ANSWER WITH NEW MATTER TO PLAINTIFFS' COMPLAINT AND NOW, comes Defendants, Dennis Shockley and Stevenson Transportation Service (properly known as Burlin9ton Motor Carriers), by and through their attorneys, Marshall, Dennehey, Warner, Coleman & Goggin, demanding relief a9ainut the Plaintiffs, in answering Plaintiffs' Complaint as follows: l. It is denied that Defendant Dennis Shockley struck Plaintiff Mitchell Panzer's vehicle suddenly and without warning in the rear, and it is denied that Dennis Shockley caused extensive property damage. To the contrary, the accident underlying Plaintiffs' Complaint was the result of Plaintiff Mitchell Panzer's negligence. 7. Admitted in part and denied in part. It is admitted that Defendant Dennis Shockley was operating a 1991 Kenworth truck trailer vehicle at the time of the accident. It is specifically denied that Dennis Shockley struck Plaintiff Mitchell Panzer's vehicle. 8. Denied. It is denied that ~ennis Shockley was negligent. To the contrary, Plaintiff Mitchell Panzer was negligent in causing this accident. 9. (a) - (f). Denied. It is denied that Defendant Dennis Shockley was negligent in any manner as it relates to the accident which underlies Plaintiffs' Complaint. To the contrary, this accident was caused by the negligence of Plaintiff Mitchell Panzer. 10. Denied. It is denied that this accident was caused by Defendant's negligence. To the contrary, this accident was caused by plaintiff Mitchell Panzer's negligence and was -2- directly attributable to acts and/or omissions on the part of Plaintiff Mitchell Panzer. 11. Answering Defendant lacks knowledge sufficient to form a belief as to the truth of the allegations of Paragraph 12 and therefore, the same are denied, strict proof required at trial. 13. Denied. Plaintiffs' claims are barred by the applicable statute of limitations. 15. Plaintiffs have failed to state a cause of action upon which relief can be granted. 16. Plaintiffs are barred and/or limited by all applicable provisions of the Pennsylvania Motor Vehicle Financial Responsibility Law. 17. No act or omission on the part of Defendants was a substantial or contributing factor in bringing about Plaintiff's -3- alleged injuries and/or damages, all such injuries and/or damages being expressly denied. 18. Any and all injuries and/or damages as described by Plaintiffs in their Complaint, the same being expressly denied, were caused in whole or in part, by the acts or omissions on the part of Plaintiffs and/or others over whom Defendants had no control nor right of control. 19. Plaintiffs' claims are barred and/or limited by the doctrine of res judicata and/or collateral estoppel. 20. Plaintiffs' claims are derivative in nature, and are barred as a matter of law. 21. Defendants breached no duty of care owed to Plaintiffs under the circumstances. 22. Plaintiffs' claims are barred and/or limited by the Pennsylvania Comparative Negligence Act. 23. Plaintiffs' claims are barred and/or limited by the applicable provisions of the Pennsylvania Worker's Compensation Act. 24. At all times material hereto. Defendants acted in a safe, legal and non-negligent manner. 25. Plaintiff's negligent operation of his motor vehicle was the sole and proximate cause of all alleged injuries and damages. As the result of the policy of insurance between The Hartford and Mitchell E. Panzer Plaintiff, The Hartford Insurance Company paid Mitchell E. Panzer $6.397.94 (said figure includes his collision deductible), as fair and reasonable reimbursement for the damages incurred. 13. Pursuant to the policy of insurance between The Hartford and Mitchell E. Panzer, The Hartford has subrogated to Mitchell E. Panzer for this loss.
