MILLER Defendant CUSTODY- CONTEMPT AND NOW here comes the Defendant/ Petitioner, Stuart D_ Miller, by and through his Attorney, Daniel Pollock, Esq., to file this Petition to find the Plaintiff. Suzanne M. Martin, in contempt of the Order governing custody of the Child, Evan J. Martin, for the reasons spelled out below. CountT Contempt 1. The Order of court dated February 23, 2005 provides in paragraph 2 that each parent shall have shared legal custody and the right to all records concerning Evan's education. 2. Stuart Miller has not been provided with copies of Evan's report cards, dates concerning Evan's activities at school, as well as names of Evan's teachers. 3. Stuart Miller has also been informed that Evan is being home schooled for this Academic Year, and has asked to be kept informed as well as participate in the process of the home schooling which has been denied by the plaintiff. Wherefore Stuart Miller prays that the court find that Ms. Martin is acting in contempt of Paragraph #2 of the Custody order of February 23, 2005. Count II Contempt 4. Paragraphs 1-3 are incorporated by reference as if they had been fully written out. 5. Paragraph #4 of the order of this court dated February 23, ?005 states that the father, Stuart Miller, shall have partial physical custody of the child. As well as reasonable telephone contact with the child. 6. Ms. Martin has refused to cooperate with any Partial physical custody arrangement concerning Stuart Miller and Evan Martin. 7. Ms. Martin has interfered with Stuart Miller's attempts to speak with Evan Martin on the telephone by complaining of harassment. 8. Ms. Martin refuses to help provide transportation of Evan so that Stuart Miller may spend Quality time with him. Wherefore Mr. Miller Prays that Ms. Martin is found in contempt of paragraph 4. Of the February 23, 2005 order of this court. Count III Contempt Paragraphs 1-8 are incorporated by reference. 10. Paragraph 6 of the order of February 23, 2005 states that neither party may do or say anything which may estrange the child from the other parent. 11. Suzanne Martin's actions of refusing Stuart Miller of participating in Evan's Schooling and failing to cooperate with an appropriate partial custody schedule for Stuart to be able to spend quality time with Evan, including time on the telephone is done by design to estrange Evan from his Father, Stuart Miller. Wherefore Mc Miller Prays that Suzanne Miller is found in contempt of Paragraph 6 of the Custody order of February 23, 2005. Corrective measures requested 12. Paragraphs 1-11 are incorporated by reference ] 3. Stuart Miller prays for the full force of this court to guarantee his partial custody rights by ordering corrective measures to be followed by Suzanne Martin 14. At this time Stuart Miller's Driving Privileges are suspended, Mr. Miller requests that this Court order Suzanne Martin to Provide transportation of Evan to and from Mr. Miller's residence in Middletown Pa. every other weekend in accordance with the prior order of this court dated April 17, 2000. 15. Mr. Miller also requests that Ms. Martin be ordered to allow his telephone contact with Evan without interference or threats for whatever the court decides is a reasonable amount of contact at appropriate times. 16. Mr. Miller requests that if he calls when Evan is unavailable that Evan be given the opportunity to call Mr. Miller at Evan's earliest convenience. 17. Mr. Miller requests that he receive copies of all schedtiles of any and all activities in which Lvan participates no later then 1 week prior to the scheduled event, as well as the name of the adult(s) in charge of the activity. 18. Mr. Miller requests access to any and all school related records, be they a traditional school setting or home school setting, no less then twice a quarter, or marking period, so that he may monitor the educational progress of Evan. A custody conciliation conference was held on January 24, 2006, with the following individuals in attendance: The Father, Stuart D. Miller, with his counsel, Daniel Pollock, Esquire and the Mother, Suzanne M. Martin, who is not represented by counsel in this matter. 3. This Court previously entered an Order in this matter on February 23, 2005, under which the Mother has primary physical custody of the Child and the Father had partial custody as arranged by agreement. The Order further provided that the parties would cooperate in establishing a partial custody schedule when the Father obtained transportation and accommodations. The Father filed this Petition for Contempt alleging, among other things, that the Mother is not providing information pertaining to the Child as required by the shared legal custody provision and has refused to provide transportation for all exchanges of custody in light of the suspension of the Father's driver's license until December 2006. 4. Although with the assistance of the Father's counsel there were initial encouraging attempts at exploring options which would be acceptable to both parties, it became clear that the animosity between the parties was preventing them from engaging in a meaningful attempt to address the custodial issues. Just as the details of an initial period of partial custody were being established, a snide remazk by one party led to the abrupt departure of the other. Therefore it will be necessary to schedule a hearing in this matter. 5. The Father's position on custody is as follows: The Father alleged that the Mother is uncooperative in providing important information concerning the Child's education and activities and that she is intentionally attempting to estrange the Child from him. The Father seeks to have contact with the Child on a regular basis and believes the Mother should provide transportation until the suspension of his driver's license ends in December 2006. The Father does not believe the Mother is promoting his relationship with the Child as she is required to do as the primary custodian. 6. The Mother's position on custody is as follows: The Mother denied the Father's allegations regazding interference with the father-child relationship. The Mother indicated that the Father does not make attempts to see or talk to the Child on a regular basis. The Mother alleged that the Father has been abusive to her pazents, with whom she and the Child had been living until recently. The Mother indicated that the Child does not want to spend time with the Father. The Mother does not believe it is her responsibility to provide transportation for the Father because he lost his driver's license, particularly as she is disabled and the parties reside approximately 20 miles apart. 7. Stuart Miller has had very limited phone contact with His son Evan, his attempts to speak to Evan are being largely ignored, and although he leaves messages the phone calls are not returned. V. Suzanne Martin has failed to communicate any reason for her willful disregard of the order of August 17, 2006 to Stuart Miller, or to Counsel. 14. Suzanne Martin has failed to contact Stuart Miller concerning any of the missed times of partial custody to attempt to reschedule any of these times 15. Stuart Miller fears that he will miss spending part of Christmas with his son Evan based on Suzanne Martin's past behavior. 16. Stuart Miller has costs in excess of $500 for the pursuit of the custody matter resulting in the order of August 17, 2006 and for the pursuit of this petition for special relief. 17. In spite of pleas from Stuart Miller the Hampden Township Police Department has failed to take any action to require Ms. Martin to deliver Evan as she is supposed to pursuant to this Court Order. Wherefore The Petitioner Prays that this Court will award him all expenses associated with the pursuit of the partial custody and the pursuit of this motion for special relief. An earlier Order was entered on August 17, 2006, also by The Honorable Edgar B. Bayley. The August 2006 Order, in pertinent part, grants the parties shared legal custody of the minor child and sets forth a partial physical custody schedule for Father. The October 12, 2007 Order modifies the partial custody schedule to give Father a four-hour period of time with the minor child on either a Saturday or Sunday each week but does not change the terms of the August 2006 Order granting shared legal custody. (See Attached Orders as Exhibits A and B). 5. Mother has willfully disobeyed the current Order, and is not acting in Evan's best interests in ways including, but not limited to, the following: a. Mother has a history of leaving the area with the minor child without consultation with or agreement from Father, thus interfering with Father's ability to exercise his periods of partial physical custody with Evan. b. Since Mother's return to the area, she has been inconsistent in allowing Father to exercise his weekly periods of partial custody with Evan. c. Mother last allowed Father to see Evan about 2-3 months ago and has since not been cooperative in talking to Father to re-establish his custody schedule. d. Mother ties Father's ability to exercise his periods of partial custody to her ability to get some form of financial support from Father and since Father is no longer under a child-support obligation, Mother does not comply with a custody schedule to allow Father to see Evan. 6. Father is entitled to a modification of the current order, which is in Evan's best interest, for reasons including but not limited to the following: a. Father has sought to maintain a relationship with Evan, despite various situations that have negatively impacted his own life. b. Father has a safe and stable home environment in which to exercise periods of partial physical custody with Evan. c. Father is committed to re-establishing his father/son relationship with Evan and recognizes that with the sporadic history of time with Evan, that re- establishing a relationship may take time and Father is committed to working through those difficulties. d. Father recognizes that at the age of 14, Evan may have extracurricular or school related commitments and Father is willing to work to establish a schedule that accommodates Evan's other commitments as well. 7. Mother has not been represented in prior matters pertaining to this case and Counsel does not have the ability to contact Mother to determine whether she would concur with,the relief requested in this petition. The parties shall make arrangements for the Child to participate in counseling with a professional to be selected by agreement. The purpose of the counseling shall be to assess the Child's readiness to begin working on reestablishing a parent/child relationship with the Father, and if it is determined that the Child is not currently ready, to assist the Child in working toward readiness and eventual reestablishment of contact with the Father. The parties shall follow the recommendations of the counselor with respect to determining the Child's readiness to begin the reunification process and also with regard to initiating contact between the Father and Child. Both parties shall follow the recommendations of the counselor as to each parent's participation in the counseling sessions. 2. The Mother shall provide the list of counselors covered under the Child's medical insurance policy to the Father's counsel by February 25, 2011. The parties shall select the counselor by March 4, 2011 and the Mother shall immediately contact the selected professional's office to schedule the initial session for the Child at the first available appointment. 3. Any costs of the counseling which are not covered by insurance shall be shared equally between the parties. As it is anticipated that the Mother will be transporting the Child to counseling sessions, the Mother shall provide the payment information to the Father and the Father shall pay his one-half share of the cost of the counseling session in advance either directly to the counselor's office or to the Mother. 4. The Mother shall sign any authorizations deemed necessary by the counselor to enable the Father's legal counsel to obtain status information from the counselor, such as the number of sessions held with the Child and whether or not there has been a determination of readiness to begin including the Father in the counseling sessions. 5. This Order is entered pursuant to an agreement of the parties at a custody conciliation conference. The parties may modify the provisions of this Order by mutual consent.
