THIS AGREEMENT made the C(j-D1 day of June, 1997, by and between LANCASTER DAIRY FARM AUTOMATION, of 50 East 28th Division Highway, Utitz, Lancaster County, Pennsylvania 17543, hereinafter referred to as Contractor, and FRED W. WIDDERS and JANICE E. WIDDERS, husband and wife; and DAVID & FRED WIDDERS PARTNERSHIP, of 702 Pine Road, Carlisle, Cumberland County, Pennsylvania 17013, hereinafter referred to as Owner, whereby the former undertakes and agrees to ere-:t and install milking equipment on: ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County, Pennsylvania, and more particularly bounded and described as follows: TRACT NO_ 1: BEGINNING at a railroad marker in the Northern right-of-way line of the Reading Company; thence along lands now or formerly of Louis Easter Estate, North 22 degrees 45 minutes East 694 feet, more or less, to a White Oak tree on the Northern side of a public road; thence along the Northern side of said public road and lands now or formerly of Bashore, South 74 degrees 00 minutes East 379,5 feet, more or less, to a point; thence still along said road and lands now or formerly of Bashore, South 86 degrees 30 minutes East 391 feet, more or less, to a point; thence along lands now or formerly of Mrs, Bessie Peffer, North 3 degrees 30 minutes East 642 feet, more or less, to a stone; thence by lands now or formerly of George Harman, North 54 degrees 30 minutes East 1,026.5 feet, more or less, to a stone; thence along lands now or formerly of Barnitz Estate, South 39 degrees 00 minutes East 765,5 feet to a stone; thence along lands now or formerly of Walter Bear, South 12 minutes 45 minutes West 371.5 feet, more or less, to a point in the Southern side of the public road leading to Mt, Holly Springs; thence along the Southern side of said last-mentioned public road and along lands of Adam C, McGonigal, South 73 degrees 15 minutes West 250 feet to a point; thence by lands now or formerly of McGonigal, South 16 degrees 45 minutes East 32 feet to a point in the Northern right-of-way line of said Reading Company; thence along the Northern right-of-way line of said Reading Company, South 74 degrees 25 minutes West 1992 feet, more or less, to a rail monument; thence still along said Northern right-of-way line by an arc curving to the left, with I a radius of 2814,95 feet. a distance of 237 feet to a point. a railroad marker, the Place of , BEGINNING, I! !i " TRACT NO.2: II , :i BEGINNING at a railroad marker in the Southern right-of-way line of the Reading II Company; thence by said Southern right-of-way line the following courses and distances: North I; 74 degrees 25 minutes East 1030 feet. more or less, to a rail marker; North 75 degrees 50 I minutes East 400.1 feet, more or less, to a rail marker; North 74 degrees 25 minutes East 1159 I c:\wp!;l \wpdat.I,oge,\wlddets\ltlpd.lry feet, more or less, to a rail marker; thence along lands now or formerly of the Barnitz Estate the following courses and distances: South 23 degrees 30 minutes East 51.5 feet, more or less, to a stone; South 18 degrees 15 minutes West 828.5 feet, more or less, to a Black Oak; South 18 degrees 00 minutes West 1901 feet, more or less, to a stone; thence along lands now or formerly of John McCoy, North 72 degrees 15 minutes West 2221,5 feet, more or less, to a stone; thence along lands now or formerly of Earl McCoy the following courses and distances: North 22 degrees 45 minutes East 766 feet, more or less, to a point; South 88 degrees 00 minutes East 222 feet, more or less, to a Maple tree: North 8 degrees 45 minutes East 248.5 feet to a point in tho center of the Pine Road; thence along the center of said Pine Road, South 65 degrees 30 minutes West 191,8 feet, more or less, to a point; thence still along lands now or formerly of Earl McCoy, North 22 degrees 45 minutes East 262,5 feet, more or less, to a Railroad marker, the Place of BEGINNING, LESS. HOWEVER. the following three (3) parcels of land: PARCEL A: Parcel of land conveyed by George J, Widders and Edna M, Widders, husband and wife. to William M, Kurtz and Ella Grace Kurtz, husband and wife, by their Deed dated October 3. 1951, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, in Deed Book "V", Volume 14, Page 69, PARCEL B: Parcel of land conveyed by George J, Widders and Edna M, Widders, husband and wife, to The School District of the Township of Dickinson, by their Deed dated July 91, 954, and recorded in the Office aforesaid, in Deed Book "W", Volume 15, Page 277, PARCEL C: Parcel of land retained by George J. Widders and Edna M, Widders, husband and wife, being Lot No, 2 on their Subdivision Plan recorded in the Office aforesaid, in Plan Book 44, Page 19, BEING the same property which George J, Widders and Edna M. Widders, husband and wife, by their Deed dated September 20, 1983. and recorded in the Office aforesaid, in Deed Book "J", Volume 30, Page 630. granted and conveyed unto Fred W, Widders and Janice E, Widders, husband and wife, II I \1 II [I NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One and 00/100 ($1.00) Dollar to him in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid. for themselves and their subcontractors. and all parties acting through or under them, covenant and agree that no mechanic's liens or claims thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for. towards. in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor. for themselves. their subcontractors and others under them hereby expressly waive and relinquish the right to have, file and maintain any 1 c:\wp5 1 \wpd.t.\rDglu\wldde'I\11Ipd.iry COMMONWEALTH OF PENNSYLVANIA COUNTY OF CUMBERLAND : ss. ) On this. the q Ht day of June, 1997. before me, the undersigned officer. personally appeared FRED W.
