II. Defendant seeks partial custody rights and visitation of Sydney B. Osterlund, age 3, born
July I, 1994, who presently resides at P. O. Box 384, Idamay, West Virginia, 26576.
The child was not born out of wedlock.
The child is presently in the custody of Plaintiff at P.O. Box 384, Idamay, WV, 26576.
During the child's life, the child has resided with the listed individuals at the following
addresses:

The mother of the child is Plaintiff. Holly R. Osterlund. who currently resides at
P. O. Box 384, Idamay, West Virginia. 26576. She is married.
The father of the child is Defendant, Matthew J. Osterlund, who currently resides at
409 Deerfield Road, Camp Hill, PA 17011. He is married.
12. The relationship of Plaintiff to the child is that of mother. The relationship of
Defendant to the child is that of father.
13. Defendant has not participated as a party or witness. or in another capacity, in
other litigation concerning the custody the child in this or another court.
14. Defendant has no infonnation of a custody proceeding concerning the child
pending in a court of the Commonwealth.
15. Defendant does not know of a person not a party to the proceedings who has
physical custody of the child or claims to have custody or visitation rights with respect to the
child.
16. The best interest and pennanent welfare of the child will be served by granting
the relief requested because:
a. Defendant has played a major role in raising the child;
b. The parties are presently separated within the meaning of the Pennsylvania
Divorce Code, and the divorce is forthcoming;
c. Defendant can provide a stable home environment for the child;
d. Defendant is fearful for the child's welfare as Mother has separated the
child from the Father without consideration of the child's well being; and
e. Defendant further fears that Plaintiff may deny access of Father to the
child and therefore denying child the care and nurture of her Father.
17. Each parent whose parental rights to the child have not been tenninated and the
person who has physical custody of the child have been named as parties to this action.
WHEREFORE, Defendant, Matthew J. Osterlund, respectfully requests that this court
grant partial physical custody rights to the Defendant in the fonn of partial custody two (2)
weekends a month, alternating holidays and four (4) weeks summer vacation.
