COMPLAINT
/. The plaintiff. Variety Machines, Inc., is a Pennsylvania corporation,
with a place of business located at 11h East Allen St., Mechanicsburg,
Cumberland County. Penna. 17055.
2. The defendants. Robert Lowe and June Smith, and operate a
business known as Smitty's Bar and Grill. located at 223 S. Union St.,
Middletown, PA 17057.
3.. On July 23. IYH2, the plaintiff loaned the defendants the sum of
$6,000. Said judgment note is attached hereto as Exhibit A.
4. On November 7, 19H5, the plaintiff and defendants entered into an
agreement whereby the said defendants borrowed Ten Thousand ($10.000)
Dollars from the plaintiff. Said agreement and a judj;l1lent note are attached
hereto as Exhibit B.
5. On March 12, IYH7, the plaintiff and defendants entered into an
agreement whereby the said defendants borrowed Six Thousand ($6,lJOO)
Dollars from the plaintiff. Said agreement and a judgment note are attached
hereto as Exhibit C.
6.. On February 2, 19HH, the plaintiff loaned the defendants the sum of
$3,OlJO. Said judgment note is attached hereto as Exhibit D.
7. On August 1. 1990, the plaintiff loaned the defl'ndants the sum of
$3,000. Said judgment note is attached herl'lo as Exhibit E.
H. On April 7, IYI)2, the plaintiff loaned the defendants the sum of
$2,000. Said judj;ment note is attached hereto as Exhibit F.
9. On January D, 1442, the plaintiff wrote a check in the amount of
$I.77H.2H, representing a payment to First Bank & Trust Co" on behalf of the
defendants. Said copy of check is attached hereto as Exhibit G.
10. On ~Iarch 2:l, 1992, the plaintiff IITIlte a dll'ck in the ,lnHlunt of
$3,H2H.12, rl'presenlinj; a p,l~'ment to First Bolnk & Trust Co" on behalf of the

COMPLAINT
1. The plaintiff. Variety Machines, Inc., is a Pennsylvania corporation,
with a place of business located at 116 East Allen St., Mechanicsburg,
Cumberland County, Penna. 17055,
2. The defendants, Robert Lowe and June Smith, and operate a
business known as Smitty's Bar and Grill, located at 223 S. Union St.,
Middletown, P A 17057.
3,. On July 23, 1982, the plaintiff loaned the defendants the sum of
$6,000. Silid judgment note is attached hereto as Exhibit A,
4, On November 7, 1985, the plaintiff and defendants entered into an
agreement whereby the said defendants borrowed Ten Thousand ($10,000)
Dollars from the plaintiff. Said agreement and a judgment note are attached
hereto as Exhibit B.
5, On March 12, 1987, the plaintiff and defendants entered into an
agreement whereby the said defendants borrowed Six Thousand ($6,000)
Dollars from the plaintiff. Said agreement and a judgment note are attached
hereto as Exhibit C.
6.. On February 2, 1988, the plaintiff loaned the defendants the sum of
$3,000. Said judgment note is attached hereto as Exhibit D.
7. On August 1, 1990, the plaintiff loaned the defendants the sum of
$3,000. Said judgment note is attached hereto as Exhibit E.
8. On April 7, 1992, the plaintiff loaned the defendants the sum of
$2,000. Said judgment note is attached hereto as Exhibit F.
9. On January 23, 1992, the plaintiff wrote a check in the amount of
$1,778.28, representing a payment to First Bank & Trust Co., on behalf of the
defendants. Said copy of check is attached hereto as Exhibit G.
to. On March 23, 1992, the plaintiff wrote a check in the amount of
$3,828.12, representing a payment to First Bank & Trust Co" on behalf of the
defendants. Said copy of check is attached hereto as Exhibit H.
1 I. The last payment made on these obligations was in the amount of
$100 paid on July 15, 1996, leaving a b.l\.lIlce owing of $14,416.00, plus 10%
interest in the .1Il1l1unt of $1.4-l 1.60 and attornevs fees of 5";, in the amount of
$720.80, on the unp.lid bal.lIlce. Said account sl{eet is .1ltached hereto as
Exhibit I.

COMPLAINT
1. The plaintiff. Variety Machines, Inc., is a Pennsylvania corporation,
with a place of business located at 116 East Allen St., Mechanicsburg,
Cumberland County, Penna. 17055,
2, The defendants, Robert Lowe and June Smith, and operate a
business known as Smitty's Bar and Grill, located at 223 S. Union St.,
Middletown, P A 17057.
3., On July 23, 1982, the plaintiff loaned the defendants the sum of
$6,000. Said judgment note is attached hcreto as Exhibit A,
4, On Novcmber 7, 1985, the plaintiff and defendants entered into an
agrecment whereby thc said defendants borrowed Ten Thousand ($10,000)
Dollars from the plaintiff. Said agreement and a judgment notc are attached
hereto as Exhibit B.
5. On March 12, 1987, the plaintiff and defendants entered into an
agreement whereby the said defendants borrowcd Six Thousand ($6,000)
Dollars from the plaintiff. Said agreement and a judgment note are attached
hereto as Exhibit C.
6.. On February 2, 1988, the plaintiff loancd the defendants the sum of
$3,000. Said judgment note is attached hereto as Exhibit D.
7. On August 1, 1990, the plaintiff loaned the defendants the sum of
$3,000. Said judgment note is attacheq hereto as Exhibit E.
8. On April 7, 1992, thc plaintiff loaned the dcfcndants thc sum of
$2,000. Said judgmcnt note is attached hereto as Exhibit F.
9. On January 23, 1992, the plaintiff wrotc a chcck in the amount of
$1,778.28, reprcsenting a payment to First Bank & Trust Co., on behalf of the
defendants. Said copy of check is attached hereto as Exhibit G.
10. On March 23, 1992, the plaintiff wrote a check in the amount of
$3,828.12, representing a paYl1lcnt to First Bank & Trust Co., on bchalf of the
dcfendants. Said copy of check is attached hereto as Exhibit H.
11. The last payment l1lade on these obligations was in the amount of
$100 paid on July 15, 1996, leaving a balance owing of $14,416.00, pluslll%
interest in the amount of $1,441.60 and attorneys fees of 5"~ in the amount of
$720.80, on the unpaid balance. Said account sheet is attached hereto as
Exhibit I.

5, At the time of the aforesaid Agreements, notes and checks, the said
defendants, were the owners and operators Smitty's Bar & Grill, located at 223
S. Union St., Middletown, PA 17057.
WHEREFORE, plaintiff claims of the defendants the sum of $16,578.40,
an amount within the sum requiring compulsory referral to arbitration
under the local rules of court.
