7. In consideration of the dlstributioli of personal
property agreed to herein, the alimony pendente lite order
presently pending against the Defendant through the
Cumberland County Domestlc Relatior:s Office shall remain in
effect until January 1, 2001. This alimony perldente lite
shall convert to an alinlony orde::: at the time of entry of
the parties' dec:::ee in divorce. This alimony order shall
be norunodifiable to end at the death of ci the::: party or at
the set termination date of Janua:::y I, 2001. However, this
alimony payment shall not cease if wife cohabits or
remarries. It is unde:::stood that the alimony pendente lite

6. Defendant failed 10 refinance the loan on the mobile home in breach of
the stipulated Marital5clllemenl Agreement, and to satisfy the mortgage.
7, On October II, 2004,I'laintiff received a "Final Notice" from, Synergetic
Communication, Inc. slating that there was an outstanding debt of $16,283.21 owed to
Greenpoint Credit Corp. as the balance on the mortgage to the mobile home. A copy
of said letter is attached hereto and incorporated herein by reference as Exhibit B,
8. On October 21, 2004, Plaintiff paid 52,900.00 as settlement and payment
in full of the mortgage against the mobile home, in return for all collection matters
againstl'laintiff ccasing. A copy of said letter is attached hereto and incorporated
herein by reference as Exhibit C.
9. Plaintiff received a letter from Greenpoint Credit on November 3D, 2004,
confirming receipt of the 52,900.00 as a final settlement on the mortgage. A copy of

dated July 9, 1999, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on July 7, 1997, raising
grounds for divorce of irretrievable breakdown of the marriage
and indignities and the economic claims of equitable
distribution, alimony pendente lite, and counsel fees, costs,
and expenses. No claim for alimony has been raised,
I am going to proceed on the assumption that grounds for
divorce are not an issue and that the parties will either sign
affidavits of consent or have been separated for a period in
excess of two years. I also note that Mr, DeArment is listed as
the attorney for the Defendant in the motion for appointment of
Master; however, Mr. DeArment has not entered his appearance in
the action. I am sending a courtesy copy of this letter to Mr.
DeArment.
In accordance with P,R.C.P. 1920,33(b) I am directing

Present for the Plaintiff, Pennie L. Bupp, is
attorney Bradley L. Griffie, and present for the Defendant,
Bruce A. Bupp, Jr., is attorney Mark D. Schwartz.
This action was commenced by the filing of a
divorce complaint on July 7, 1997, raising grounds for
divorce of irretrievable breakdown of the marriage and
indignities. Counsel have indicated that their clients
will sign and file affidavits of consent and waivers of
notice of intention to request entry of divorce decree so
that the divorce can be concluded under Section 330l(c) of
the Domestic Relations Code. These documents should be
prepared and brought along to the conference which we are
going to schedule with the parties and counsel so they can
be executed at that time.
The complaint also raised the economic claims
of equitable distribution, alimony pendente lite, and
counsel fees and costs. No claim has been raised for
alimony.
The parties were married on October 15, 1988,
and separated June 30, 1997. This is the second marriage
for both parties. There are no children of this marriage.
Wife has two children of a prior marriage.
Wife is 37 years of age and resides at 21
Appalachian Trial Road, Gardners, Pennsylvania, where she
lives with a male friend and a minor child of a prior
marriage. She is a high school graduate and is a cast
finisher for Susquehanna Pfaltzgraff. Her net monthly
income as stated on a support order dated June 17, 1998, is
$1,259.00. Wife does not have any health issues; she did
have some time off work in 1999 to have carpal tunnel
surgery but she apparently is back to work full-time. Wife
is receiving $282.00 per month as alimony pendente lite.
She has health insurance coverage through her employment.
Husband is 44 years of age and resides at 46
Ballpark Drive, Gardners, Pennsylvania, where he lives with
a female friend. Husband is not a high school graduate but
we do not know what grade he finished before he quit school.
He is a general laborer at Carlisle Syntec. As reported on
the support order dated June 17, 1998, his net monthly
income is $1,900.00. Husband has not raised any health
issues. He has medical insurance coverage through his
employment.
The parties own a mobile home which is
situated on land owned by husband's mother. The mobile
home is located at 46 Ballpark Drive, Gardners,
Pennsylvania, where husband is currently residing. There
has been some discussion about what the value of the home is
and also what payoff is owed to Bank America Housing on the
mortgage. Counsel need to determine the equity in this
property and will perhaps have the property appraised or
husband will agree to list the property for sale and let the
market decide the value. In any event, we need to know
what the mortgage payoff is and the status of the mortgage
payments since separation so we can determine the parties'
equity interest in the property. The mobile home is a 1989
Chesapeake.
The parties have owned various vehicles
through the course of the marriage. After reviewing the
history of the vehicles, it appears that the 1986 Nissan
pickup truck was traded in to purchase, after separation, by
husband, a 1997 Nissan pickup truck. We need the trade in
value of the 1986 truck which would be a marital asset.
The Subaru was traded in on a Toyota 4-Runner which was then
returned to the creditor on a voluntary repossession. We do
not have any information as to whether or not there is any
deficiency judgment on that vehicle but one would assume
because so much time has elapsed, there are no claims
pending against the parties. The 1991 Ford Probe was
demolished and the loan against that vehicle was paid off
and some of the proceeds were used to payoff other marital
debt.
Husband has a pension wlth Carlisle
Companies, Inc. which counsel intend to distribute using a
Qualified Domestic Relations Order. Husband also has a
401 (k) which had a value as of December 31, 1997, of
$154.95.

determine the balance of that loan as of the date of
separation. Mr. Griffie advised that he thought the loan
was paid down to $776.93 but we nped to verify that number.
Husband would be partly responsible for paying that debt so
wife would be entitled to some credit since the monthly
payments have been deducted from her paycheck.
The household tangible personal property
remained in husband's possession when wife left and counsel
intend to have that property appraised. Also, there ha:;
been an issue raised regarding husband's destruction of
premarital property which wife and her children brought into
the marriage but which she was unable to remove at the time
that she left. Apparently, according to wife's counsel,
husband set the items out in the weather and they were all
destroyed. Mr. Griffie suggests that perhaps the value of
those items were $1,000.00 to $1,500.00.
Wife has raised a question about whether or
not husband has a State Farm Life insurance policy. We need
to know whether that is a whole life or term policy, if the
policy in fact exists. If it is a whole life policy, we
need to know the cash surrender value as of the date of
separation.
In reviewing the debts of the parties as
listed on the pretrial statements, the only debt that
appears to be currently owed is the Bank America Housing
mortgage. There is some question also about a pool 10iln
with Chrysler Credit but counsel are not certain about the
status of that loan. Mr. Schwartz thought there may be il
judgment of $8,000.00 entered but we need to know if the
judgment is entered and if it is against both parties or
just one of the parties. Apparently Chrysler Credit has
made no effort to collect the loan and Mr. Griffie indicates
that according to his information Mr. Bupp put a new pool
liner in the pool last summer.
Counsel have suqqested that it may be helpful
to try to resolve this case throuqh a four-party conler"l!l:e.

7, Despite repeatcd requests by Petitioner, Petitioncr's prior counsel, and
Pctitioner's prescnt counsel, Rcspondcnt has bccn unwilling to releasc personal property of
the PlaintilTwhich includcs the Pctitioncr's childrcn's bicyclcs, bcds, clothing, pcrsonal
pictures, family picturcs, as wcll as pcrsonal propcrty of the c1icnt's, including her clothing
and some limitcd non-marital itcms.
8, It is believed and thererorc averred that the Respondent is selling or
otherwise disposing of the Petitioncr's pcrsonal property and the personal property of
Pctitioner's children.
9. Petitioncr rcquires Court intcrvcntion to havc thc Respondcnt comply with
rcleasing the pcrsonal propcrty of thc Pctitioner and Pctitioner's children to the Petitioner.
10. There is no basis in law for the Respondcnt to retain the personal items,

alimony provision. Therefore, Mr. Griffie is going to
immediately file a petition raising the alimony claim of
record so that when the parties return later today to review
the agreement and affirm the terms of settlement, the
alimony claim will have been filed of record.
The parties were married on October 15, 1988,
and separated June 30, 1997. There are no children of this
marriage.
After considerable negotiations this morning,
the Master has been advised that the parties have reached a
comprehensive agreement with respect to the economic issues.
The agreement is going to be placed on the record in the
presence of the parties. The agreement as placed on the
record will be considered the substantive agreement of the
parties not subject to any changes or modifications except
for correction of typographical errors which may be made
during the transcription. Counsel and the parties are going
to return later today to review the draft of the agreement
for typographical errors, make any corrections as required,
and then affix their signatures uffirming the terms of the
agreement as placed on the record.
After the Master has been provided a signed
copy of the agreement, which has been affirmed by parties
and counsel, the Master will prepare an order vacating his
appointment so that counsel Cdll file a praecipe trallsmitting
the record to the Court requesting a final decree in
divorce. Mr, Griffie.
MR, GRIFFIE: If the Master please, in this
case the parties stipulate and agree to resolve all claims
made in this case as follows:
1. All personal property in each parties' possession will
remain their sole property and possession from this time
forward. This is to include not only household furnishings,
appliances and the like, but also intangible personal
property such as bank accounts or other investment accounts
and all motor vehicles. In the event it is determined that
either party needs to sign any documents to waive,
relinquish, or transfer any interest in any such personal
property, the party who must sign will do so within 15 days
of being requested to do so.
2. Plaintiff's retirement benefits through her employment
with Pfaltzgraff, which is a 401(k) account, is and shall
remain her sole property. Defendant waives any claim to
any interest whatsoeve~ in the Pfaltzgraff retirement
benefi t.
3. The parties acknowledge that there is a judgment
recorded against them by Chrysler First Consumer Discount
Company, which judgment was entered in 1992. In addition,
it is understood that there is a deficiency due and owing
for the return of a 1994 Toyota 4x4 which the parties
purchased prior to their separation. With respect to any
deficiency or deficiency judgment, or the deficiency to
Chrysler, the parties agree that they will simply allow
those debts to remain as is: meaning that neither of them
are obligated to make any specific payment on those debts
and neither of them are responsible in any specific
proportions to repay those debts should claims be made by
either of those creditors in the future, but rather, the
parties will simply allow those creditors to attempt to
collect as they desire in the future.
4. Through husband's employment at Syntec wit.h Carlisi"
Companies, he is a participant in il 401 (k) pI Ill. The

anticipated that this will be an extremely small plan and,
therefore, if the balance in that account as of the date of
separation is less than $500.00, wife will make no claim
whatsoever against that plan and will receive no benefit
from husband or from that plan.
In the event. the 401(k) has a value in excess of $500.00,
husband will compensate wife 1/2 of that date of separation
value within thirty (30) days of receipt of the statements.
5. In addition, husband is involved in a defined benefit
retirement plan through his retirement with Syntec. The
parties are in the process of securing a statement from
Syntec reflecting the marital portion of that retirement
benefit. Counsel for Plaintiff shall prepare a Qualified
Domestic Relat.ion Order providing for wife to receive 50~ of
the marital portion of Defendant's Syntec retirement plan.
Both parties will sign that document so it can be submitted
to the Court and filed with Syntec in a prompt and
reasonable fashion.
6. The parties are the joint owners of a mobile home
located at 46 Ballpark Drive, Gardners, Cumberland County,
Pennsylvania. The mobile home at present is held in joint
names. The parties, through Defendant's counsel, will
secure a payment history on the mortgage or loan on that
property which is presently due and owing to Green Point
Credit. The parties will then determine the date of
separation balance on that debt. In the event the date of
separation balance exceeds $15,000.00, wife shall receive no
benefit or contributioll of any nature relative to her
interest in the mobile home.
Under those circumstances, husband shall refinance the loan
on the mobile home and at which time wife shall execute the
title conveyill') all of her riqht, ti tle, and interest to the

right, title, and interest to the mobile home to husband.
7. In consideration of the distribution of personal
property agreed to herein, the alimony pendente lite order
presently pending against the Defendant through the
Cumberland County Domestic Relations Office shall remain in
effect until January 1, 2001. This alimony pendente lite
shall convert to an alimony order at the time of entry of
the parties' decree in divorce. This alimony order shall
be nonmodifiable to end at the death of either party or at
the set termination date of January 1, 2001. However, this
alimony payment shall not cease if wife cohabits or
remarries. It is understood that the alimony pendente lite
order, which presently stands at $65.00 per week shall
remain at that same sum once the alimony pendente lite is
converted to an alimony order.
8. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the other as a result of the marital
relationship including without limitation, statutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, and right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims.

TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
Petitioner, Pennie L. Neal, by her counsel, Saidis, Shuff, Flower & Lindsay, files
this petition to enforce divorce settlement and respectfully represents in support
thereof:
1. Petitioner, plaintiff in this action, currently resides at 21 Appalachian
Trail Road, Gardners, Pennsylvania 17324.
2. Respondent, defendant in this action, currently resides at 1199
Green Spring Road, Newville, Pennsylvania 17241.
3. The parties to this action were married on October 15, 1988, separated on
June 30, 1997, and a complaint for divorce was filed on July 7, 1997.
4. On Apri112, 2000, the parties appeared before the Divorce Master to
have their property settlement agreement entered into the record. A copy of the
agreement is attached hereto and incorporated herein by reference as Exhibit A.

Paragraph six (6) of the Agreement states that Defendant agreed to
refinance the loan on the mobile home and pay it in full, after which Plaintiff agreed to

convey title to the mobile home to the Defendant, conveying all of her right, title and
interest in said mobile home.
6. Defendant failed to refinance the loan on the mobile home in breach of
the stipulated Marital Settlement Agreement, and to satisfy the mortgage.
7. On October 11,2004, Plaintiff received a "Final Notice" from, Synergetic
Communication, Inc. stating that there was an outstanding debt of $16,283.21 owed to
Greenpoint Credit Corp. as the balance on the mortgage to the mobile home. A copy
of said letter is attached hereto and incorporated herein by reference as Exhibit B.
8. On October 21, 2004, Plaintiff paid $2,900.00 as settlement and payment
in full of the mortgage against the mobile home, in return for all collection matters
against Plaintiff ceasing. A copy of said letter is attached hereto and incorporated
herein by reference as Exhibit C.
9. Plaintiff received a letter from Greenpoint Credit on November 30, 2004,
confirming receipt of the $2,900.00 as a final settlement on the mortgage. A copy of
said letter is attached hereto and incorporated herein by reference as Exhibit D.
10. As a result of Defendant's deliberate breach of the stipulated Marital
Settlement Agreement, Plaintiff suffered damages of $2,900.00, plus interest, attorney's
fees and court costs.
11.
Defendant's breach of the stipulated Marital Settlement Agreement as set
forth above was arbitrary, vexatious and in bad faith.
