Township, Mechanicsburg, Pennsylvania. A true and correct copy of said Guaranty
executed by Melvin G. Austin, Jr., and Helen E. Austin, is attached hereto, marked Exhibit
"A: and made a part hereof by reference thereto. A true and correct copy of the Mortgage
Accompanying Guaranty executed by same is attached hereto, marked Exhibit "B" and
made a part hereof by reference thereto. It is noted that said Mortgage Accompanying
Guaranty was recorded in the Office of Recorder of Deeds of Cumberland County on April
19, 1991, in Mortgage Book 1009, Page 172.
4. The Guaranty did obligate the said Melvin G. Austin, Jr. and Helen E. Austin
to pay to Fulton Bank any and all sums, liabilities which the principal debtor, Austin's Pet
Shop, Inc., did not payor perform in a timely manner.
5. The hereinbefore identified Note of Austin's Pet Shop, Inc., of March 8, 1991,
a true and correct copy of which is attached hereto, marked Exhibit "C" and made a part
hereof by reference thereto did provide for ninety-six (96) successive monthly installments
commencing April 15. 1991, in the amount of $1,506.72, at a variable rate of 1.75% above
the annual rate of interest regularly and from time to time charged by Fulton Bank as its
prime rate, until said obligation would be paid in full with all accrued interest.
6. Said March 8,1991 Note of Austin's Pet Shop, Inc., with Fulton Bank, was
modified by Supplement dated April 15, 1996, which did restructure the remaining
obligation to provide for seventy-one consecutive monthly installments thereafter in the
amount of $667.32 each commencing April 15, 1996. and continuing thereafter until paid
in full, which would occur on or about March 15. 2002. A true and correct copy of said

Supplement Promissory Note is attached hereto, marked Exhibit "0" and made a part
hereof by reference thereto.
7. The said Austin's Pet Shop, Inc., did file for relief under Chapter 7 of the
Bankruptcy Act on or about June 27, 1996, said case docketed to No. 96-01734 RJW-1
(7).
8. The said Austin's Pet Shop, Inc., and Melvin G. Austin, Jr. and Helen E.
Austin, have failed to pay the monthly payments on said Note, as supplemented, from June
15,1996, through June 1,1997. The obligation, therefore, became in default on June 16,
1996.
9. As provided in the Note and the Guaranty Agreement, due to the said default,
all the debt is now due and payable as demanded by Plaintiff, Fulton Bank.
10. Defendants, Melvin G. Austin, Jr. and Helen E. Austin, are therefore in
default, and said obligation of Fulton Bank in the principal amount of Thirty-Four Thousand
Eight Hundred and Two Dollars and 48/100, ($34,802.48); accrued interest through June
23,1997, ofThree Thousand Nine Hundred Twenty-nine and 26/100 ($3.929.26); and late
charges of Ninety-Three Dollars and 28/100 ($93.28); for a total, through June 23, 1997
of Thirty-Eight Thousand Eight Hundred Twenty-Five Dollars and 12/100 ($38,825.12).
11. Payments have not been made to Fulton Bank since the commencement of
the Bankruptcy Petition and no payments have been made since June 3, 1996, as
aforestated.

12. Pursuant to Motion filed by Fulton Bank for Relief from Automatic Stay,
hereunder, Robert J. Woodside, United State Bankruptcy Judge did sign the Order
February 7, 1997, permitting Fulton Bank to exercise its right under the identified Note and
Mortgage against the subject real estate of 148 Lancaster Boulevard, Lower Allen
Township, Mechanicsburg, Cumberland County, Pennsylvania, 17055. A true and correct
copy of said Order is attached hereto marked Exhibit "E" and made a part hereof by
reference thereto.
13. As provided in the loan documents, a reasonable attorney's fee for collection
of $3,000.00 is also demanded.
14. Plaintiff, Fulton Bank, did provide the said Defendants notice of their rights
under the Pennsylvania Homeowners Emergency Assistance Program by notice of
February 26, 1997. The said Defendants did apply for assistance under said Act and
denial of the application was issued by the Pennsylvania Housing Finance Agency on or
about June 18, 1997. A true and correct copy of the Notice and denial is collectively
attached hereto marked Exhibit "F" and made a part hereof by reference thereto.
WHEREFORE, Plaintiff Fulton Bank, demands judgment against
DebtorslDefendants Melvin G. Austin, Jr. and Helen E. Austin in the amount of

Accompanying Affidavit Pursuant to Rule 3129
PLEASE BE ADVISED that the sale of the parcel of real estate
with the improvements erected thereon known as 148 Lancaster
Boulevard, Mechanicsburg, Cumberland County, Pennsylvania 17055,
which improved parcel of real estate was conveyed to Defendants
Melvin G. Austin, Jr, a/k/a/ Mel G. Austin and Helen E, Austin, by
deed dated March 8, 1991, and recorded April 19, 1991, at the
Office of the Recorder of Deeds, Cumberland County, Pennsylvania,
in Book 1009, Page 172, will be held on December 10, 1997, under the
auspices of the Sheriff of Cumberland County, Cumberland COllntv~
Courthouse, One Courthouse Square, Carlisle, Pennsylvania, Q~ ~u:uu
a,m, A complete copy of the further legal description of said real
estate is attached hereto as Exhibit "A",
The aforesaid sale is being held on the judgment of Fulton
Bank, indexed to No. 97-3483 civil Term, in the Court of Common
Pleas of Cumberland County, said judgment being in the principal
amount of $41,825.12, together with interest in the amount of
$3,105.12, with additional accrued interest thereafter at a per
diem figure of $6.46 per day.
The aforesaid tract of land, with improvements erected
thereon, is reputedly owned by the said Melvin G, Austin, Jr.,
a/k/a Mel G. Austin, Jr., and Helen E, Austin, solely,
Claims against the property must be filed with the Office of
the Sheriff before the above sale date, Claims to proceeds must be
made with the Office of the Sheriff before distribution.
Notice is further given to all parties in interest of said
claim that a schedule of proposed distribution will be filed by the
Sheriff of Cumberland County on or about January ~, 199B,
Distribution will be made in accordance with the said schedule
unless exceptions are filed thereto within ten (10) days
thereafter.
Attached hereto is a copy of the Writ of Execution. It has
been issued because there is a judgment against Defendants, Melvin
G. Austin, Jr" a/k/a Mel G. Austin, Jr" and Helen E. Austin. It
will cause the property above identified to be held or taken to pay
the judgment. Defendants Melvin G. Austin, Jr., a/k/a Mel G.
Austin, Jr" and Helen E. Austin, may have legal rights to prevent
the property from being taken, A lawyer can advise you more
specifically of these rights, If you wish to exercise your rights,
you must act promptly.
