3. On or about August 19, 1988, Defendants entered into an agreement whereby they
borrowed from The Commonwealth National Bank ("CNB") and agreed to repay to it the sum of
Forty-Five Thousand One Hundred Dollars and Zero Cents ($45,100.00), plus interest, and as
security for the loan executed and delivered to CNB their mortgage dated August 19, 1988, in the
amount of Forty-Five Thousand One Hundred Dollars and Zero Cents ($45,100.00) mortgaging
a tract ofland with a dwelling erected thereon located in Cumberland County, Pennsylvania known
as 206 Locust Street, Camp Hill, Cumberland County, Pennsylvania 17011. At all times relevant
hereto, Defendants were and remain the sole owners of the mortgaged property by tenants by the
entireties. A description of the property is attached hereto, made a part hereof and marked Exhibit
"A", A copy of the Note evidencing the aforesaid agreement is attached hereto. made a part
hereof and marked Exhibit "B".
4. On August 25, 1988, said mortgage was recorded in the Office of the Recorder of
Deeds of Cumberland County in Mortgage Book 914, Page 1087 and this mortgage in the public
records is incorporated herein by reference.
5. On or about August 19, 1988, said mortgage was assigned by CNB to Philadelphia
National Bank, ("PNB") as Trustee under a certain trust indenture dated as of April 1, 1982, with
the Pennsylvania Housing Finance Agency recorded August 25, 1988 in miscellaneous Book 353,
Page 1023. Under this assignment PNB succeeded to all the rights and interests of CNB in the
aforesaid mortgage. The note set forth in Paragraph 3 above was also assigned to PNB as Trustee
for Pennsylvania Housing Finance Agency. See Exhibit "C". PNC was subsequently acquired by
Corestates Bank, N.A. Thereafter, Corestates Bank, N.A., and Mellon entered into an agreement
10. Defendants also agreed under the terms of the mortgage and note that in the event
of default thereunder they would pay, in addition to the charges listed in paragraph 9 above,
attorneys' fees and costs incurred by Mellon as a result of the institution of these legal
proceedings.
11. The obligation owed by Defendants to Mellon continues to accrue interest thereon
at the rate of $9.88 per day beginning May 29, 1997.
12. In accordance with the Homeowners' Emergency Mortgage Assistance Act, of
December 23, 1983, P.L, 385 No. 91, 35 P,S. ~1680.401c~.s.e.Q., Notices of Intent to Foreclose
and of Defendants' rights under said Act were forwarded to James P. Strahosky and Darlene C.
Strahosky by letters dated February 12, 1997, first class mail, addressed to James P. Strahosky
at 206 Locust Street, Camp Hill, Pa. 17011, and Darlene C. Strahosky at 103 S. Baltimore Street,
Apartment A, P.O. Box 177, Franklintown, PA 17323. Copies of the aforesaid Notices are
attached hereto and marked Exhibits "D" and "E". Copies of the mailing receipts, postal fonns
3817, evidencing the mailing of said Notices are attached hereto and marked Exhibit "F".
Defendants received delivery of said Notices on February 15, 1997. See 35 P.S. ~ 1680.404c(e).
Mellon believes, and therefore avers, that Defendants have not applied for assistance under the
Act.
13, Pursuant to the Act of January 30, 1974, P.L. 13, No, 6,41 P.S. ~101 ~.s.e.Q., and
in particular ~403 thereof, Mellon gave written notice to Defendants of its intent to foreclose by
letters dated February 12, 1997, addressed to James P. Strahosky at 206 Locust Street, Camp Hill,
PA, 17011 and Darlene C. Strahosky at 103 S. Baltimore Street, Apartment A, P.O. Box 177,
Franklintown, PA 17323, certified mail. return receipt requested Nos. P 487 144 153 and P 487
144 154 respectively. Copies of said notices are attached hereto, made a part hereof and marked
Exhibits "a" and "H".
14. Defendant, James P. Strahosky received delivery of the aforesaid notice on
February 19, 1997 as evidenced by the signed certified mail receipt attached hereto, made a part
hereof and marked Exhibit "I".
15. Defendant, Darlene C. Strahosky, did not claim delivery of the aforesaid Notice
despite the postal authorities allempted deliveries as evidenced by the Domestic Return Receipt
(after mailing) PS Form 38Il-A, a copy of which is attached hereto. made a part hereof, and
marked Exhibit "J".
16. Plaintiff then forwarded said Notice set forth herein as Exhibit "K" to Defendant,
Darlene C. Strahosky, by first class mail, certificate of mailing, to her last known address in an
envelope bearing the return address of counsel for Plaintiff. To date said Notice forwarded in this
manner has not been returned as undeliverable or otherwise. A copy of the mailing receipt, postal
forms 3817, evidencing the mailing of said Notice is attached hereto and marked Exhibit "L".
17. As set forth above, Mellon has made repeated demands upon James P. Strahosky
and Darlene C. Strahosky, Defendants herein, to cure the default under the aforesaid mortgage
and promissory note, however, Defendants have refused and failed and continue to refuse and to
fail to cure this default.
