THIS AGREEMENT made the 'I U 'day of ~ . /
1997/ by and between KEITH A. WRIGHT and KAREN L. ~~~~persons, hereinafter
referred to as Owners; and D & S CUSTOM HOMES, a Partnership, hereinafter referred to as
Contractor, whereby the former undertakes and agrees to erect and construct a single family
dwelling on:
ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland
County, Pennsylvania, more partil:ularly bounded and described as follow:
BEGINNING at a point on the Western side of McCoy Lane as shown on said Plan,
which point is on the dividing line between Lots Nos. 80 and 87 on said Plan; thence along the
Eastern side of Lot No, 87 North 71 degrees 40 minutes 14 seconds West 225 feet to a point
in line of lands now or formerly of Robert E. and Joyce L. Umbaugh; thence,by lands now or
formerly of Umbaugh North 18 degrees 19 minutes 46 seconds East a distarfce of 250 feet to
a point on the dividing lir.e between Lots Nos, 85 and 86 as they appear on; said Plan; thence
along the Southwestern boundary of Lot No. 85 South 50 degrees 46 minutes 13 seconds East
256,69 feet to a point on the Western side of McCoy Lane; thence along tHe Western side of
McCoy Lane by a cu,vc tl) the left having a radius of 225 feet an arc uj~lllnce of 82,08 feet to
a proposed concrete monllnwnt; thence continui:1g along said McCoy 1.:ll'e South 18 degrees
19 minutes 46 seconds West a distance of 78,16 feet to a point on thtl dividing line between
Lots Nos, 86 and 87, the Place of BEGINNING.

for Phase Number Two ci Callap:Hscink, which is rl;cordecJ in the Offi;;e of the Recorder of

UNDER AIIJD SUBJECT to a portion of a 20 fool storm water casement, as shown
on the hereinafter mentioned Subdivision Plan.
UNDER AND SUBJECT to building and use restrictions recorded in the Office of the
Recorder of Deed!; in and for Cumberland County, in Miscellaneous Boo!< 486, Page 1074.

BEING part of the property which was conveyed to Wilbert L. Diohl and Shryle M,
Diehl, husband and wife. by Michnel R, Rapuano llnd Marsha L. Rapuano, his wife, by deed
dated January 13, 1986/ and recorded in tho Office aforesaid in Deed Book "S". Vol. 31, Pago
236; and being part of "Parcol A" in said Deed, By an Agreement of Ssle for Real Estate
between Wilbert L. Diehl and Shryle M, Diehl, husband and wife, and D&S Custom Homes,
dated May 15, 1986/ and recorded in the Office aforesaid in Misc. Book 317, Page 915/
equitable title to said property was conveyed to D&S Custom Homos,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the snid Contractor, for and
in consideration of the sum of One and 00/100 ($1.00) Dollar to it in hand paid by Owner, the
receipt whereof is hereby acknowledged. and the further corlsideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and all parties acting through or
under them, covenant and ogree that no mechanic's liens or claims thoreto for or on account
of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings on the
lot above described, and the said Contractor. for themselves, their subcontractors and others
undar them hereby expressly waive and relinquish the right to have. filo and maintain any
mechanic's liens or claims against the said buildings or any of them. and agree that this
instrument. waiving the right of lien, shall be an independent covenant.
