.
1, The parties shall have joint legal custody of the children, which shall
include, but not be limited to the mutual sharing of information and decisions with
regard to medical care, education, religious instruction,
2, The Mother shall have primary physical custody of the children, subject to
periods of partial or temporary physical custody and visitation with the Father as
follows:
A. Every other weekend from Friday, at or about 6:00 p.m" through
Sunday, at 8:00 p.m" except that if the Father has Friday off work, he shall be
permitted to pick up the children at 6:00 p.m, on Thursday evening,
B, On weekends when the children are with the Mother, provided the
Mother does not have alternative plans for the children, the Father shall be
permitted to pick up the children for church on Sunday morning and shall return
them to the Mother by Noon on that day,
C, The parties shall share the Christmas holiday on a mutually
agreeable basis, it being the intention of the parties to spend time with their
children on Christmas Day as equally as possible, The Father shall have the
children on Easter, July 4th, and Thanksgiving on even numbered years and on
Memorial Day and Labor Day on odd numbered years, The Mother shall have
the children on Easter, July 4th, and Thanksgiving on odd numbered years and
on Memorial Day and Labor Day on even numbered years, The Father shall
always have the children on Father's Day and the Mother shall always have the
children on Mother's Day, The parties shall each have time with the children on
their respective birthdays,
D, The Father shall have up to four weeks vacation time with the
children each year, with no more than two weeks taken at one time, The
vacation weeks shall be for a period of seven days, but must include Father's
regularly scheduled weekend, unless otherwise agreed by the parties, The
Father shall give notice to the Mother by May 1'1 each year of the weeks he
wishes to exercise this Summer vacation,
E, Such other times as the parties may mutually agree from time to
time, each recognizing that some flexibility may be necessary in order to
accommodate work schedules and other changes in circumstances and their
mutual desire to spend significant time with each of their children.
3, Neither party shall reside with the children outside of the Commonwealth
of Pennsylvania without first securing the consent of the other party or further order of
this Court. Whenever either parent takes the children away from their respective
primary residences on vacation, they shall provide a means for the other parent to
contact them in an emergency.
4, Both parties agree that each party shall have reasonable telephone
contact with the children while the children are in the other party's custody and that the
children will be permitted to call the noncustodial parent as desired while they are in
the custody of the other parent.
5, The parties will keep each other advised immediately relative to any
emergencies concerning the children and shall further take any necessary steps to
ensure that the health, welfare and well being of the children is protected.
6, The parties shall do nothing that may estrange the children from the other
parent or injure the opinion of the children as to the other parent or which may hamper
the free and natural development of the children's love or affection for the other parent.
7. Father shall pay to Mother the sum of $185,00 every two weeks for the
support of the children, plus 50% of the children's reasonable daycare expenses, not to
exceed $160,00 every two weeks, effective November 1,1998, unless the Father is
temporarily or permanently disabled or unemployed and is not receiving disability or
unemployment payments, Said amount shall be payable directly to the Mother, rather
than through the Domestic Relations Section by a wage attachment, so long as the
Father remains current in his payments, If the Father becomes more than thirty (30)
days delinquent in these payments, then the Mother shall be entitled to request the
Cumberland County Domestic Relations Section enter an attachment of the Father's
wages to secure such payment. The Mother shall pay the expenses of third party
childcare, with the Father's contribution as aforesaid, but the parties will attempt to use
each other for childcare whenever possible, In addition, the Father shall provide health
and dental insurance coverage for the children, unless such insurance becomes
unavailable through his employment due to temporary or permanent disability or
unemployment. The Mother shall pay all "co-pays" for doctor visits and prescriptions;
however, the parties will share all other unreimbursed medical expenses for the
children, including eye and dental care, with the Father paying 60% and the Mother
paying 40% of said expenses, All amounts payable hereunder are subject to change
based upon changed circumstances in accordance with the law and rule of Court,
8, For all tax returns for the tax year 1998 and thereafter, the parties agree
that WIFE shall be entitled to the dependency exemptions for both children on her tax
returns, provided the custody schedule does not substantially change, However, WIFE
will pay to HUSBAND the amount of federal income tax paid by the HUSBAND on the
support paid to WIFE during the year, This amount will be calculated by Father
completing his income tax return and determining his federal tax obligation, Then he
will subtract the amount of support paid from his taxable income and determine the
amount of tax on this "adjusted" income figure, The amount of the additional tax paid
on the support payments will be determined by subtracting the second tax amount from
