PETITION TO FIX THE FAIR MARKET VALUE OF
REAL PROPERTY SOLD TO JUDGMENT CREDITOR
Wachovia Bank, N.A., successor by merger to Wachovia Bank of
Georgia, N.A., by its attorneys, Snelbaker, Brenneman & Spare,
P. C. files this Petition to fix the fair market value of certain
real property sold to Petitioner as judgment creditor and in
support thereof states the following:
1. Petitioner Wachovia Bank, N.A., successor by merger to
Wachovia Bank of Georgia, N.A., is a national banking association
with a principal address of 191 Peachtree street, N.E., 30th
Floor, Atlanta, Georgia.
2. Respondent Sanbury Corporation is a Georgia Corporation
with an address of 6405 Barfield, Atlanta, Georgia.
3. Respondent pebblebrook Apartments, L.P. is a Georgia
limited partnership.

6. Respondent B. G. Sanders is an adult individual and
general partner of Pebblebrook Apartments, L.P.
7. On April 24, 1997 a consent jUdgment was entered in
favor of Petitioner and against all Respondents identified above
in the Superior Court of DeKalb County, Georgia, docketed to
civil Action NO. 97-1077-4 in the amount of $3,570,430 with
interest at seven and one-half percent (7.5%) per annum.
8. On June 11, 1997 Petitioner transferred to and entered
the above-referenced judgment in this Court, docketing same to
Civil Action No. 97-3099 against Respondent Sanbury Corporation
only.
9. On June 11, 1997 Petitioner filed a praecipe for writ of
execution, directing the Prothonotary to issue a writ of
execution to the Sheriff of Cumberland County with respect to two
undeveloped tracts of land owned by Sanbury Corporation located
in Upper Allen Township, Cumberland County, Pennsylvania (the
"Sanbury Property").
10. On September 3, 1997, the Sanbury Property was exposed
to public auction by the Sheriff of Cumberland County and
purchased by Petitioner, the judgment creditor, for the price of
$1. 00.
11. The Respondents identified in Paragraphs 2 through 6,
sUDra., of this Petition are the only persons or entitles known
to Petitioner who may be directly or indirectly liable to
Petitioner for the payment of the debt upon which execution was

brought on the Sanbury Property.
12. The fair market value of the Sanbury Property at the
time it was purchased by Petitioner at public auction was
$350,000.00.
13. Petitioner and Respondents agree and stipulate that the
fair market value of the Sanbury Property at the time of its sale
to Petitioner on September 3, 1997 was $350,000.00 and that same
should be fixed by the Court as the fair market value of the
Sanbury Property pursuant to 42 Pa.C.S.A. S 8103(c)(1).
14. A true and correct copy of the Stipulation between
counsel for Petitioner and Respondents establishing the fair
market value of the Sanbury Property of $350,000.00 is attached
hereto and incorporated by reference herein as "Exhibit A".
WHEREFORE, Petitioner Wachovia Bank, N.A. requests this
Court to fix the fair market value of the Sanbury Property at
$350,000.00.

within named defendant, to wit: Sanbury Corporation a notice of the pendency of the action by
certified mail marked DELIVERY ONLY TO ADDRESSEE, to there last known address at
6405 Barfield Road N. E, Atlanta, Georgia 30328. This letter was mailed under the date of June
30, 1997 and was received on July 8, 1997 with return receipt card signed by H.M. Hildreth.
