1. Plaintiff, MIDFIRST BANK, is a Corporation having an office at
P. O. Box 26648, Oklahoma City, Oklahoma, 73126.
2. Defendants, PAUL E. GUTSHALL, JR. and SHERYL L. GUTSHALL, are
adult individuals whose last known address is 348 Hilltop Road,
Newburg, PA 17240.
3. On or about March 17, 1989, the said Defendants executed and
delivered a Mortgage Note in the sum of $54.495.00 payable to
Commonwealth Mortgage Company of America, L.P., which Note is
attached hereto and marked Exhibit "A".
4. Contemporaneously with the execution of the aforesaid Mortgage
Note, in order to secure payment of the same, Defendants made,
executed and delivered to original Mortgagee, a certain real estate
Mortgage which is recorded in the Recorder of Deeds Office of the
within County and Commonwealth in Mortgage Book 933, Page 215
conveying to original Mortgagee the subject premises. The Mortgage
was assigned to Fleet Mortgage Corp. and recorded as aforesaid in
Book 366, page 48 on June 30, 1989. The Mortgage was assigned to
MIDFIRST BANK and will be sent for recording. The Mortgage and
Assignments are incorporated herein by reference.
5. The land subje=t to the Mortgage is: RD #1, Box 348, Newburg,
Pennsylvania 17240 and is more particularly described in Exhibit "B"
attached hereto.

Administration under Title II of the National Housing Act (12

Assistance Act of 1983).
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure
against Defendants for the aforementioned total amount due together
with interest at the rate of 11.0% ($15.57 per diem), together with
other charges and costs including escrow advances incidental thereto
to the date of Sheriff's Sale and for foreclosure and sale of the
property within described.

1. Plaintiff, MIDFIRST SANK, is a Corporation having an office at
P. O. Sox 26648, Oklahoma City, Oklahoma, 73126.
2. Defendants, PAUL E. GUTSHALL, JR. and SHERYL L. GUTSHALL, are
adult individuals whose last known address is 348 Hilltop Road,
Newburg, PA 17240.
3. On or about March 17, 1989, the said Defendants executed and
delivered a Mortgage Note in the sum of $54,495.00 payable to
Commonwealth Mortgage Company of America, L.P., which Note is
attached hereto and marked Exhibit "A".
4. Contemporaneously with the execution of the aforesaid Mortgage
Note, in order to secure payment of the same, Defendants made,
executed and delivered to original Mortgagee, a certain real estate
Mortgage which is recorded in the Recorder of Deeds Office of the
within County and Commonwealth in Mortgage Sook 933, Page 215
conveying to original Mortgagee the subject premises. The Mortgage
was assigned to Fleet Mortgage Corp. and recorded as aforesaid in
Sook 366, page 48 on June 30, 1989. The Mortgage was assigned to
MIDFIRST SANK and will be sent for recording. The Mortgage and
Assignments are incorporated herein by reference.
5. The land subject to the Mortgage is: RD U1, SOX 348, Newburg,
Pennsylvania 17240 and is more particularly described in Exhibit "S"
attached hereto.
6. The said Defendants are the real owners of the land subject to
the Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on November 1, 1996 and all
subsequent installments thereon, and the following amounts are due on
the Mortgage:
(a) Unpaid principal balance
$51,691.15
(b) Interest at $15.57 per day
from 10/1/96 to 7/1197
(based on contract rate of 11.0%)

(c) Late Charges at $24.97 per
month for 8 months

is reinstated prior to the sale, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance pursuant to Pennsylvania Act No. 6 of 1974 is not required in
that the original loan balance exceeds $50,000.00.
