COMPLAINT
1. Plaintiff, Julie E, Haring, is an adult individual residing at 7
Wheatfield Drive, Carlisle, Cumberland County, Pennsylvania, 17013,
2, Defendant, Kathy A. Dorbert, is an adult individual residing at
R.D,#3, Box 62 AA, Newport, Perry County, Pennsylvania, 17074,
3. On or about July 19, 1995, at approximately 5:30 p,m" Julie E, Haring
was traveling northbound on Locust Point Road and was suddenly and without
warning struck by an oncoming car,
4. As Plaintiffs car was traveling northbound on Locust Point Road
approaching the intersection of Locust Point Road and Ridge Hill Road, a car driven
by the Defendant on Ridge Hill Road failed to stop at a stop sign, proceeded into the
intersection and was struck by a car traveling southbound on Locust Point Road,
The car which was traveling southbound on Locust Point Road after striking the
Defendant's car veered into Plaintiffs lane of travel and struck Plaintiffs car head-
on,
5, Both the car that was driving southbound on Locust Point Road and
the car being driven by Julie E. Haring had the right-of-way at the intersection of
Locust Point Road and Ridge Hill Road.
6, The collision involving these three cars was the result of negligence on
the part of the Defendant, Kathy A. Dorbert,
7. The Defendant owed a duty of care to the Plaintiff to operate her
vehicle in a reasonable and safe manner and free from negligence,
8, Defendant breached this duty of care by committing the acts of
negligence more fully described in this Complaint,
9, The accident resulted solely from Defendant's negligence and
recklessness as more fully described herein, and was not caused by any act or
failure to act on the part of the Plaintiff.
10. This accident was due to Defendant's negligence in that:
(a) She failed to properly operate and control her vehicle;
(b) She failed to maintain the propel' look. out for other
vehicles;
(c) She violated the laws and the statutes of the
Commonwealth of Pennsylvania and the common law regulating and
governing the operation of motor vehicles on the streets and highways
including, but not limited to. Title 75 ~3323(b),
(d) She failed to have her motor vehicle under proper and
adequate control given the circumstances;
(e) She operated her vehicle in a reckless and careless
manner under the circumstances then present;
(f) She breached her duty of care to Plaintiff to operate her
vehicle in a safe manner; and
(g) She operated her vehicle without regard for the right,
safety and position of Plaintiff,
11. As a direct and proximate result of the foregoing acts of negligence and
recklessness on the part of the Defendant, Plaintiff was injured,
12. The injuries suffered by the Plaintiff as the direct and proximate
result of the Defendant's negligence and recklessness consisted of severe headaches,
cervical strain and sprain and injuries to the Plaintiffs shoulders and cervical
spme,
13, Plaintiff suffered from these injuries which had a significant impact on
her ability to engage in her normal activities and required medical treatment for
these injuries for a period in excess of one (1) year,
WHEREFORE, Plaintiff prays for judgment against the Defendant in an
amount not to exceed $25,000,00 plus interests and costs as the law may allow.

was heading South. Car didn't stop at stop sign, truck heading South, hit car and
then the truck hit me head on."

woozy" .
3, Objective Findings (Examination) Restricted cervical range of motion, muscle
pain, muscle pulling on rotation, neck and shoulder pain on palpation.
4, X-ray Analysis Summary No fractures or disclocations, reversed cervical curve.
5. Diagnosis 847.0 Cervical Sprain/Strain, 724.1, Pain in the Thoracic Spine.
6. Alternate Summary (Comments) It is in my opinion, based upon the description
of the accident, the immediate onset of symptoms, my examination and xray findinqs,
and my experience in similar cases, that this accident was the cause of the injury.
