Respondent Sanbury Corporation is a Georgia Corporation with an address of 6405 Barfield, Atlanta, Georgia. 3. Respondent pebblebrook Apartments, L.P. is a Georgia limited partnership. Sanders is an adult individual and general partner of Pebblebrook Apartments, L.P. 7. On April 24, 1997 a consent jUdgment was entered in favor of Petitioner and against all Respondents identified above in the Superior Court of DeKalb County, Georgia, docketed to civil Action NO. 97-1077-4 in the amount of $3,570,430 with interest at seven and one-half percent (7.5%) per annum. 8. On June 11, 1997 Petitioner transferred to and entered the above-referenced judgment in this Court, docketing same to Civil Action No. 97-3099 against Respondent Sanbury Corporation only. 9. On June 11, 1997 Petitioner filed a praecipe for writ of execution, directing the Prothonotary to issue a writ of execution to the Sheriff of Cumberland County with respect to two undeveloped tracts of land owned by Sanbury Corporation located in Upper Allen Township, Cumberland County, Pennsylvania (the "Sanbury Property"). 10. On September 3, 1997, the Sanbury Property was exposed to public auction by the Sheriff of Cumberland County and purchased by Petitioner, the judgment creditor, for the price of $1. 00. 11. The Respondents identified in Paragraphs 2 through 6, sUDra., of this Petition are the only persons or entitles known to Petitioner who may be directly or indirectly liable to Petitioner for the payment of the debt upon which execution was -2- LAW O,."IC[S SNELDAKER. S 8103(c)(1). 14. A true and correct copy of the Stipulation between counsel for Petitioner and Respondents establishing the fair market value of the Sanbury Property of $350,000.00 is attached hereto and incorporated by reference herein as "Exhibit A".
