Whereas, we the Plaintiffs, Chris and Stacy Heckman, are residsnts of Cumberland County 1 Pennsylvania. 2. Defendant Harry Banzhoff is an individual who conducts business at 350 North 25th Street, Cumberland County, Pennsylvania. NOTICE You have been sued in court. If you wish to defend against the claims set forth in the following pages, you must take action within twenty days after this complaint and notice are served, by entering a written appearance personally or by attorney and filing in writing with the court your defenses or objections to the claims set forth against you. You are warned that if you fail to do so the case may proceed without you and a judgement may be entered against you by the court without further notice for any money claimsd in the complaint or for any other claim ir relief requested by the Plaintiff. The Plaintiffs, Chris and Stacy Heckman, are adult individuals residing at 360 N. 67th Street, Harrisburg, Pennsylvania. 2. The Defendant, Harry Banzhoff, III, is an adult individual residing at 350 N. 25th Street, Camp Hill, Pennsylvania. 3. On September 28th, 1995, the Plaintiffs, by written lease agreement with the Defendant, leased the residential premises at 731 State Street, Lemoyne, Pennsylvania for a stated term of one year at a rental of $495.00 per month, payable on the eighth day of each month. Plaintiffs were also required to pay a security deposit in the amount of $495.00. A copy of the lease is attached as Exhibit "A". 4. The lease provided that the term of the lease would automatically renew on a month to month basis until notice of intention to terminate was given by either party not less than 45 days prior to the expiration of the initial one year term on September 28, 1996. 5. No notice of termination was given by either party prior to expiration of the initial term of the lease on September 2B, 1996, and the Plaintiffs continued possession of the premises. 6. As a result of the foregoing, the Plaintiffs lease of the premises was extended. Notice of intention to terminate was given, December, 1996. Plaintiffs vacated the premises on February 22, 1997. 8. Plaintiffs paid rent due on February 8, 1997, but to date have failed to receive the Security Deposit due from September 28, 1995. 7. The 9. The sum of $495.00 is still due and unpaid. the Defendant despite repeated demands, has failed and refused to pay the same, or any part thereof. WHEREFORE, the Plaintiffs demand judgement against the Defendant for $495.00, with interest from March 22, 1997 and costs. The parties hereto, intending to be legally bound, hereby agree as follows: Landlord here by leases to Tenant, and Tenant hereby accepts as tenant, the house known as 731 State Street, Cumberland County, Pennsylv~nia (hereicafter referred to a "leases premises") I on the following terms and conditio~s: 1. TER!~ A."'i:l ::'E!\El';AL: T:;e term shall commence on the 1st day of October 1, 1995 and shall be for a one year on the last day on September 30, 1996, (un~ess sooner terminated under the provisions hereof) or renewed or extended as hereinafter provided. Either the Landlord or the Tenant may terminate this Lease Agreement at the end of the primary term, or any renewal term, by giving to the other party not less than forty five (45) days written notice prior to the termination date. If no such written notification shall be given by either party, then the term of this Lease Agreement shall be automatically re~ewed upon the same terms and conditions for another month and ~o of from month to month. 2. RENT: Tenant stall pay the Landlord as rent for the leased premises for the primary term therecf the total sum of Five Thousand Nine Hundred Forty Dollars, 1$5,940.00), payable in advance without prior demand in equal monthly installments of Four Hundred Ninty Five Dollars, ($495.00), of the first day of each month during the term hereof. All rents above set forth are to be paid to the Landlord at the above address or at such other place as Landlord may designate from time to time by written notice to the Tenant. Checks shall be made payable to Harry G. 3anzhoff, III. 3. LATE CP~GES: Tenant further agrees to pay a late payment charge of five (5%) percent per month if the amount of rent in default on the lOth day of each month. If rental is mailed , the post mark date shall determine the date of payment, If any check for rent is returned to the Landlord for insufficient funds or other reason late charge will continue until the rent is actually paid by Tenant. 4, UTILITIES AND SERVICES: No utilities or services will be provided by the landlord. 5. USE OF PREMISES: Tenant agrees to use these premises only as a personal residence and for not other purposes by not more than 2 persons, consisting of tenant and such other persons as designated on Tenant's rental application. Tenant shall not use the leases premises for any disorderly or immoral purpose nor commit any waste therein or permit any nuisance in or about the leased premises, also Tenant shall not do or suffer anything to be done in or about the leases premises which will violate any laws or increase the rate of fire or other insurance or jeopardize coverage of the same. 6. SECVRITY DEPOSIT (A) N~OUNT: Landlord and shall Hundred Ninty Five payment of damages Tenant shall upon the execution hereof, pay to keep on deposit with Landlord the sum of Four Dollars ($495.00), as security deposit for the to the leased premises or default in rent. (B) Application: If there shall be damages to the leased premises for which Tenant is responsible, or default in rent, Landlord may apply or retain the whcle or any part of the security deposit to the extent required to reimburse the Landlord for the said damages to the leased premises and\or default in rent. However, Landlord shall not be limited to or required to so apply or retain the whole or any portion of said security deposit, but on the contrary, may look to the Tenant directly and independently for reimbursement for any damages by Tenant or for payment of delinquent rentals. 7. LANDLORD'S LIABILITY: Tenant agrees that Landlord shall not be liable for any property damage or personal injury occurring on or in the premises or elsewhere on Landlords property unless the damage or injury results from Landlord's negligence. 8. MISREPRESENTATION IN APPLICATION: Any material misrepresentation in Tenant's application for the leased premises, whether intentional or otherwise, may be treated by Landlord, at his sole option, as an act of default hereunder and all remedies . , . available to Landlord in the event of authoritatively shall likewise be available to Landlord in such case. 9.
