STIPULATION AGAlNS'l: LIENS
nITS AGREEMENT, made this day of June, 1997 by and between H.
W. NAUMAN & SON, INC., T/A NAUMAJ.\f CONSTRUCTION, a Pennsylvania
corporation of 351 Sprecher Rond, Lancaster, Pennsylvania 17603, (hereinafter referred to
IU CONTRACTOR), and HAMPDEN CENTER, INC., 444 Park Avenue South, New
York, NY l0016(hcrcinafter referred to as OWNER);
WHEREBY, the Contr:lctor has agreed to complete Trak Auto building addition
located at Hampden Center, Hampden Township, Pennsylvania, providing all the marerials
and labor, for the Owner, upon the following lot or lr.1ct of land. of the Owner.
NOW THIS INDENTURE WITNESSETH, that it is hereby covenanted and agreed
by and between the parties hereto that the Contractor shall not file nor will the Contractor
pennit nor suffer any subconlr.1ctor, materialman, mechanical or other person or persons
under the Contractor employed by the Contractor to file any mechanics, or other lien or
liens, claim or claims fot' work done and marcrials furnished, or either of them in or under
the performance of the said agreement betweclL the parties for the constrUction of the said
improvc:mcnrs, against the ground or premises UpOIL which the Contractor is about to
construct the said improvements or against' any structure or property whatsoever covered by
the said agreement between the parties hereto.
AND THE CONTRACTOR hereby cenifies, covenants and agrees that no materials
have been furnished, nor has any labot' been. performed, nor have any building operations
been started, under- the said agreement between the. panies hereto.
IN WITNESS WHEREOF, these presents have been executed under seal the day and
