Moyer, Jr resides at 4950 A Carlisle Road, Dover, PA 17315. 2. Defendant, James King, Sr. resides at 2258 Ritner Highway, Shippensburg, PA 17257. 3. Donald K. Moyer, Jr. owns a truck which he leases to a company called Roadway Package Systems in order for Roadway Package Systems (RPSl to fulfill its obligations with its customers. 4. Several days prior to October IS, 1996, James King, Sr, asked Donald Moyer if James King Sr. could drive the truck owned by Donald K. Moyer Jr. for RPS, 5. Donald K. Moyer, Jr. Agreed to allow James King, Sr. to make a run on October 25, 1996, 6. On October 25, 1996, James King Sr. while driving the truck owned by Donald K. Moyer Jr, was involv9d in a motor vehicle accident. 7. The accident was one which the Risk Management department at RPS determined to be the fault of James King, Sr. 8. Because RPS determined the aforesaid accident to be the fault of James King, Sr., RPS pursuant to its contract with Donald K. Moyer Jr. demanded that Donald K. Moyer Jr. pay to RPS the first $1,000.00 tha t RPS had to pay the driver of the vehicle which James King, Sr. collided with. 9. Donald K. A contract cannot impose any contractual obligation on one who is not a party to the contract. Wolff v. Wilson, 1905, 28 Pa.Super. 511. 10. Recovery for purely economic loss occasioned by tortious interference with contract or economic advantage is not available under a negligence theory. Aikens v. Baltimore and Ohio R. Co., 501 A.2d 277 (pa. Super. 1985) 11. Defendant is not liable to Plaintiff for negli- gently making Plaintiff's contract with RPS more expensive or burdensome. Restatement (Second) of Torts Sec. 766C 12. The damages sought by Plaintiff relate to economic injuries and are not recoverable as a matter of law against the Defendant. WHEREFORE, it is respectfully requested that this Honorable Court dismiss Plaintiff's Complaint for failure to set forth a cause of action upon which relief can be granted. PRELIMINARY OBJECTIONS IN THE NATURE OF A MOTION TO STRIKE PURSUANT TO Pa.R.C.P. 1028(a){2) 13. In paragraphs 8 and 9 of the complaint, Plaintiff alleges that he had to pay to RPS the sum of $1000 pursuant to his contract with RPS. 14. Plaintiff's complaint avers that RPS paid the sum of $2,222.28 to a third party as a result of the accident and that Plaintiff reimbursed to RPS $1,000 of the aforesaid $2,222.28 which was the deductible. 8. Plaintiff's complaint demands judgment against Defendant for the entire $2,222.28. 9. As a general rule, an action on a contract cannot be maintained against a person who is not a party to it. 8 P.L.E. Contracts, Sections 201, 384, pages 247, 445. 10. A contract cannot impose any contractual obligation on one who is not a party to the contract. Wolff v. Wilson, 1905, 28 Pa.Super. 511. 11. In paragraph 8 of Plaintiff's Amended Complaint, Plaintiff alleges that he was insured by RPS, Inc. 15. Plaintiff's Amended Complaint, paragraphs 3 and 4 allege that Plaintiff leases the truck to RPS and that Plaintiff agreed to allow Defendant to drive the truck for RPS. 16. Plaintiff's complaint indicates that Defendant was authorized by Plaintiff to drive the truck leased by RPS. 17. Defendant, as an authorized agent for Plaintiff, was an insured while driving the truck on October 25, 1996 for RPS. 18. RPS has no right of subrogation against Defendant for the $2,222.28 paid to a third party as a result of the accident. 19. Plaintiff fails to plead material facts regarding Defendant's obligation or duty to pay the $1000 deductible or any part of the $2,222.28 that RPS, Inc. paid on behalf of its insured. WHEREFORE, it is respectfully requested that this Honorable Court dismiss Plaintiff's Complaint for failure to set forth a cause of action upon which relief can be granted.
