PLAINTlFF'S RESPONSE TO DEFENDANT'S NEW NATTER
AND NOW, comes the Plointiff, Morlin Horshborger, by ond through his
ottorneys, the Low Office of Dorrell C. Dethlefs, ond rtles the following Response to
Defendont's New Molter, overring os follows:

Please take notice that the arbitration hearing for the above matter has been
scheduled for January 20, 1999, at 1 :30 p.m. in the hearing room of the Old
Courthouse, Second Floor, Courthouse Square, Carlisle, Pennsylvania 17013,
Should any party or arbitrator desire to reschedule this hearing for any
reason, the person requesting the change shall be responsible for scheduling a
new date with all parties, attorneys and arbitrators, locating a hearing room in
Carlisle for such purpose and making proper notification to all concerned,

Statement was signed on January 18, 1995. According to the document
submitted as Plaintiff's Exhibit "B" attached to Plaintiff's Amended
Complaint, the date is actually August 18, 1995. Further, the disclo-
sure questionnaire aBks for any awareness of a sewer lateral problemB.
It iB averred that there is no duty to disclose something for which
there is no awareness, hence, no knowledge. Proof of Defendant's
knowledge thereof is demanded at trial.
7. Denied. It is denied that the defendant was aware of any
problems relating to the lateral sewer system, other than routine,
regular root removal performed during the time that the defendant
owned, but never lived on the property. By way of further answer,
defendant admits to having the roots removed, thus removing any
problems. Further, no problems were reported by the tenant after the
routine cleaning. If an answer is required, it is denied and proof of
defendant's knowledge is demanded at trial.
B. Neither admitted nor denied. After reasonable investigation
the defendant is without sufficient knowledge or information to form a
belief as to the truth of this averment.
9. Denied. Defendant is not aware of nor is able to determine
from plaintiff's complaint exactly the nature, problem, or substance
of Plaintiff's alleges "damages". Further, if the problemB ariBe from
Borne alleged clogged roots in the Bewer pipes, it is averred that a
routine $100.00 visit to clear out overgrown roots twice in fifteen
years, could not have cauBed a $5,982.00 problem, and proof thereof is
demanded at trial.

WHEREFORE, defendant respectfully prays that this Honorable
Court dismiss plaintiff'B complaint for the reasons herein stated.
NEW MATTER
10. Paragraphs one (1) through nine (9) are incorporated herein
by reference as if fully stated therein.
11. It is averred that if any sewer lateral problems were
discovered after the property transferred ownership, the plaintiff had
a duty to mitigate the damages by seeking the least costly method to
solve the problem.
12. Plaintiff failed to mitigate his damages by refusing to call
on Free Flow, Roto Rooter, or a similar sewer pipe and root cleaning
company immediately.
13. But for plaintiff's failure to mitigate, the damages might
have been merely a $100 routine root removal cleaning problem.
WHEREFORE, defendant respectfully prays that thiB Honorable
Court dismiss plaintiff's complaint for the reaBons herein stated,
award attorney fees, and any other relief that this Court deems
reasonable.

AMENDIID COMPLAINT
AND NOW, comes Marlin Harshberger, by and through his
attorneys, The Law Offices of Darrell C. Dethlefs, in support of
the within Complaint hereby avers as follows:
1, Plaintiff, Marlin Harshberger, is an adult individual
residing at 804 16th Street, New Cumberland, Pennsylvania, 17070.
2. Defendant, Marjorie G. Medlin, is an adult individual
residing at 1555 Locust Street, New Cumberland, Cumberland County,
Pennsylvania,
3. On or about November 5, 1995, Plaintiff and Defendant
entered in an Agreement of Sale for the purchase of property
located at 804 16th Street, New Cumberland, Pennsylvania herein
after "The Property."
4. By Special Warranty Deed dated December 22, 1995. The
property was conveyed by Defendant to Plaintiff. A copy of said
deed is attached hereto made a part hereof and labeled as Exhibit
IlAn.
5. Subsequent to the aforementioned conveyance, Plaintiff
had encountered severe problems with the sewer lateral in that said
lateral would become clogged with roots causing sewage backups.
6, In accordance with the seller's disclosure statement
dated January 18, 1995 and executed by the Defendant, Defendant
did not disclose the existance of any problems relative to the
sewage system of the property. A copy of said disclosure statement
is attached hereto made a part hereof and labeled as Exhibit "B".
7, Plaintiff believes and therefore avers that Defendant was
aware of problems relative to the sewer system due to the growth of
roots clogging said sewer system in that Defendant only several
months prior to entering into an agreement of sale for the subject
property engaged a contractor for the second time to clear roots
from the sewer lateral in question.
8. Plaintiff materially and substantially relied to his
detriment upon the representations made by Defendant relative to
the seller's disclosure statement.
9. Plaintiff suffered damages in order to remedy the
aforementioned sewer lateral problems by replacing the
aforementioned sewer lateral at a cost of Five thousand nine
hundred eighty-two ($S, 982,00) Dollars and 00/100 which was a
direct result of Defendant's non-disclosure as set forth in
Paragraph 6 herein,

TO PLAINTIFF'S COMPLAINT
AND NOW, comes the defendant above-named, Marjorie G.
Medlin, by and through her attorneys, Stone LaFaver & Stone, and files
the following preliminary objections purBuant to Pa.R. C. P.S1028 et
seq., averring as follows:
FAILURE OF A PLEADING TO CONFORM TO LAW OR RULE OF COURT
AND INSUFFICIENT SPECIFICITY IN A PLEADING
1. Plaintiff has failed to plead specifically any law in which
his cause of action mayor may not be based; therefore, there is legal
insufficiency of a pleading.
2. Plaintiff has failed to plead with any specificity in
paragraph 9 of plaintiff's complaint, what, if any, damages he has
suffered by defendant's alleged non-disclosure; therefore, there is
insufficient pleading in his complaint. Plaintiff has failed to
allege any information that might Buggest just what damages he haB
Buffered. This complaint is both legally and factual inBufficient and
fails to conform to any action based in law or equity.
DEMURRER
3. Plaintiff has failed to allege sufficient facts to support a
cause of action. Plaintiffs have failed to state how the allege non-
diBcloBure of sewer problems specifically lead to their sewer problems
and the alleged damages. More specifically, in paragraph 5 of
Plaintiff's complaint, plaintiff does not plead with any specificity
the nature of the sewer problems or the cause thereof; therefore,
there is legal insufficiency of a pleading.

6, In accordance with the seller's disclosure statement
dated January 18, 1995 and executed by the Defendant, Defendant
did not disclose the existance of any problems relative to the
sewage system of the property. A copy of said disclosure statement
is attached hereto made a part hereof and labeled as Exhibit "B".
7 . Plaintiff Believed and therefore avers that Defendant was
aware of problems relative to the sewer system due to the growth of
roots clogging said sewer system.
8. Plaintiff materially and substantially relied upon the
representation made by Defendant relative to the seller's
disclosure statement,
9. Plaintiff suffered damages in order to remedy the sewer
lateral problem in the amount of Five thousand nine hundred eighty-
two ($5,982,00) Dollars and 00/100 which was a direct result of
Defendants non-disclosure as set forth in Paragraph 6 herein.
VERIFICATION
I hereby verify that the statements of fact made in the
foregoing Complaint are true and correct to the best of my
knowledge, information and belief. I understand that any false
statements therein are subject to the criminal penalties contained
in 18 Pa.C.S. ~ 4904, relating to unsworn falsification to
