and respectfully avers
1. Paul C. Levy, Plaintiff, is an adult individual that
I resides at 419 Shelly's Lane, Etters, Cumberland County,
I Pennsylvania, 17319.
Ii 2. Defendant is an adult individual doing business as

Leininger's Automotive Specialist at 6384 Brandy lane,
Mechanicsburg, Cumberland County, Pennsylvania, 17055.

On November 29, 1996, Plaintiff delivered his 1987 Ford
I
:Bronco II to Defendant's business address in Mechanicsburg,

iPennsylvania and the parties reached an agreement of $2,300.00 to
I
irepair Plaintiff's vehicle.
4. plaintiff alleges agreed upon repairs consisted of: (1)
rebuilding the engine, and (2) rebuilding the transmission.
5. Defendant's invoice includes an eighteen month I 20,000
mile warranty. See Exhibit "A".
6. Plaintiff alleges the parties agreed the repairs would be
completed by December 5, 1996.

7. Upon returning, Plaintiff was informed by Defendant that
the cost would be $300.00 more than the previously agreed amount of
$2,300.00.
8. Plaintiff pre-paid a total of $2,756.00 ($2,000.00 Visa,
$756.00 Personal Check) on December 1, 1996. See Exhibit "A".
9. Defendant completed repairs on December 13, 1996.
10. On December 15, 1996, Plaintiff discovered transmission
leak.
11. After waiting over two weeks, Plaintiff picked up vehicle
on January 2, 1997, but transfer case seal was not completed.
12. On January 4, 1997, Plaintiff discovered the hood of his
1987 Ford Bronco II was welded on by Defendant.
13. On January 23, 1997, Plaintiff picked up vehicle and
discovered the transfer case was incorrectly replaced, for it did
not fit.
14. On January 26, 1997, Plaintiff discovered wire harness
component was not connected by Defendant.
15. plaintiff alleges that on March 13, 1997, vehicle's
transmission failed in Albany, New York.
16. Plaintiff alleges he was forced to incur car rental
expenses in the amount of $153.60. See Exhibit "B".
17. Plaintiff alleges he was informed by a Ford Dealership in
New York, on March 17, 1997, that incorrect bell housing bolts were
used by Defendant, the front seal was done incorrectly, and the OlD
was completely out.
27. The following problems remain with Plaintiff's vehicle
due to Defendant's breach of contract: (1) the transmission does
not shift properly, (2) valve cover leak, (3) transmission leak,
(4) valve tap, and (5) transfer case leak.
28. Plaintiff has been required to have the vehicle's
transmission repaired at cost of $1,500.00.
WHEREFORE, Plaintiff respectfully requests this Honorable
Court to grant the relief requested for Defendant's Breach of
Contract in the amount of Four Thousand Seven Hundred Dollars
($4,700.00) for the loss of use of his 19B7 Ford Bronco II, costs
for repairs from outside mechanics including $1,500.00 to repair
transmission, car rental, plus attorney's fees, court costs
including filing fee with District Justice and any other relief
this Court deems appropriate.
COUNT II - BREACH OF IMPLIED WARRANTY
29. Paragraphs 1 through 28 are incorporated herein by
reference as if fully set forth.
30. Defendant did not perform his obligation, for the work
did not meet the standard of being fit for Plaintiff's use.
31. The following problems remain with Plaintiff's vehicle
due to Defendant's breach of contract: (1) the transmission does
not shift properly, (2) valve cover leak, (3) transmission leak,
'(4) valve tap, and (5) transfer case leak.
WHEREFORE, Plaintiff respectfully requests this Honorable
Court to grant the relief requested for Defendant's Breach of
