6. Subsequent to the purchase. PlaintiH discovered that the subject 1995 Acura had
been involved in a collision and had sustained extensive damages. in particular:
A. Damage requiring the replacement of and painting of the passenger
side of the vehicle;
B. Damage requiring the replacement of and painting of thB hood of thB
vehicle;
C. Scarred front brake rotors;
D. Missing stabilizer bar;
E. Extensive soldering of the internal structure;
F. Extensive rusting at joints cracked from impact;
G. Repair or replacement of the front fender on the driver's side; and
H. Repair to the trunk area,

value, a difference of $3,500.00.

20. Plaintiff purchased the subject vehicle primarily for personal or family use.
21. Defendant violated Section 3 of the Unfair Trade Practices and Consumer Protection
Law, 73 P.S.s201-2(4)(vii)&(xvii).
22. As a result of Defendant's violation of the Unfair Trade Practices and Consumer
Protection Law, Plaintiff suffered actual damages of 53,500.00.
WHEREFORE, Plaintiff prays this Honorable Court to enter a judgement for Plaintiff and
against Defendant and to award to Plaintiff treble damages, attorneys' fees and costs.

denied and proof thereof is demanded at trial. On the contrary,
the Defendant, through its sales agent, advised the Plaintiff
that the 1995 Acura in question had been previously damaged in
an accident and that repairs had been made to the vehicle.
Defendant's sales agent disclosed to Plaintiff all information
in his possession regarding the prior damage and Plaintiff made
no further inquiry or asked to have the vehicle examined
independently.

NEW MATTER
23. On or about March 4, 1996, Plaintiff purchased a 1996
Honda Civic from Defendant.
24. Subsequent to the purchase of the 1996 Honda Civic,
Plaintiff contacted Defendant and indicated that she wished to
trade in the 1996 Honda Civic on a vehicle with better
acceleration.
25. In September 1996, Defendant's sales representative
showed to Plaintiff the 1995 Acura Integra, the vehicle in
question. He advised Plaintiff that the vehicle had been
previously damaged in an accident and had been repaired.
26. Upon disclosure of the previous damage to Plaintiff,
Plaintiff made no further inquiry, made no inspection, and made
no request to have the vehicle independently inspected.
27. On September 27, 1996, Plaintiff signed a sales
contract, purchased the 1995 Acura Integra, and traded in her
1996 Honda Civic. Attached hereto, marked as Exhibit "AU, and

31. Under the terms of the contract there were no
warranties provided to Plaintiff upon sale of the vehicle other
than the factory warranty as specified above and Honda Care
Vehicle Service Coverage purchased by Plaintiff.
32. Any damage to the vehicle, as alleged by Plaintiff,
was caused by her own negligent conduct ill wrecking the vehicle
in an accident shortly after purchase from Defendant.
33. Plaintiff has failed to mitigate her damages.
