Usted puede perder dinero 0 sus propiedades 0 otros derechos importantes para usted, . year at the rate of $1,290.00 per month, by virtue of an oral agreement entered into on two separate occasions between Plaintiff and Defendant's attorney, Richard S, Friedman, who was acting with Defendant's authority and on his behalf, Moreover, even if there were no verbal lease, notification by plaintiff that the July rent would be $2,000.00 and that the August rent would be $3,000,00 was never agreed to by Defendant and said increases of rent are unreasonable, it being the purpose of Plaintiff to force Defendant into surrendering possession, contrary to the order of the District Justice, rather than obtaining the fair market rental value for his property. It is further averred that Defendant would be required under an extension of the lease on a month to month basis to pay reasonable rent, which is $1,290.00 per month. 8. It is admitted that Plaintiff desires that the Defendant pay the amount of $6,575.13 with possession, but it is averred that these sums are not due. and further averred that Plaintiff is not entitled to possession. Proof of any claim for damages is demanded. 9, It is admitted that Plaintiff seeks payment of costs and reasonable legal fees as required by the lease, Moreover, it is averred that Plaintiff is entitled to no legal fees for representation by counsel. The first hearing in front of District Justice Clement resulted in a denial of a request for possession, and damages for Plaintiff in an amount less than had been tendered by Defendant, It is further averred that Plaintiff is entitled to no legal fees for the second action, which was " filed precipitously in front of District Justice Clement on September 22, 1997, which action was dismissed by the District Justice. WHEREFORE, Defendant demands judgment against Plaintiff, NEW MATTER 10. The averments contained in paragraphs 1-9 of the Answer are incorporated herein by reference as though the same were more fully set forth herein, 11. On or about February 10, 1997, Richard S. Friedman, Esquire, known by Plaintiff as counsel to Defendant, had a discussion with Plaintiff and indicated that Defendant was interested in extending the lease for an additional period of one year. 12, At that time, Plaintiff agreed with Mr. Friedman that he would extend the lease for an additional period of one year, and that if Mr, Friedman prepared a Lease Extension Agreement, as he had for the previous year's extension, he would execute it. 13, On February 13, 1997, Richard S. Friedman, Esquire prepared a Lease Extension Agreement in accordance with the terms and conditions of his verbal agreement with Plaintiff and mailed and faxed said Lease Extension Agreement to plaintiff at his fax number and address. 14, The Lease Extension Agreement was in accordance with the terms and conditions agreed to by Plaintiff, and is attached hereto, marked Exhibit A and incorporated herein by reference. , 15. On or about April 7, 1997, Richard S. Friedman called Plaintiff and spoke to him about the Lease Extension Agreement, which had been agreed upon by Plaintiff. 16. Plaintiff stated that he was in agreement with the terms and conditions previously agreed to, but that he had misplaced the Lease Extension Agreement, He further indicated that he would execute the Lease Extension Agreement and return it to Richard S. Friedman, Esquire, 17. Richard S. Friedman, Esquire then faxed a letter to the Plaintiff, which is marked Exhibit B, attached hereto and incorporated herein by reference, 18. Defendant relied upon the oral agreement of Plaintiff and Mr. Friedman, who was acting on Defendant's behalf, and expended several thousand dollars improving subject premises for utilization of the grounds and pool during the summer, and likewise he and his fiancee spent over 100 hours of their own time cleaning the property, servicing the pool, landscaping, and performing other beautification items which were not required by the terms of the initial lease or renewal thereof, anticipating that they would be residing in subject premises until May 3D, 1998, WHEREFORE Defend3nt demands judgment against Plaintiff. COUNTERCLAIM 19. The averments contained in paragraphs 1-18 of the Answer and New Matter are incorporated herein by reference as though the same were more fully set forth herein. . 20. On June 2, 1997, Plaintiff filed an action in front of District Justice Clement, a copy of which is attached hereto and marked Exhibit C. 21. The complaint requested possession and stated that notice had been given, and likewise demanded damages. 22, The District Justice found that proper notice had not been given, denied the requested possession to the Plaintiff, and awarded damages which were less than, had been tendered by Defendant. A copy of the District Justice Judgment transcript for the June 24, 1997 hearing is attached hereto and marked Exhibit D. 23. The Defendant was forced to incur substantial legal fees, to defend Plaintiff's spurious action. 24, On July 11, 1997, Plaintiff filed another action in front of District Justice Clement, a copy of which is attached hereto and marked Exhibit E, 25, The District Justice found that the proceeding was premature and dismissed the complaint. A copy of the District Justice Judgment transcript for the August 18, 1997 hearing is attached hereto and marked Exhibit F. 26, Defendant was forced to incur substantial costs for legal defense, including attorney's fees and witness fees, as a result of the filing of this action. 27. The District Justice actions filed on June 2, 1997 and July 11, 1997 were meritless and for the purposes of harassing and annoying the Defendant, were filed without probable cause, VERIFICATION I, MICHAEL FINKELSTEIN, hereby acknowledge that I am the Defendant in the within action; that I have read the foregoing Answer with New Matter and counterclaim; and the facts contained therein are true and correct to the best of my knowledge, information and belief. Jennings, Lessor. WIT N E SSE T H : WHEREAS, the parties entered into a lease agreement dated May 11, 1995 for premises situate 137 Blacksmith Road, Camp Hill, Cumberland County, Pennsylvania, and, and an extension thereto dated November, 1995; and r WHEREAS the parties wish to extend the said lease agreement for a period of an additional year. NOW THEREFORE, the parties hereto, in consideration of the mutual covenants herein contained, agree as follows: 1. The avenments offact contained in paragraph twelve (12) of the New Matter are specifically denied. On the contrary, the plaintiff never agreed to sign a written lease extension at the same financialtenms. 13. The avennents of fact contained in paragraph thirteen (13) of the New Matter are specifically denied. On the contrary, the plaintiff never agreed to tenms with the defendant regarding a lease extension. The fax copy sent to the plaintiff was unsigned by the defendant and plaintiff refused to sign it. 14. The avennents offact contained in paragraph fourteen (14) of the defendant's New Matter is specifically denied. On the contrary, the tenms of Exhibit "A" of the New Matter were never agreed to by the plaintiff, John Jennings. Any extension to the lease needed to be in writing and signed by both parties in order to meet the Statute of Frauds 33 P.S. Section I. 15. The avennents offact contained in paragraph fifteen (15) of the defendant's New Matter are specifically denied. On the contrary, the plaintiff has no memory of a telephone call from the defendant and his legal counsel in April of 1997. The plaintiff had no intention of extending the lease in April with the defendant since he was still in arrears on payment of the rent. 2 16. The averments of paragraph sixteen (16) of the New Matter are specifically denied. On the contrary, the plaintiff never agreed to extend the lease for the same terms nor did he ever agree to sign the written extension prepared by the defendant's counsel. 17. The averments off act contained in paragraph seventeen (17) of the New Matter are specifically denied. On the contrary, the correspondence was not received by the plaintiff. On or about April 7, 1997, the defendant was in arrears for rent payments to the plaintiff in excess of Two Thousand Five Hundred and no/lOO ($2,500.00) Dollars. The plaintiff had no intention or obligatit ., to extend the terms of the lease to his tenant. 18. The averments off act contained in paragraph eighteen (18) of the New matter of the defendant are hereby specifically denied. On the contrary. the lease provides that any improvements by the tenant be made in writing to the plaintiff and said plaintiff must agree to the list ofimprovements or alterations in writing to the tenant. The plaintiff never received a written request from the defendant to improve the leased property nor did defendant ever send a list of requested improvements to the plaintiff.
