the custody of the child in this or another court.
7. The plaintiff has no information of a custody proceeding
concerning the child pending in a court of this Commonwealth.
8. The plaintiff does not know of a person not a party to
the proceedings who has physical custody of the child or claims
to have custody or visitation rights with respect to the child.
9. The best interest and permanent welfare of the child
will be served by granting the relief requested because:
a. Mother has provided a stable, loving, nurturing, safe
environment for the child;
b. Mother has been the primary caretaker of the child since
her birth;
c. Father has abused alcohol and drugs in the past and
cannot provide a safe environment for the child.
d. Father does not possess a valid driver'S license and
must rely on others to transport child.
10. Each parent whose parental rights to the child have not
been terminated and the person who has physical custody of the
child have been named as parties to this action.
WHEREFORE, the plaintiff requests this Court to grant
primary physical custody of UH' child 10 the plaintiff with
partial custody in the (kfendant provided he can demonstrate that
he can renklin drug fre<' dlld I10t consuII'" alcohol during periods of
partial custody.
Fourth of July. This holiday schedule will begin with Father having
Labor Day in 1 997. These periods of partial custody and visitation
shall be from 9:00 a.m. until 8:00 p.m.
4. The Christmas holiday shall be broken into two segments.
Segment A shall be from Christmas Eve at 12:00 noon until December
25th at 12:00 noon, and Segment B shall be from December 25th at
12:00 noon until December 26th at 12:00 noon. Father shall have
Segment A in 1997 and all odd years thereafter and Segment B in
1998 and all even years thereafter. Mother shall have Segment A in
1998 and all even years thereafter and Segment B in 1997 and all odd
years thereafter.
5. Both parties are entitled to one uninterrupted week of
vacation during the summer. They shall provide each other with thirty
(30) days advance notice as to when they intend to exercise this week
of custody.
6. Mother shall have the child on Mother's Day and Father shall
have the child on Father's Day. These periods of partial custody and
visitation shall occur from 12:00 noon until 8:00 p.m.
7. The parties shall share the transportation under the terms of
this schedule.
