LIVELSBERGER t/a, HERITAGE BUILDERS, : Contractor STIPULATION AGAINST LIENS WHEREAS, KENNETH J. LEVINE and HAGAR N. LEVINE, his wife, of 1275 Shade Lane, Boiling springs, Pennsylvania, hereinafter called "Owner" have entered into a contract with GLENN D. LIVELSBERGER t/a HERITAGE BUILDERS of 696B Birchwood Road, Harrisburg, Pennsylvania, hereinafter called "Contractor" for the erection, construction, alteration or repair of a building and other improvements upon the property and real estate containing a total of 7.2198 acres, mIl, a/k/a Lot No.1, Finn1 Subdivision Plan for ceorge P. Kenworthy and Carolyn F. Kenworthy, recorded in Plan Book 65, at Page 127, and Lot No.2, Preliminary Subdivision Plan for Luther W. Lebo and E1va S. Lebo, recorded in Plan Book 67, Page 144, Dickinson Township, Cumberland County, Pennsylvania, more particularly described on Exhibit "A" attached hereto and made a part hereof by reference. NOW THEREFORE, it is stipulated and agreed between the parties, as part of the contract and in further consideration thereof, that neither the Contractor or any subcontractor or materialmen, nor any person furnishing labor and materials under the contract or any supplemental contract, may file a lien, commonly called a Mechanics' Lien, under the contract or any supplemental contract, oral or written, for work done or materials furnished, such right being expressly waived. Contractor warrants and represents that no work of any kind has been done and no materials have been furnished, delivered or ordered in connection with the contract or any supplemental contract for extra work. Contractor further agrees to indemnify Owner from any and all damages, costs and expenses, including reasonable attorney's fees suffered by Owner as a result of any lien filed or claim asserted against the property by Contractor, or any subcontractor, materialmen, workmen or any other person in violation of this stipulation.
