1995.
13. Plaintiff has been advised as to the availability of counseling and that he
may have the right to request that the Court require the parties to

14. Plaintiff requests the Court to enter a decree of divorce on the grounds that
the parties to this action have lived separate and apart for a period of at
least two years.
WHEREFORE, Plaintiff prays that a decree in divorce be entered divorcing
Plaintiff from the bonds of matrimony between the said Plaintiff and Defendant.

on JULY 2, 1997.
2. The marriage of Plaintiff and Defendant is irretrievably broken and ninety
(90) days have elapsed from the date of filing the Complaint.
3. I consent to the entry of a final decree of divorce.
4. I understand that I may lose rights concerning alimony, division of
property, lawyer I s fees or expenses if I do not claim them before a
divorce is granted.

PETITION FOR BIFURCATION OF DIVORCE ACTION
TO THE HONORABLE, THE JUDGES OF SAID COURT:
1. Pet.it.ioner is Rest.a S. Gregoire, II, who resides at P. O. Box 101, Spring
Run, Pennsylvania.
2. Respondent. is Kathie Fraker-Gregoire, who resides at 102 A St.reet,
Plainfield, Cumberland County, Pennsylvania.
3. The Petitioner filed an action in divorce July 2, 1997, docketed to the
above captioned number.
4. The parties separated April 13, 1995.
5. (a) On July 7, 1997, Plaintiff attempted to serve Defendant by certified
mail the Complaint in Divorce. See attached Exhibit 1, attached hereto
and made a part hereof as though fully set forth herein.
(b) No green card was ever returned, but Defendant returned the complaint.
See attached Exhibit 2, attached hereto and made a part hereof as though
fully set forth herein.
(c) On July 17, 1997, the same letter as was sent July 7, 1997, only re-
dated July 17, 1997 was provided the Sheriff of Cumberland County along
with a true copy of the divorce complaint and complaint for service. The

shsriff finally was able to accomplish service on August 1, 1997. See
attached Exhibit 3, attached hereto and made a part hereof as though fully
set forth herein.
6. On October 21, 1997, a certified letter, along with a notice of Intention
to Request Entry of a S3301(d) Divorce Decree, a copy of a Praecipe to
Transmit the Record, a Counter-Affidavit, and Notice were sent to
Defendant. Neither the green card nor any documents were ever returned by
Defendant. See attached Exhibit 4, attached hereto and made a part
hereof as though fully set forth herein.
7. On March 11, 199B, Defendant was again served by the Cumberland County
Sheriff a copy of the Notice of Intention to Request Entry of a S33011d)
Divorce Decree, a Counter-Affidavit and Notice and a Consent to Divorce
and Waiver of Notice of Intention to Request Entry of Divorce Decree.
See attached Exhibit 5, attached hereto and made a part hereof as though
fully set forth herein.
B. On March 16, 199B, attorney for Plaintiff received the Counter-Affidavit
unsigned, but with written comments.
See attached Exhibit 6, attached
hereto and made a part hereof as though fully set forth herein.
9. (a) There is no reason not to bifurcate this action with this Court
retaining jurisdiction to issue an Order since there are no unresolved
issues.
The parties accomplished equitable distribution as separation
when Defendant received all marital property.
(b) Defendant is simply withholding her consent and refusing to sign
documents in order to continue to receive support payments from Plaintiff.

10. Petitioner requests this Court issue an Order bifurcating this divorce
action and issue a decree of divorce, retaining jurisdiction to later
lesue an Order awarding Alimony Pendente Llts and Equitable Dietribution
as decreed.
11. Further, Petitioner requests this Court to dIrect the Master in Divorce,
E. Robert Elicker, Ii, Esquire, to promptly schedule a hearing on these
collateral issues at such tIme as the Court has ruled on the motions of
Defendant pending before this Court.
WHEREFORE, Petitioner requests thIs Court I"ue an Order bifurcating this
divorce action and a decree of divorce, retaining jurisdiction to later issue an
Order awarding Alimony Pendente Lite and Equitable Distribution if such are
requested by Defendant and to direct the Master in Divorce, E. Robert Elicker,
II, Esquire, to promptly schedule a hearing on these collateral issues as such
time as the Court has ruled on the motions of Defendant pending before this
Court.

Plainfield, Cumberland County, Pennsylvania.
3. The Petitioner filed all action in divorce July 2, 1997, docketed to the
above captioned number.
4. The parties were div,rced by decree of this Court dated July 1; 1998,
said decree preserved any economic issued which the defendant wished to
raise. 13, 1995.
See attached copy of Decree in Divorce included as
Exhibit A.
S. To date defendant has raised no economic claims with this Court; Plaintiff
is satisfied with the property distribution which the parties accomplished
at separation April 13, 1995, wher&by the Defendant-wife retained all of
the household conterlts and otller property, while the Plaintiff-Husband
