Defendant Plaintiff is Steven B. Carson, an adult individual who Deerfield Avenue, Mechanicsburg, Pennsylvania is A & M Industrial Supply Co., Inc., a corporation organized and existing under the laws of the State of New Jersey, and having offices at 1414 Campbell Street, Rahway, New Jersey 07065. 3. On or about October 30, 2000, Plaintiff became employed by Defendant as a sales representative. 4. Defendant verbally agreed to pay Plaintiff an annual salary of $65,000.00 and a quarterly bonus of $2,000.00. Said verbal agreement was memorialized in a document prepared by Defendant, entitled "Acknowledgment of Employment,,, dated October 30, 2000, a copy of which is attached hereto, made a part hereof, and marked Exhibit "A". 5. On or about May 28, 2002, Defendant terminated Plaintiff,s employment. 6. At the time Plaintiff's employment was terminated, Defendant owed Plaintiff the sum of $7,275.00, representing the quarterly bonus of $2,000.00 for the time commencing July 1, 2001, and ending May 28, 2002. 7. Plaintiff has demanded payment of the aforesaid wages from Defendant, but Defendant has failed and refused to pay Plaintiff. 8. The quarterly bonuses constitute wages under the Pennsylvania Wage Payment and Collection Law, 43 Pa. C.S. 260.1, et seq. (the "Law"), and the action of Defendant constitutes a violation of the Law. 9. Plaintiff demands judgraent against Defendant for unpaid wages in the amount of $7,275.00, liquidated damages under Section 260.10 of the Law, attorneys fees under Section 260.ga(f) of the Law, interest and costs. WHEREFORE, Plaintiff respectfully requests judgment in his favor and against Defendant in the amount of $7,275.00, liquidated damages, attorneys fees, costs and interest, which sums, in the aggregate, do not exceed the jurisdictional amount requiring compulsory arbitration.
