STIPULATION AGAINST LIENS
THIS AGREEMENT made the 17th day of June, 1997, by and
between RONALD L. SNYDER, HOMES BY KEYSTONE, hereinafter referred
to as Contractor, and TIMOTHY W. BIGLER and PATTI J. BIGLER,
hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a custom built home on that
certain lot of ground situate at 43 Peach Orchard Road, Newville,
Cumberland County, Pennsylvania, more fully described in Exhibit
"A" attached hereto and made a part heraof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for
and in consideration of the sum of ($1.00) Dollar to Contractor
in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and

others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

EXHIBIT "A"
ALL that certain tract or parcel of land and premises,
situate, lying and being in the Township of Penn, in the County
of Cumberland and Commonwealth of Pennsylvania, more particularly
bounded and described as follows:
BEGINNING at a point on the center line of Township Road T-
344, on the line of land now or formerly of M. Lucille Shughart;
thence along said land now or formerly of M. Lucille Shughart,
South 87 degrees 47 minutes 29 seconds West 516.28 feet to an
iron pin; thence by land now or formerly of David Leroy Harrison,
North 51 degrees 02 minutes 26 seconds East 392.87 feet to a
point; thence by the same, North 59 degrees 02 minutes 20 seconds
East 150 feet to a point; thence by land now or formerly of
Robert W. Kough, et. ux., South 68 degrees 21 minutes 47 seconds
East 150.31 feet to a point in the center line of Township Road
T-344 aforesaid; thence by said center line, South 00 degrees 44
minutes 19 seconds West 39.01 feet to a point; thence by the same
by a curve to the right having a radius of 288.79 feet an arc
distance of 93.12 feet; thence by same, South 19 degrees 12
minutes 48 seconds West 125.54 feet to a point, the Place of
BEGINNING.
BEING described in accordance with a Final Subdivision Plan
for Betty L. Paxton, said Plan being recorded in the Office of
the Recorder of Deeds in and for Cumberland County, Pennsylvania,
in Plan Book 45, Page 48. Said Final Subdivision Plan for Betty
L. Paxton is a resurvey of Lot No.4 of Timber Tracts, Inc., Plan
of Lots as recorded in the office aforesaid in Plan Book 26, page
69; and being a partial resurvey of Lot No.3 of said Timber
Tracts, Inc., Plan of Lots. Said Final Subdivision Plan provided
for a lot addition to Lot No.4, to create the tract which is
described above, and as reference to said Final Subdivision Plan
will disclose.
BEING Lot No. 4A on the aforesaid Subdivision Plan and
containing 2.393 acres (104,405.635 square feet), and being
improved with a mobile home and detached garage.
BEING the same premises which Timothy W. Bigler and Tonia L.
Bigler, husband and wife, by their Deed dated January 26, 1992
and recorded in the Office of the Recorder of Deeds of Cumberland
County in Deed Book "E", Volume 36, Page 626, granted and
conveyed unto Timothy W. Bigler, individual, Grantor herein.
