and the parties hereto are desirous of settling fully and finally their respective financial
and property rights and obligations as between each other, including, without limitation
by spccification: thc settling of all matters betwcen thcm relating to the ownership of rea!
and pcrsonal property; the settling of allmattcrs bctwecn them rclating to the past,
present, or future support and/or maintenance of Wife by Husband or of Husband by
Wife; and in general, the scttling of any and all claims and possible claims by one against
the othcr or against their respcctive estatc, particularly those rcsponsibilities and rights
growing out of the marriage relationship; and
WHEREAS, both Husband and Wife have been fully, separately and
indepcndently advised of their legal rights and obligations, and each covenants that he
and she has cach made a full and complete disclosure to the other of his or hcr respective
property, holdings and income; and
The provisions of this Agreement and their legal effect have been fully explained
to the parties by their respective counscl. The Wife has cmp!oyed and had the benefit of
counsel of CONSTANCE P. BRUNT, ESQUIRE, as her attorney, The Husband has
cmploycd and had the benefit of counscl of JAMES A. MILLER, ESQUIRE, as his
attorncy, Each party acknowledges that he or she has received independent legal advice
from counsel of his or hcr selection and that each fillly understands the facts and has been
fully infornlcd as to his or her legal rights and obligations, Each party acknowledges and
acccpts that this Agreement is, under the circumstances. fair and equitable, and that it is
bcing entercd into freely and voluntarily after having received such advice and with such
knowledge, amI that execution of this Agrecment is not the result of any duress or undue
intluence and that it is not the result of any collusion or improper or illegal agrcement or

agreements. In addition, each party hereto acknowledges that he or she has been fully
advised by his or her respcetive attorney of the impact of the Pennsylvania Divorce Code,
whereby the Court has the right and duty to dctennir.e all marital rights of the parties,
including divorce, alimony, alimony pcndente lite, equitable distribution of all marital
property owned or possessed jointly or individually by either party, counsel fees and costs
oflitigation, and, fully knowing the same and being fully advised of his or her rights
thereunder, each party hereto still desires to execute this Agreement, acknowledging that
the terms and conditions sct forth herein arc fair, just and equitable to each of the parties,
and waives his and her respective right to have the Court of Common Pleas of
Cumberland County or any other court of competent jurisdiction make any determination
or order affecting the respective parties' rights to a divorce, alimony, alimony pendente
lite, equitable distribution of all marital property, counsel fees and costs oflitigation.
NOW, THEREFORE, in consideration of the premises and of the promises,
covenants and undertakings hereinafter set forth, and for other good and valuable
consideration, the receipt of which is hereby acknowledged by each of the parties hereto,
Husband and Wife, each intending to be legally bound hereby, covenant and agree as
follows:
I. SEI'AI~A TION. It shall be lawti.1 for Husband and Wife at all times
hereafter to live separate and apart ii'Dln each other and to reside, from time to time, at
such place or places as they shall respecti\'c\y deem tit, free from any control, restraint or
interference, direct or indirect, by each other. Neither party shall molest the other or
compel or endeal'or to Cllmpc\ the other to cohabit or dwell with him or her by any legal
or other proceedings, The tlJregoing pnJl'ision shall not be taken to be an admission on

the part of either party of the lawfulness or unlawfulness of the causes leading to their
living apart.
2. SUnSEOUENT DIVORCE. The parties hereby acknowledge that
Husband has filed a Complaint in Divorce in the Court Of Common Pleas of Cumberland
County, docketed to No, 97-3(126, claiming that the marriagc is irretrievably brokcn. The
parties hercby express their agreement that they have been living "separate and apart" in
excess of two years and their further agreement that the marriage is irretrievably broken.
Each party expresses his or hcr intent to execute any and all affidavits or other documcnts
nccessary for the parties to obtain a no-fault divorce as soon as practicable hereafter. The
partics hereby waive all rights to request Court-ordered counseling under the Divorce
Code. Neither party to such action shall seck alimony, alimony pendente lite, or support
or maintenance of any nature contrary to the provisions of this Agreement. It is further
specifically understood and agreed by the parties that the provisions of this Agreement
relating to cquitable distribution of property of the parties arc accepted by each party as a
final settlement for all purposes whatsoever, as contemplated by the I'ennsylvania
Divorce Code.
Should a decree, judgment or order of separation or divorce be obtained by either
of the parties in this or any other statc, country or jurisdiction, each of the parties hereby
consents and agrees that this Agreement and all of its covenants shall not be affected in
any way by any such separation or divorcc; and that nothing in any such dccree,
judgmcnt, ordcr or tilrthcr modification or revision thereof shall aIter, amcnd or vary any
tennofthis Agreement, whether or not l'ither or both of the parties shall rl'marry, it being
understood by amI betll l'l'n thl' partil's hl'rl'tothat this Agrl'l'ml'nt shall survil'e and shall

not be merged into any (lccree, judgmcnt, or order of divorce or separation.
Notwithstanding the provisions of the I'ennsylvania Divorce Code or of any law to the
contrary, none of the terms and provisions of this Agreement shall be subject to
modification by the Court or in any !:lshion other than as set forth hereinafter. It is
specifically agreed, however, that this Agreement shall be subject to enforcement under
the provisions of the Pcnnsylvania Divorce Code or, at the option at the aggrieved party,
by a suit against the alleged breaching party either in law or in equity,
3. EFFECTIVE DATE. The effective date of this Agreement shall be the
"datc of execution" or "exccution date", de tined as the date upon which it is executed by
the parties if they have each executed the Agreement on the same date. Otherwise, the
"date of execution" or "execution date" of this Agreement shall be defined as the datc of
execution by the party last executing this Agreement.
4. DEBTS AND OBLIGATIONS. Husband represents and warrants to
Wife that since the separation he has not, and in the future he will not, contract or incur
any debt or liability for which Wife or her estate might be responsible, and he shall
indemnify and save Wife hannless from any and all claims or dcmands made against her
by reason of such debts or obligations incurred by him since the date of said separation,
except as otherwise set forth herein,
Wife represents and warrants to Husband that, since the separation, she has
not, and in the future she will not, contract or incur any debt or liability for which
Husband or his estate might be responsible, and she shall indemnify and save Husband
hamlless from any and all claims or dl'mands madl' against him by reason of such debts
or obligations incurred by her since the date of said sl'paration, exl'l'pt as othl'rwise set

forth herein.
5. BANKRUI'TCY I'ROCEEDlNGS. The parties acknowledge that thcy
have filed ajoint voluntary petition under Chapter 13 of the United States Bankruptcy
Code, dockcted to No. 98-376, in the United States Bankruptcy Court for the Middle
District of Pennsylvania. On January 26, 1998, the said Bankruptcy Court entered an
Order confirming the Plan filed by the parties therein and requiring certain paymcnts to
the bankruptcy Trustee in order to complete the bankruptcy plan and to obtain a full and
complcte discharge of the parties from any further liability for the debts listed in the Plan.
Husband shall be solely responsible for making all of the remaining payments due to thc
bankruptcy Trustee in order to complete the Plan and to obtain the said full and completc
discharge of any further liability by Wife for the debts listed in the Plan. In the event that
Husband fails to make any monthly I'lan payment as scheduled or othcrwise fails to
comply with the Plan as ordered by the Bankruptcy Court or the Trustce, Husband shall
pay alimony to Wife in the amount of Seven Hundred Seventy-five Dollars ($775.00) per
month, in addition to any other alimony payments provided for herein, which payments
shall commence immediately upon Husband's failure to make any Plan payment as
scheduled or upon other defauIt or t:lilure to comply with the bankruptcy Plan or any
Order in connection therewith, and will continuc until such time as the bankruptcy I'lan
has been complcted and paid in tilll and tinal discharge grantl'd. Such alimony payments
shall be non-modifiable and shall not be subject to tennination except in the event ofthc
death of either party. Such additional alimony payments shall be made through the
Cumberland County Domestic Relations Sl'clion.
6. 1\I1ITlIAI. REI.EASES. Husband and Witi: do hereby mutually remise,

release, quit-e1aim or tlJreVer discharge the other and the estate of such other, for all time
to come, and for all purposes whatsoever, from any and all rights, title and interest, or
claims in or against the cslate of such other, of whatever nature and wherever situate,
which he or she now has or at any time hereafter may have against such other, the estate
of such other or any part thereoC whether arising out of any former acts, contracts,
engagements or liabilities of such other or by way of dower or curtesy; or claims in thc
nature of dower or curtesy, or widow's or widower's rights, family exemption or similar
allowance or under the intestate laws; or the right to take against the spouse's will; or thc
right to treat a lifetime conveyance by the other as testamentary; or all other rights of a
surviving spouse to participate in a deceased spouse's estate, whether arising under the
laws ofPcnnsylvania, any state. commonweaIth or territory of the United States, or any
other country; or any rights which either party may now have or at any time hereafter
have for past, present or future support or maintenance, alimony, alimony pendcnte lite,
counsel fees, costs or expenses, whether arising as a result of the marital relation or
otherwise, except, and only cxcept, all rights and agreements and obligations of
whatsoever nature arising or which may arise under this Agreement or for the breach of
any provision hereof. Notwithstanding the foregoing, the parties expressly reserve any
claims for past or present support or maintenance, alimony, alimony pendente lite,
counsel fees, costs or expenses, as have previously accrued or hereafter accrue pursuant
to an Order of COUl1 previously or hereatier entered. It is the intention of Husband and
Wifc to give to eaeh other by the execution of this Agreement a fitll, complete and
general rclease with respeet to any and all property of any kind or nature, real, personal or
mixed, which the other now owns or may hereatier .lequire, except, and only except, all
rights and agreements and obligations of whatsoever nature arising or which may arise
under this Agreement or tlJr the breaeh of any prmision hereof.

7. J)JVISION OF 1I011SEIIOLD AND I'ERSONAL I'ROI'ERTY. The
parties hercto have divided he tween themselves, to their mutual satisfaction, all items of
tangiblc and intangible marital property. Neither party shall make any claim to any such
items of marital property, or of the separate personal property of either party, which arc
now in the possession and/or under the control of the other. Should it become neccssary,
the parties caeh agrce to sign, upon request, any titles or documents necessary to givc
effcct to this paragraph. I'roperty shall be deemed to be in the possession or undcr the
control of either party if. in the case of tangible personal property, the itcm is physically
in the possession or control of the party at the time of the signing of this Agreement, and
in the case of intangible personal property, ifany physical or written evidence of
ownership, such as passbook, chcckbook, policy or certificatc of insurance or other
similar writing is in the possession or control of the party. Anything to the contrary
contained herein notwithstanding, Husband and Wife shall be deemed to be in the
possession and control of any pension or other employee benefit plans or other employee
bcnefits of any nature to which either party may hal'e a I'csted or contingent right or
interest, apart from the provisions of the Dil'orce Code, at the time of the signing of this
Agreement.
8. VEHICLES. Each party shall rctain possession and ownership of any
I'ehicle which is presently in his or her possession as his or her separate property, free and
clear of any claim, right, title or intercst in the said \'ehicle by the other party.
9. DlSTlUBl1TION OF CASII ASSETS, STOCKS AND BONDS. Each
party shall retain as his or her separatc pwpCl1y, frce and clear of any claim, right, title or

interest by the other party any cash, bank accounts, mutual fund accounts, brokerage
accounts, stocks, bonds or other cash assets or depository accounts of uny nature now
titled in his or her respective name.
10. CAI'ITAL IlLUE CROSS I'ENSION. The parties acknowledgc that
Wifc is a participant in the Capital Blue Cross Retirement I'lan as a result ofhcr
employment with Capital Blue Cross. Wifi: shall retain the entire interest in the said
pension plan as her sole and separate property, and Husband hercby waives and
relinquishes any right, title, interest or claim he may have with rcgard to the said
retirement plan. Husband agrees to immediately upon request execute any waivers or
other documents as required by Wife's Plan Administrator to effectuate the provisions of
this Paragraph.
II. I'RUDENTIAL LIFE INSURANCE I'OLlCY NUMBER 97 648 323.
The parties acknowledge that Husband is the owner and insured on a Prudential Variable
Appreciable Life Insurance Policy No. 97 Cl48 323, having a policy face death benefit
amount of One Hundred Thousand Dollars (S I 00,000.(0). Husband agrees to maintain
said policy in full force and effi:ct for such period of time as he is responsible for the
payment of any alimony to Wife as setll)rth herein. Husband's ownership of the said
insurance policy shall be subject to the following conditions:
A. lie shall maintain the insurance in full forcc and effect, paying all
premiums due thereon in a timely !:lshion, and shall not borrow
against, assign, pledge or otherwise encumber the insurance to the
extcnt ofWife's said interest therein, nor surrender it to obtain its

cash value to the extent of Wife's said interest therein;
B. lie shall immediately designate Wife as the irrevocable beneficiary
to One lIundred Thousand Dollar (SI()O,OOO.OO) of the face death
benefit amount on the policy, such beneficiary designation to
continue in effect tor such time as Ilusband is obligated for the
payment of any alimony to Wifc as set forth herein;
C. Within thirty (30) days after the exeeution of this Agreement,
Husband shall deliver to Wire's attorney satisfactory proof that thc
aforesaid irrevocable beneficiary designation has been properly
endorsed on such policy and that the insurance company has
received notice of the restrictions placed upon Husband's ownership
of the said policy by the tenns of this Agreement. Husband shall
provide proof to Wife on at least a semi-annual basis of the payment
of all scheduled premiums as due.
12. ALlI\IONY. Ilusband shall pay to Wife alimony in the amount of Nine
Hundred Dollars (S<)OO.OO) per month, payable through the Domestic Relations Section of
Cumberland County, commcneing at the date of execution of this Agreement. Said
alimony shall be non-modifiable and shall continue indefinitely, except that it shall be
subject to tennination in the event of the death of either party or in the event that Wifc
remarries or cohabits with an unrelated male.
13. EFFECT OF SlIBSEOIJENT BANKRlIl'TCY. The parties agree that

none of Husband's obligations under the terms or this Agreement arc intended to be a
debt which is affected by a discharge in bankruptcy. They further specitically intend that
Husband's obligations under the tenns of this Agreement shall be non-dischargeable and
not subject to discharge in bankruptcy because thcy acknowledge that, based upon the
respectivc incomes, assets and needs or the parties and their households, such arc
necessary for Wifc to mcet her financial obligations and to support and maintain her
standard of living. Husband cxpressly agrees not to file a bankmptcy action, other than
the joint bankruptcy action heretofore filed by the parties as set forth in Paragraph 5
above, prior to the completion of his obligations pursuant to this Agreement. These
obligations shall not be discharged in a bankruptcy action filed by or against Husband.
If Husband files for bankruptcy contrary to the temlS of this Agreement, this
Agrcement shall constitute conclusive evidence of the parties' intent that the obligations
of this paragraph arc in the nature of maintenance and support, and arc not dischargeable
under current bankruptcy law or under any amendment thereto. Further, if Husband
institutes any action in bankruptcy or any other bankmptcy proceeding is instituted in
which Wife's right to payments or property hereunder becomes a malleI' for judicial
review, Husband agrees to consent to any motion tiled by Wife with the bankruptcy
courts, wherein she may request that [he bankruptcy courts abstain from deciding the
dischargeability of any and all obligations to her hereunder in order to allow the
appropriate Court of Common Pleas to rule upon this issue.
Further, in the event that either party becomes a debtor in any bankruptcy or
financial reorganization procecdings of any kind while any obligations remain to be
perfomled by that party Il)r the bcnetitof the other party pursuant to the provisions of this
Agreement, the dcbtor- spousc hcrehy wailcs, releases and rclinquishes any right to claim
any exemption (whethcr granted undcr statc or ti:derallaw) to any property remaining in

the debtor as a defense to any claim made pursuant hereto by the creditor-spouse, and thc
debtor-spouse hereby assigns, transti:rs and conveys to the creditor-spouse an intercst in
all of the debtor's exempt property sufticientto meet all obligations to the creditor-spouse
as set forth hercin, including all attorney's fi:es and costs.
14. SUI'I'ORT I'ROCEEDlNGS. The parties acknowledge that Husband
has been paying spousnl support to Wife through the Cumberland County Domcstic
Relations Section, docketed to No. 984 S 19'>7, I' ACSES Case No. 8041 OQDOS. The said
spousal support shall temlinate, effective as of the date of execution of this Agreement.
Husband shall, within ten (10) days of the date of execution of this Agreement, makc a
lump-sum pnyment to pay in tilll all outstanding support arrears as detemlined by the
Domestic Relations Section of Cumberland County.
15. COUNSEL FEES. Upon the execution of this Agreement, Husband
shall make a lump-sum payment to Wife's counsel in the amount of One Thousand
Dollars ($ 1 ,000.(0) as partial payment of Wife's counsel fees.
16. TAXES. By this Agreement, the parties have intcnded to effectuate and
by this Agreement have equally divided their marital property. The parties have
detemlined that such division confonllS to a right and just standard with regard to the
rights of each party. The division of cxisting marital property is not, except as may be
otherwise exprcssly providcd herein, intended by the parties to constitute in any wny a
sale or exchange of asscts, and the division is being efti:cted without the introduction of
outside filllds or othcr property not wnstituting a part of the marital cstate. As a part of
the cqual division ofthc marital property and thc marital scttlement hercin contained, the

COMPLAINT IN DIVORCE
UNDER SECTION 3301(c) OF THE DIVORCE CODE
1. Plaintiff is WILLIAM G. FREUNDEL, an adult individual
who currently resides at 7 C Tory Circle, Enola, Cumberland
County, Pennsylvania.
2. Defendant is MARY LOU FREUNDEL, an adult individual who
currently resides at 7 C Tory Circle, Enola, Cumberland County,
Pennsylvania.
3. Both Plaintiff and Defendant have been bona fide
residents in the Commonwealth for at lease six (6) months
immediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on May 25,
1968, in Enola, Cumberland County, Pennsylvania.
5. There have been no prior actions for divorce or
annulment between the parties.
6. Plaintiff has been advised of the availability of
counseling and the right to request that the Court require the
parties to participate in counseling.
7. Neither the Plaintiff or Defendant is a member of the
Armed Services of the United States or any of its Allies.
8. The Plaintiff avers that the ground on which the action
is based is that the marriage is irretrievably broken.
9. Plaintiff avers that there are no children of the
parties under the age of eighteen (18).
WHEREFORE, Plaintiff requests this Honorable Court to enter
a decree in Divorce dissolving the marriage between the parties
pursuant to Section 3301(c) of the Divorce Code of 1980, as
amended.

10. Plaintiff and Defendant have acquired real and personal
property during their marriage.

dated May 12, 1998, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on July 3, 1997, raising
grounds for divorce of irretrievable breakdown of the marriage
and the economic claim of equitable distribution. On October
22, 1997, the Defendant filed an answer and counterclaim. The
counterclaim raised the additional economic issues of alimony,
alimony pendente lite, and counsel fees and expenses.
I am going to proceed on the basis that grounds for
divorce are not an issue. Based on that assumption, I am
directing each counsel to file a pre-trial statement in
accordance with P.R.C.P. 1920.33(b) on or before Friday, June
12, 1998. Upon receipt of the pre-trial statements, I will
immediately schedule a pre-hearing conference with counsel

AND NOW, THIS 2nd day of February, 2000, come your
Petitioners, Clayton W. Davidson, Esquire and Francis M. Socha,
Esquire, whom request permission to withdraw as counsel for the
plaintiff in the above captioned matter and in support thereof
aver the following:
1. On July 3, 1997, the Plaintiff, through present
counsel, filed a complaint for divorce under 330l(C) with this
Honorable Court.
2. On September 17, 1999, the Plaintiff, through present
counsel, filed an amended complaint in divorce under 330l(D) and
thereafter requested the parties divorce action be listed for a
masters hearing.
3. On or about October 13, 1999, the Defendant filed her
Pre-trial statement, with the Cumberland County Divorce Master,
E. Robert Elicker, II, Esquire.
4. On October 15, 1999, the Plaintiff filed his Pre-trial
statement, which included his income and expense and inventory
and appraisement, with the Cumberland County Divorce Master, E.
Hobert Elicker, II, Esquire.
5. On October 18, 1999, Divorce Master Elicker scheduled a
pre-hearing conference for April 7, 2000 in response to the
Plaintiff's request for a masters hearing.
6. On or about December 1, 1999, the Defendant filed her
income and expense and inventory and appraisement.
7. Petitioners contend that the Plaintiff has failed to
follow the legal advice of his attorneys in numerous instances
which has strained the attorney-client relationship and has made
it impossible to continue.
8. petitioners further contend that on December 16, 1999
the Plaintiff, in a trenchant letter, instructed present
counselors to withdraw as his attorneys, indicated he would
represent himself and would not pay his outstanding legal bill.
9. Based upon the above, petitioners contend that it has
become impossible to maintain any reasonable and/or appropriate
attorney-client relationship with the Plaintiff.
10. Petitioners contends that the Defendant, Mary Lou
Freundel is represented by Constance P. Brunt, Esquire.
11. Petitioners contends they should be allowed to withdraw
as counsel since the Plaintiff would have sufficient time to
obtain substitute counsel prior to the April 7, 2000 pre-hearing
conference.
WHEREFORE, Petitioners respectfully request this Honorable
Court enter an order permitting them to withdraw as counsel for
the Plaintiff.

petition to withdraw as follows:

It is specifically denied that Plaintiff
failed to follow petitioner's advice.
Moreover, it was
petitioner
who
failed
to
follow
Plaintiff's
advice.
Plaintiff has been paying to Defendant support.
Plaintiff
advised petitioner to file for a Master in order to resolve
all support and economic claims pending.
Petitioner failed
to file at the inception of this case a complaint in divorce
under section 3301 (c) and (dl which would allow for a
no-fault divorce in 90 days or 2 years if Defendant did not
consent.
As pet it ionel- stated in piHi'lgl'aph 2 of pet i t ionel-' s
pet it ion, pet i t iOllel- filed Pla i nt iff's amended complaint
under section 3301 (d) in excess of 2 years thereby further
causing Plaintiff additional financial st.rain by allowing
this case to proceed longer than as provided under the laws
of this Commonwealth. Had petitioner followed Plaintiff's
request, then Plaintiff would not have suffered additional
financial damage.
8. Admitted in part and denied in part. It is admitted
that the undersigned advised petitioner to withdrawal. It
is denied that the Plaintiff's letter to petitioner was
cutting; rather, it is petitioner who deemed it to be such.
The letter instead was direct and to the point about
petitioner's failure to adequately and competently represent
the undersigned's interests in the pending divorce case.
Plaintiff's life and finances are at issue which Plaintiff
hired petitioner to adequately represent, Plaintiff was
entitled to have petitioner treat Plaintiff's case as
important. petitioner failed to do so. The letter was only
pointing such out to petitioner. Plaintiff was displeased
with petitioner'S services.
9. Denied. Based upon petitioner's failure to properly
and adequately handle Plaintiff's case, it is impossible [or
petitioner to continue to represent Plaintiff's interests.
10. Admitted.
11. Admitted in part and denied in part. It is admit.ted
that petitioners should be allowed to withdraw, It 1S
denied that Plaintiff will have sufficient t.ime to seek
subst itut.e counsel to pl'epan> fOl' th,' pending April 7, 2000,
Master's pretrial conference. Plaintiff will have to seek
out competent legal counsel and gather sufficient funds to
retain such. It is denied that a little over one month is
sufficient time to find counsel, retain counsel and allow
counsel to become satisfactorily acquainted with Plaintiff's
case.

counsel.
C.O.UNTERCLAIM
12. Plaintiff hereby incorporates preceding paragraphs 1
through 11 as if fully set forth herein.
13. Plaintiff has been caused to suffer financially as a
result of petitioners' failure to adequately, competently
and diligently represent Plaintiff's interests in this
matter.
14. Plaintiff instructed petitioner to file for a Master's
Hearing so that in accordance with the laws of this
Commonwealth, when the 2 years separation period culminated,
Plaintiff could proceed with a Master's Hearing to resolve
all outstanding economic issues relating to the marriage.
15. Contrary to Plaintiff's instructions, petitioner failed
to timely file for a Master's Hearing.
16. Moreover, petitioner filed an amended complaint for
divorce under section 33011d) 2 months after the statutorily
provided 2 year separation period.
17. As a resu1 t of petitioners' lack of diligence,
Plaintiff was caused to pay additional support to Defendant,
and incur additional costs by petitioner in petitioners'
preparation of the amended complaint documents.
18. Had petitioner competently represented Plaintiff's
interests, there would not have been an untimely amended
complaint filed; rather, at the inception of this case,
petitioner would have filed under section 3301(c) and (d) of
the Divorce Code and would have filed for a Master's Hearing
at a time which would have coincided with Plaintiff's 2 year
separation from Defendant.
19. Had petitioner competently represented Plaintiff's
interests, Plaintiff would not have incurred additional
attorney fees for the preparation of an amended complaint
and any associated fees after a Master's Hearing; moreover,
Plaintiff may not have been required to P3Y support to
Defendant as long as Plaintiff has been paying such.
WHEREFORE, Plaintiff respectfully requests your
Honorable Court to grant Plaintiff:
a. relief from any and all outstanding attorney
fees charged by Petitioner as they relate to
matters arising after July, 1999;
b. reimbursement by petitioner to Plaintiff of
all fees and costs paid by Plaintiff to petitioner
after July, 1999; and,
c. reimbursement by petitioner to Plaintiff of
any excess SUppOl't payment" made by Plaintiff to

Plaintiff contends that the Defendant is not entitled to
counsel fees due to her earning capacity, present income level and

XI. DISPUTES CONCERNING VALUE OF MARITAL PROPERTY:

XII. PROPOSED RESOLUTION OF ECONOMIC ISSUES:
Plaintiff believes, following a review of the factors set
forth in S3502 of the Pennsylvania Divorce Code, that equal
distribution is warranted and that the parties have equitably
divided their marital property.
Additionally, Plaintiff believes that the factors set forth in
S3701 of the Pennsylvania Divorce Code support an award of limited
alimony in the Defendant's favor for a period of four (4) years.
Finally, Plaintiff believes that the Court should not direct
the Plaintiff to pay Defendant's reasonable counsel fees and costs
and all Master's and Stenographic fees pursuant to S3702 of the
EXHIBIT A
