COMPLAINT
1. Plaintiff, NATIONWIDE MUTUAL INSURANCE, is an Ohio
corporation with a principal place of business located at 1137 A
Kennebec Drive, Chambersburg, Franklin County, Pennsylvania, who at
all times material hereto was the owner of a certain motor vehicle,
to wit: a 1994 Dodge Intrepid, which was then and there being
operated by Annette Long.
2. Defendant, TRACY CLARK, is an adult individual
residing at 678 Front Street, West Fairview, Cumberland County,
Pennsylvania, 17025 who at all times material hereto was the owner
of a certain motor vehicle, to wit: a 1985 Ford Econoline Van.
3. Defendant, BRENDAN CLARK, is an adult individual
residing at 678 Front Street, West Fairview, Cumberland County,
Pennsylvania 17025, who at all times material hereto was the
operator of a certain motor vehicle, to wit: a 1985 Ford Econoline
Van.

COUNT I - NEGLIGENCE
NATIONWIDE MUTUAL INSURANCE v. BRENDAN CLARK
4. The averments of paragraphs 1 through 4 are
incorporated by this reference as if set forth more fully herein.
5. On or about July 16, 1995, at 12:30 p.m., in the
parking lot of Uni-Mart located at Routes 11 and 15, West Fairview,
Cumberland County, Pennsylvania, Defendant Brendan Clark operated
a 1985 Ford Econoline Van in a negligent and careless manner, as
set forth more specifically herein, and caused the said 1985
Econoline Van to violently collide with the motor vehicle being
then and there driven by Annette Long.
6. At the aforesaid time and place, Defendant Brendan
Clark operated the 1985 Ford Econoline Van in such a negligent and
careless manner so as to cause extensive damage to the motor
vehicle owned by Plaintiff as more fully described hereafter.
7. The carelessness, recklessness and negligence of the
Defendant Brendan Clark consisted of the following:
a. failing to maintain proper and adequate control
over said automobile;
b. failing to use due care for the rights, safety
and position of others;
c. failing to use reasonable care under the
circumstances;
d. failing to keep a proper lookout;
e. operating said motor vehicle at an excessive

rate speed under the existing circumstances;
f. failing to obey and observe properly the
statutes of the Commonwealth of Pennsylvania regulating the proper
use of motor vehicles on the public streets and highways;
g. failing to observe the vehicle of the Plaintiff
upon the highway so as to avoid a cOllision;
h. operating the vehicle in a manner disregarding
the rights and safety of others so as to endanger any person then
and there lawfully travelling upon the roadway;
i. failing to have the vehicle under proper
control so that it could be readily stopped, turned aside or the
speed thereof slackened upon the appearance of danger.
8. As a result of the aforementioned cOllision, which
was directly and proximat~ly caused by the negligence and
carelessness of Defendant Brendan Clark, Plaintiff's automobile
sustained extensive damage in the amount of One Thousand Three
Hundred seventy-Five and 62/100 Dollars ($1,375.62).
9. Despi te demand, Defendant has paid no part of any of
the aforesaid damages suffered by Plaintiff.

WHEREFORE, Plaintiff demands judgment against Defendant
Brendan Clark in the amount of One Thou.and Three Hundred seventy-
Five and 62/100 Dollars ($1,375.62) together with interest and all
costs of this action as may be allowed by law and such other and
further relief as may be just and appropriate.
COUNT II - NEGLIGENT ENTRUSTMENT
NATIONWIDE MUTUAL INSURANCE v. TRACY CLARK
10. The averments of paragraphs 1 through 9 are
incorporated by this reference as if set forth more fully herein.
11. The negligence and carelessness of the Defendant,
TRACY CLARK consisted of the following:
a. entrusting and said vehicle to an individual
with known propensities for careless and reckless driving;
b. entrusting said vehicle to an otherwise
imprudent and irresponsible driver;
12. As a result of the aforementioned collision, which
was directly and proximately caused by the negligence and
carelessness of Defendant TRACY CLARK, Plaintiff's automobile
sustained extensive damage in the amount of One Thousand Three
Hundred Seventy-Five and 62/100 Dollars ($1,375.62).
13. Despite demand, Defendant TRACY CLARK have paid no
part of any of the aforesaid damages suffered by Plaintiff.
WHEREFORE, Plaintiff demands judgment against Defendant,
TRACY CLARK in the amount of One Thousand Three Hundred Seventy-
Five and 62/100 Dollars ($1,375.62), together with interest and all

Defendant in the within action, is over eighteen years of age, her
last known address is 678 West Front Street, West Fairview,
Pennsylvania and is not in the mili tary or naval service of the
United States of America, or otherwise within the provisions of the
Soldiers and Sailors Civil Relief Act of 1940 and its amendments.
I verify that the statements made in this Affidavit are true
