ANSWER
1. The averments contained in paragraph 1 of the
Complaint are denied and on the contrary, it is averred that the
Plaintiff, on July 12, 1995, entered into a Purchase Agreement
for the purchase of seven (7) windows. A copy of that Agreement
is attached hereto, made a part hereof and marked Exhibit "A".
2. It is further alleged that on August 24, 1992, a
Grace Mickey entered into an Agreement concerning seven (7)
windows and a copy of that Agreement is attached hereto, made a
part hereof and marked Exhibit "B".
3. It is denied that the windows will not now lock
and it is denied that there presently exists bows in the sachs.
4. It is admitted that a window was broken although
it is not known when the window was broken. However, the broken
window has been replaced by Defendant.
5. It is admitted that the Plaintiff filed suit
against the Defendant before District Justice Charles A. Clement,
Jr. and it is admitted that a Judgment was entered against the
Defendant on May 1S, 1997.

6. The averments contained in paragraph 4 are denied and
specifically the Defendant denies that he called the District
Justice in question. On the contrary Defendant alleges that all
of the windows in question have been repaired.
7. The averments contained in paragraph S are
exclusively within the knowledge of the Plaintiff and hence they
are denied and proof is demanded at trial.
8. The averments contained in paragraph 6 are denied
as stated although it is admitted that a Judgment was entered
against the Defendant and in favor of the Plaintiff in the amount
of $3,318.S0. It is admitted that a second Hearing took place
and it is admitted that the Defendant did not attend that
Hearing. Additionally, the Defendant avers that he did not
receive notice of that Hearing.
9. The Defendant is at a loss to understand the
averments contained in paragraph 7; the Defendant never heard of
Keystone Windows System and does not know whether they are in
business or out of business. The Defendant, on both of these
situations, sold and caused to be installed Cavco Energy Saver
windows and it is further alleged that Defendant repaired or
caused to be repaired all windows in question.
WHEREFORE, Defendant requests judgment in his favor.

Enclosed is a copy of my Certificate of Service concerning the above-captioned
matter. The next step in the proceeding is for Mr. Soloninka to follow the rules of court
in Cumberland County and eventually list the case for trial before a board of arbitrators.
I am not certain that he knows how to do this and I do not think there is any point in
either you or me telling him.
If he contacts you it very well may be that perhaps you and he can settle the
matter. This is really a small matter to litigate although, of course, if that is what he
wants to do, that of course is what we will do.
In the interim, I am sending my statement for services to-date. It is very difficult
to estimate where this case may go from here; certainly if the case is eventually tried
before a board of arbitratqrs we will need' additional fees. probably in the vicinity of
$750.00. I give this information to you now so that you know that while the matter is not
all that excessive, the professional time involved to represent you properly can easily be
considerable.

You will note Mr. Soloninka has listed the mailer for a hearing before a Board of
Arbitrators and that the hearing is scheduled for March 9, 1998. If you want me to
represent you in this mailer I will appreciate It if you will telephone my office for an
appointment in order that we'may discuss it. It appears as if Mr. Soloninka is proceeding
without counsel although that may change some time in the future and you will note the
