AND FOR A HEARING ON THE MERITS
AND NOW, Comes ~lward C. Holland, in pro se, who m~kes this
motion to defer payment of th~ lien and for a hearing on the
merits, and in support thereof states the following:
1. That I, Edward C, Holland, received a copy of this
Court's la:Jtice in the above ,natter on the date of August 12, 1997
although said notice was entered in the above docket on
June 27, 1997. The reason for the delay in receipt was due
to my ha'linq been transferred to SCI-Mahancy. [See Exhibit
"A," ~hich shous the date at receipt at SCI-Mahanoy. ]
2. Presently, in the matter of my conviction for which
I am serving a sentence fur, I have a reasonable chance to b~
rele~sed or. eith~r. bailor acquitted at a new trial within the
next 90 OilYS. Hence, I ask that ~ny ~roceedings against me
be extend ad ~cr "at least" that periud of time.
3. Furth:rmore, I ask thut a hearing be sched~led, with
my presence secured and in attendance, to adduce the circum-
stances surrounding the above matter as soon as ,ossible. An~
that any judgment in this matter be deferred until this hearing
is conducted.

llen upon the tranchises and property. both real and perlonal,
Including atter-acquired proporty of the employer liable therefor
and shall attach thereto from the date a lien for such contribu-
tions, interest and penalties is entered at record in the manner
hereinafter provided. The lien imposed hereunder shall have
priority tram the date of such entry ot record and shall be fully
paid and satisfied out of the proceeds at any judicial ,ale at
property subject thereto betore any other Obligation, judgment,
Claim. lien or estate to which said property may subsequently
become subject except costs of the sale and of the vrit upon which
the sale was made and real estate taKes and municipal claims
against such property, but shall be subordinate to mortgage. and
other liens eKi~ting and duly recorded or entered of record prior
to the recordln9 at the tAX lien. In the case of a judicial sale
at property subject to a llen imposed hereunder. upon a lien or
claim over whlch the lien imposed hereunder has priority, as
aforesaid, such sale shall discharge the lien imposed hereunder to
the eKtent only. that the proceeds are applied to its payment and
such lien shall continue in full force and eftect as to the
balance remaining unpaid.
(b) The department may at any time transmit to the prothonotaries of
the respective counties of the commonwealth, to be by them entered
of record and indeKed as judgments are now indeKed. certified
copies of all liens imposed hereunder. upon which record it shall
be lawful for writs of eKecution to be directly issued without the
issuance and prosecution to judgment ot writs of scire facias:
Provided, That not less than ten (10) days before the issuance of
any execution on the lien. notice of the filing and the effect of
the lien shall be sent by registered or certified mail to the
employer at his last known post office address. No prothonotary
shall require as a condition precedent to the entry of such liens
the payment of the costs incident thereto.
(c) The liens shall continue for tive years from the date ot entry and
may be revived and continued in the manner now or hereafter
provided for the renewal ot judgments or as may be provided in The
Fiscal Code, as amended.

(d) Notwithstanding any other prOVisions of this section. the lien
herein provided for shall have no effect upon any stock of goods.
wares or merchandise regularly sold or leased in the ordinary
course of business by the employer Against whom said lien has been
entered unless and until a writ of execution has been issued and
levy made upon said stock of goods. wares and merchandise.
(e I (i) Any payment s due dlld payable under the pro\l i s ions of this act
by an employer which is the Commonwealth. a borough. city,
county, school district. township or other political subdivi-
sion of the Commonwe~lth or instrumentality thereot. or an
authority at any level of government whether such employer's
liability is determined on a reimbursement basis or under the
employer experience provisions of this act, shall be deemed
Commonwealth taxes for purpose at enforcement and prlorlty in
the same manner provid~d in thi. act with respect to pri\late
employers.

Purchase of Property at Judicial Sale, Olspolal.--
(0)
At any judicial sale of any property. real or pprsonal. of any
employer against whom a lien or judgment has been entered under
the provisions of this act. the department is hereby authorized
and empowered to bid in such property if necessary for the pro-
tection of its interest. Title shall be taken in the name at the

vided and for the subsequent maintenance. preservation and dis- ,
posal thereof are hereby declared to be administrative expenses to
be paid out of the Administration Fund.

(c) Any property purch3sed under the provisions of this section shall
be held until such time as the d~partment shall believe it advis-
able to dispose of the same except as hereinafter provided.
Thereupon. the department. at eithec public or private sale. may
dispose of the property upon such t~rms and conditions as it may
deem advisabLe. and the Department of Justice may approve. It
shall be lawful to sell the property for cash or for part cash and
a mortgage to run from the purchaser to the Commonwealth. When
the terms and conditions of such sale shall have been agreed upon
and approved. the Department of Justice is hereby authorized and
directed to execute and deliver a deed or other appropriate
document conveying or transferring the property. Any such con-
veyance or transfer shall be free and clear of all liens and
encumbrances in favor of the department except the lien of A
purchase-money mortgage. if any. cantempocaneously executed and
delivered to the Commonwealth.

(l) Notwithstanding any other provisions of this :iubslrctlon, .!lny
person who has received or employer ~ho has made a back wage
payment pursuant to an award of 4 labor relatIons board
arbitrator or the like without deduction for unemployment
compensatlOn benefits received during the period to which such
waqes are allocated shall notify the department Immediately of
the receipt or pdlyment of such back waqe award. The recipient
of such b4Ck wage award, made without deduct Ion for unemploy-
ment compensation benefits received durlnq the period. shall
be liable to PdY into the Unemployment Compensat ion fund an
amount equal to the amount of such unemployment compensation
benefits received.

honored shall be chdlgl::!d a penalty of on~ hundred per centum
(100') at the face value of the check. up to a mdximum of one
hundred dollars ($100) with a minimum of ten dollars (SlO) per
OCCUlrence for all dishonored checks or such othl::!r dmounts as
shall be determIned by the secretary and published in the Penn-
sylvania Bulletin as a notice under 4~ P",C.S, 72S(a)(l) (relati.ng
to additional contents at Pennsylvania Bulletin).
Section 80S For the enforcement of this act or any rule and regulation
issued under the authority thereot the department Is hereby empowered~.
and it shall be its duty. to conduct such periodi~ spot checks an~
investi.gations as will disclose with reasonable cert~inty whether or
not compensation benefits have been paid to persons not legally
entitled thereto or as will disclose violations at this act and to
