficulty we are encountering in this matter is the age Wld physical condition of the
Administratrix. Those items, combined with the difficulty we have met with in the way of her
inability to travel under the weather conditions, have set us back in our goal of settling this
matter.
We ask you for your patience and advise you that we have satisfied Attorney Hogg's
client and have paid other bills that have arisen. Please be assured we will make every effort to
get this matter settled as soon as circumstances allow.

Please be advised that this mailer has finally been concluded in that the sale of the
property occurred approximately four (4) weeks ago, and we have prepared the Inheritance Tax
Return, and accountings for ultimate distribution.
In that aspect, I have enclosed herewith four (4) original executed Inheritance Tax
Returns and a check in the amount of$IO,815.19 made payable to the Register of Wills, Agent,
for the tax which this office detennines is the amount due. I would respectfully request that you
forward an original return and inventory with the enclosed leller to the Department of Revenue,
Inheritance Tax Division, so that the penalty docs not continue to run against this estate.
Receipts and Releases have been sent to all beneficiaries, and we are waiting the return of
the same in order to distribute the amount set forth within the Inventory to all beneficiaries.

Dear Madam:
Enclosed please find a status report in the above estate. It doesn't furnish you with a great
deal of information, hence this letter.
Mary M. Merva died March 16, 1994. She left to survive two elderly sisters and one
elderly brother. The only persons now surviving are the named administratrix, Pauline Martin,
and the two sisters, neither of which are able to handle this matter.

Ms. Martin is not well physically, with so many deaths to cope with in such a short
period, nor is she able to be herself mentally. That said, be advised that your communication of
April I 5th seems to have had the desired effect. The contract with the Realtor has been executed
as of April 18, 1996 and even though the dwelling of the decedent is not in good shape to sell, it
will be hopefully be sold soon at a reduced figure. We believe that the proceeds of the sale will
satisfy all creditors, satisfy the Pennsylvania Inheritance Tax in full, together with the payment of
real estate taxes and leave a small amount to distribute to the eleven heirs of decedent.
The utility bills have been satisfied, the claim which originally brought this matter before
the Court has been satisfied, insurance has been placed on the dwelling, and we are awaiting a
buyer.

I am in rcceipt of your Notice cnclosed herewith of April 4, 1997, and have immediately
attended to the return of the Status Report under Rule 6,12 under the Orphans Court Rules of
Procedure,
To date the administration of the cstate is complete pursuant to the attached Receipts and
Releases enclosed herewith, the originals of which I ask be filed with the Court. Kindly time
stamp the copy and return to my office within the enclosed self-addressed, stamped envelope for
my records.
As noted within the Receipts and Releases, the amount of$ I ,000.00 is being held for
additional taxes, etc., specifically income tax on the sale of the property if applicable, as the
accountants are attending to these maltcrs to see iftherc are any capital gains applicable, This
office did rcceive a Notice of Appraisemcnt, Allowance or Disallowance, from the Deportment
of Revenue, Inheritance Tax Division, indicating a $29.49 crcdit, therefore all Inheritance Tax
has been paid,
Those amounts will be disbursed to the beneficiaries, but for purposes of the status report,
administrntion is complete, as the Receipts and Releases have been obtained and monies
disbursed,
