placed on plastic crates in an enclosed porch at 48 Richard Avenue,

9. On or about October 1, 1996, the Defendants left 48
Richard Avenue, Shippensburg, PA, leaving the aforesaid candles
burning when they left the premises,
10. Shortly after the Defendants left the premises of 48
Richard Avenue, Shippensburg, PA with the candles lit, a fire began
at the premises of 48 Richard Avenue, Shippensburg, PA.
11, The fire at 48 Richard Avenue, Shippensburg, PA caused
damage to personal property of the Plaintiffs^located at 46 Richard
Avenue, Shippensburg, PA,
12, Plaintiffs' damage was the direct and proximate result of
the negligence, carelessness and/or recklessness of the Plaintiffs
by leaving the 48 Richard Avenue premises without extinguishing the
aforesaid candles,

and costs of suit.

AND NOW, come the Plaintiffs, Edgar W. Knaub, Carol A, Knaub
and Stephanie Knaub (collectively "the Knaubs"), by and through
their attorneys, Goldberg, Katzman & Shipman, P,C" to file this
Complaint and, in support thereof, state as follows:
1, Plaintiff, Edgar W, Knaub, is an adult individual
residing at 275 Ht. Hope School Road, Willow Street, PA 17584,
2, Plaintiff, Carol A, Knaub, is an adult individual
residing at 275 Mt. Hope School Road, willow Street, PA 17584.
3. Plaintiff, Stephanie Knaub, is an adult individual
l-es id i ng at 9 South /less Street, Quarryville, PA 17566.
4. Defendant, Valerie White, is an adult individual whose
last known addless was 446 East Main Street, Lansdale, PA 19446-
2811,
S. Defendant, Jennifer Knight, is an adult individual whose
last known address was 20A North Washington Street, Shippensburg,
PA 17257,
6. Defendant, Jennifer Hunter, is an adult individual whose

Defendant, Jennifer Hunter (hereafter, "Answering Defendant"), by and through her
attorneys, Post & Schell, P.c.. hereby liles her Answer to Plaintiffs' Complaint with New Matter
and New Matter Crossclaims pursuant to Pa. RCP 2252(d) and, in support thereof, avers:

WHEREFORE, Answering Defcndant denics any and all liability to any party to thc within
litigation, demands that the Complaint against her bc dismisscd with prcjudicc and that judgment

14. Plaintiffs may havc failed to state a causc of action upon which rclief can be grantcd.
Answering defendant was not ncgligent.
15. Any acts or omissions of answcring defendant allegcd to constitute ncgligence were
not substantial.
16. The incident and/or damages dcscribcd in Plaintiffs' Complaint may have been
caused or contributed to by Plainti ffs.
17. The negligent acts or omissions of other individuals and/or entities may havc
constituted intervening superscding causes of the damage and/or injuries alleged to havc been
sustained by the Plaintiffs.
18. Plaintiffs may havc assumed the risk.
19. The incidcnt, injuries and/or damages alleged to have been sustained by Plaintiffs
were not proximately caused by answering defendant.
20. The action of individuals or entitics bcyond Answering Defendant's control may have
caused or contributed to the incident.

22. Plaintiffs may have been comparatively or contributorily negligent.
23. Plaintiffs failed to mitigate damages,

severally liable with Defendant, Jennifer Hunter, who would then be entitled to a contribution from
Co-Defcndant, Jennifer Knight, and/or Co-Defendant, Jennifer Knight, is Iiablc over to Dcfendant,
Jennifer Hunter, by way ofindemnilication for all sums which may be recovercd.
WHEREFORE, Defendant, Jennifcr Huntcr, dcnies all liability to Plaintiffs and makcs
claim against and joins Co-Dcfcndant, Jcnnifcr Knight, for sole liability, contribution and
indcmnilication.

if any, is barred by their own conduct.
