6. Plaintiff was unable to use what Defendant had installed as It was not
appropriate for Plaintiff's uses, and did not work properly.
7. In view of the above, Plaintiff employed the services of another company,
abandoned Defendant's upgrade and purchased another, more effective upgrade.
8, The new upgrade required the purchase of new software, as the software
installed by Defendant was Incompatible with the new system. Plaintiff paid
Defendant the following sums for software and software related equipment It Is now
unable to use:

9. Plaintiff paid Defendant $302.10 (285.00 + 17.10 tax) for a CD ROM drive
which was never received by Plaintiff.
10. Plaintiff paid Defendant $306.37 (289,00 + 17,34 tax) for a multimedia kit
which was unnecessary and never Installed by Defendant.
11. Plaintiff prepaid Defendant $2,756.00 for Forty (40) hours of service, of
which only Eleven (11) hours was ever received,
12. Defendant trained and consulted with Plaintiff's employee, Tom Redding,

required to employ the services of Compudata, Inc. for software support, at a cost to
Plaintiff of $133.75.
COUNT I
17. Paragraphs 1 through 16 are hereby incorporated by reference as if more
fully stated herein,
18. In doir.g the acts described above, Defendant has breached the parties'
contract.
19. As a result of the breach, Plaintiff has incurred a total of $28,853.86 in
expense.
WHEREFORE, Plaintiff SECCO, Inc, respectfully requests this Honorable Court
to enter judgment in favor of Plaintiff and against Defendant in the amount of
$28,853,86, an amount in excess of the jurisdictional amount requiring arbitration,

21. It would be inequitable for Defendant to retain the benefit of the sums
described herein, as Defendant would be unjustly enriched thereby.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter
judgment in favor of Plaintiff and against Defendant in the amount of $28,853,86, an
